No full textВ статье рассматриваются общие правила (начала) назначения административного и уголовного наказаний. Делается вывод о том, что законодательное отражение общих правил (начал) назначения наказания более обосновано не только содержательно, но и структурно в Уголовном кодексе Российской Федерации, нежели чем в Кодексе Российской Федерации об административных правонарушениях. Анализируются обстоятельства, смягчающие и отягчающие административную ответственность (уголовное наказание). Констатируется, что законодательные положения в этой части относительно универсализированы. Далее определяются правила учета смягчающих и отягчающих обстоятельств, а также их конкретно-прикладное влияние на индивидуализацию наказания– определение конкретного вида, срока или размера. Отмечается, что разумная формализация законов в части назначения наказания– явление полезное и даже необходимое. Основываясь на положениях ст. 62 УК РФ, предложен вариант определения уголовно-правовой значимости отдельно взятого (смягчающего или отягчающего) обстоятельства. В целях единообразия судебной практики предлагается «оценивать» фиксированную степень уголовно-правовой значимости смягчающего или отягчающего наказание обстоятельства в пределах от 1/3 до 1/6 от его максимальной меры по санкции Особенной части УК РФ. Это правило может распространяться и на процесс назначения административного наказания.The article looks into the general rules (or general foundations) of inflicting the administrative and criminal punishments. The author concludes that the legislative reflection of the general rules (foundations) of punishment inflicting is both more substantial and structurally drawn in the Criminal code of the Russian Federation, than in the Code of the Russian Federation about administrative offenses. The circumstances of softening and aggravating the administrative responsibility (and the criminal penalty) are analyzed. It is noted that the legislative provisions in this part are rather universalized. Then the author defines the rules for the accounting of the softening and aggravating circumstances and their influence on the punishment individualization by defining a certain type, term or length of a punishment. It is noted that the reasonable formalization of laws regarding the punishment inflicting is a useful and even necessary phenomenon. Based on Article 62 of the Criminal Code of the Russian Federation, the author offers the option of determining the criminal and legal importance of a single taken (softening or aggravating) circumstance. For the sake of uniformity of jurisprudence, it is offered «to estimate» the fixed degree of the criminal and legal importance of the circumstance softening or aggravating a penalty ranging from 1/3 to 1/6 from a maximum penalty according to the sanction of Special part of the Criminal Code of the Russian Federation. It is possible to refer the rule to the process of inflicting the administrative punishment as well
Evidence of a dibaryon spectrum in coherent photoproduction at forward deuteron angles
No full textThe coherent reaction, was studied with the BGOOD experiment at ELSA from threshold to a centre-of-mass energy of 2850\,MeV. A full kinematic reconstruction was made, with final state deuterons identified in the forward spectrometer and decays in the central BGO Rugby Ball. The strength of the differential cross section exceeds what can be described by models of coherent photoproduction and instead supports the three isoscalar dibaryon candidates reported by the ELPH collaboration at 2.38, 2.47 and 2.63\,GeV/c. A low mass enhancement in the invariant mass is also observed at the centre-of-mass energy which is consistent with the ABC effect. At higher centre-of-mass energies, a narrow peak in the invariant mass at 2114\,MeV/c with a width of 20\,MeV/c supports a sequential two-dibaryon decay mechanism.8 pages, 10 figures. Measurement of the γ n → K0 0 differential cross section over the K∗ threshold
No full textThe differential cross section for the quasi-free photoproduction reaction gamma(n)-> K-0 Sigma(0) was measured at BGOOD at ELSA from threshold to a centre-of-mass energy of 2400 MeV. Close to threshold the results are consistent with existing data and are in agreement with partial wave analysis solutions over the full measured energy range, with a large coupling to the Delta(1900)1/2(-) evident. This is the first dataset covering the K* threshold region, where there are model predictions of dynamically generated vector meson-baryon resonance contributions
