Preconditions of the reorganization approval and its consequences
No full textThe thesis is focused on the preconditions of the reorganization approval and the consequences related to this step which is one of the methods of entrepreneurs’ insolvency resolution. Specifically, the aim of this work is to analyse the preconditions of the approval of the reorganization and thoroughly evaluate whether they are properly applied in practice.The preconditions of the reorganization approval are not explicitly defined in the Insolvency Act and are defined on different places of the Insolvency Law, both in the general provisions and within the specific rules of reorganization procedure. In the frame of the examined topic, the author first defined a comprehensive overview of the preconditions of the reorganization approval and closely analysed them. Furthermore, the author evaluated the application of these preconditions in practice by comprehensive research of all available decisions of the insolvency courts related to reorganizations. Based on the research followed by analyses the author concluded that the conditions for the authorization of reorganization are generally applied correctly by insolvency courts. At the same time, the author identified situations that were not sufficiently defined by the Insolvency Act and had to be interpreted by case-law. The author generalized such cases and recommended applying them in all insolvency proceedings. In particular cases the author recommended also to incorporate them into the next amendment of the Insolvency Act.Tato práce se zabývá problematikou podmínek povolení reorganizace a důsledků spojených s tímto krokem, který je jedním ze způsobů řešení úpadku podnikatelů. Konkrétně je cílem této práce zkoumat nastavení podmínek povolení reorganizace a podrobně zhodnotit, zda jsou správně aplikovány v praxi.Podmínky povolení reorganizace nejsou insolvenčním zákonem nijak explicitně definovány a jsou uvedeny na různých místech insolvenčního zákona v obecných ustanoveních, i jednotlivých ustanoveních týkajících se reorganizace.V rámci zkoumaného tématu tedy autor nejprve zpracoval ucelený přehled podmínek povolení reorganizace a podrobně je rozebral. Následně autor zmapoval všechny případy, ve kterých bylo o reorganizaci požádáno, a vyhodnotil aplikaci podmínek povolení reorganizace v praxi.Při zkoumání daného tématu došel autor k závěru, že podmínky povolení reorganizace jsou insolvenčními soudy aplikovány vesměs správně. Zároveň autor identifikoval situace, které nejsou insolvenčním zákonem dostatečně vymezeny a muselo tak dojít k jejich výkladu judikaturou.Takto vymezené vybrané případy autor zobecnil a doporučil je aplikovat v rámci všech insolvenčních řízení. Ve vybraných případech pak autor doporučil i jejich zapracování do textu insolvenčního zákona v rámci možné další novelizace

counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed
Variations on the Author
Get PDF“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship
Appropriate Similarity Measures for Author Cocitation Analysis
Get PDFWe provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature. No full textThe diploma thesis concerns with issues of the hunt as a part of the nobleman representation and its image in facilities of the Czech hunting chateaus. The introductory chapters of this these describe the phenomena of hunt, its evolution and its image in fine art. These chapters are subsequently filled in iconographical drafts, which helped to form the shape of the decoration of chateaus. The core of the thesis are chapters concern with theme of the hunting architecture and artistic evaluation of the group nobleman hunting residences. Specifically, these are chateaus Svaty Hubert, Humprecht, Diana, Ohrada and Kozel. In the final chapters the author introduces an issue of nobleman representation. Into its context he situates the theme of hunt and pieces of fine arts connected with it. These chapters also contain a few examples of the aristocrats who knew how to use the hunt for their personal representation. For illustration is this thesis amended by picture attachment
