Application of Contra Legem Principles in Judicial Rulings on Joint Property Characteristics
This article examines the nuanced application of the contra legem principle by judicial panels in the adjudication of community property cases, particularly in the context of marital property. It highlights the evolving legal landscape and the importance of equitable distribution in contemporary law, underscoring the need to understand judicial reasoning in an era increasingly focused on fairness and gender equality. The study closely examines cases from religious courts, highlighting a trend in which judges have awarded a disproportionate share of community property to wives. This observation raises important questions about the balance between legal norms and the pursuit of equity in family law, and provides a critical lens through which to explore the dynamics of asset distribution and its broader implications in current legal frameworks. The research aims not only to outline judges\u27 distribution formulas, but also to offer insights into why such decisions are increasingly relevant in today\u27s legal discourse, marking a significant shift toward recognizing the complexities of marital property division. This study uses qualitative research methods with a legal descriptive analysis approach. A thorough legal source is case number 413/Pdt.G/2021/PA.Tng and a number of other legal materials related to the author\u27s research topic. The results of the study show that the panel of judges applied the contra legem principle in deciding this matter based on sociological considerations and distributive justice

This article focuses on congregational singing in the German Protestant churches in the 19th century, aiming to gain insight in the congregational singing in the Netherlands, as the Dutch church musicians were strongly influenced by and often educated in Germany. Did female prisoners with mental disorders receive psychiatric treatment before imprisonment?

unless otherwise stated.BackgroundThroughout the world, high prevalence rates of mental disorders have been found in prison populations, especially in females. It has been suggested that these populations do not access psychiatric treatment. The aim of this study was to establish rates of psychiatric in- and outpatient treatments prior to imprisonment in female prisoners and to explore reasons for discontinuation of such treatments.Methods150 consecutively admitted female prisoners were interviewed in Berlin, Germany. Socio-demographic characteristics, mental disorders, and previous psychiatric in- and outpatient treatments were assessed by trained researchers. Open questions were used to explore reasons for ending previous psychiatric treatment.ResultsA vast majority of 99 prisoners (66%; 95% CI: 58¿73) of the total sample reported that they had previously been in psychiatric treatment, 80 (53%; 95 CI: 45¿61) in inpatient treatment, 62 (41%; 95 CI: 34¿49) in outpatient treatment and 42 (29%; 21¿39) in both in- and outpatient treatments. All prisoners with psychosis and 72% of the ones with any lifetime mental health disorder had been in previous treatment. The number of inpatient treatments and imprisonments were positively correlated (rho¿=¿0.27; p¿<¿0.01). Inpatient treatment was described as successfully completed by 56% (N¿=¿41) of those having given reasons for ending such treatment, whilst various reasons were reported for prematurely ending outpatient treatments.ConclusionThe data do not support the notion of a general `mental health treatment gap¿ in female prisoners. Although inpatient care is often successfully completed, repeated inpatient treatments are not linked with fewer imprisonments. Improved transition from inpatient to outpatient treatment and services that engage female prisoners to sustained outpatient treatments are needed
Perilaku seksual menyimpang dalam Al-Qur'an: Studi tematik penafsiran Hamka analisis psikologi seksual
ABSTRAK
Al-Qur’an mempunyai fungsi sebegai petunjuk bagi manusia, seiring berkembangnya zaman persoalan yang dihadapi umat manusia juga semakin banyak salah satunya adalah masalah LBGT. LGBT dalam Al-Qur’an sering dikaitkan dengan perbuatan penyimpangan seksual kaum Nabi Luth. Penelitian ini fokus pada telaah ayat-ayat tentang perilaku seksual menyimpang Kaum Nabi Luth dalam tafsir al-Azhar, karya seorang ulama nusantara, Hamka.
Penelitian ini bertujuan untuk mengetahui bagaimana pandangan Hamka mengenai perilaku seksual menyimpang dalam Tasir Al-Azhar dan mengetahui bagaimana pandangan psikologi seksual terhadap perilaku seksual menyimpang dan faktor-faktor yang mempengaruhi penyimpangan seksual dalam Tafsir Al-Azhar.
Pada kajian ini penulis menggunakan kajian kepustakaan (library research) dengan menggunakan metode kulaitatif dengan pendekatan tafsir maudhu’i. Penelitian ini berusaha menghimpun ayat-ayat yang berkaitan dengan perilaku penyimpangan seksual kaum Nabi Luth kemudian dianalisis dengan menggunakan teori psikoseksual Sigmund Freud.
Kajian ini menghasilkan kesimpulan bahwa penyimpangan seksual pada Kaum Nabi Luth dalam Tafsir Al-Azhar merupakan perilaku homoseksual. Perbuatan homoseksual kaum Nabi Luth terjadi baik pada laki-laki maupun perempuan, dengan tindakan sodomi (anal seks) sebagai praktiknya. Faktor-faktor penyebab penyimpangan seksual pada Kaum Nabi Luth diantaranya adalah kenangan masa lalu kaum amrad yang diajdikan sebagai objek libido kaum laki-laki dewasa Nabi Luth, pengaruh lingkungan yang tidak menguntungkan bagi perkembangan seksual orang-orang Sodom, seks bebas dan kebutuhan seksual perempuan Kaum Nabi Luth yang tidak terpenuhi sehingga menimbulkan tindakan penyimpangan seksual.
ABSTRACT
Al-Qur'an has a function as a guide for humans, along with the development of the times the problems faced by mankind are also increasing, one of which is the issue of LBGT. LGBT in the Qur'an is often associated with the sexual perversion of the Prophet Lut.
This study aims to find out how Hamka views deviant sexual behavior in Tasir Al-Azhar and to find out how sexual psychology views deviant sexual behavior and the factors that influence sexual deviation in Tafsir Al-Azhar.
This study focuses on examining verses about the deviant sexual behavior of the Prophet Lut in the interpretation of al-Azhar, by an Indonesian cleric, Hamka. In this study, the author uses library research using a qualitative method with a maudhu'i. This study attempts to collect verses related to the sexually deviant behavior of the Prophet Lut and then analyzed them using the theory of sexual psychology.
This study concludes that sexual deviation in the Prophet Lut in Tafsir Al-Azhar is homosexual behavior. Homosexual acts of the Prophet Lut happened to both men and women, with acts of sodomy (anal sex) as a practice. The factors that cause sexual deviation in the people of the Prophet Lut include the memories of Amrad's past, environmental influences that are not favorable for sexual development, free sex, and unfulfilled sexual needs.
