Identification of the local stiffness reduction of a damaged composite plate using the virtual fields method
No full textIn the present study, a damage detection problem is formulated as the identification of the spatial stiffness distribution in a damaged composite plate. Full-field heterogeneous curvature fields obtained from an optical deflectometry technique are processed by using the virtual fields method adapted to retrieve the 2D stiffness distribution map of a damaged carbon-epoxy plate. The method not only picks up the location of the damage but also provides a fairly good estimate of the stiffness reduction in the damaged area. In this paper, the procedure is described, validated on simulated measurements and some initial experimental results are given. (c) 2007 Elsevier Ltd. All rights reserved.</p

Pada kasus Putusan Mahkamah Agung No. 2520 K/Pid.Sus/2011dengan terdakwa La Rusu seorang nelayan kecil telah melanggar Pasal 100B Undang-Undang No. 45 Tahun 2009 tentang Perikanan. Permasalahan apakah kasus La Rusu yang diputus oleh Mahkamah Agung No.2520 K/Pid.Sus/2011 merupakan tindak pidana perikanan serta bagaimana pengaturan pertanggungjawaban pidana mengenai tindak pidana pengoperasian kapal penangkap ikan tanpa disertai Surat Persetujuan Berlayar oleh nelayan kecil pada kasus Putusan No.2520 K/Pid.Sus/2011. Metode Penelitian menggunakakan metode penelitian hukum normatif. Data hasil penelitian bahwa pengoperasian kapal nelayan kecil penangkap ikan KMN Bunga Harapan GT 3 tanpa Surat Persetujuan Berlayar (SPB) dari Syahbandar pada kasus Putusan Mahkamah Agung No.2520 K/Pid. Sus/2011 merupakan salah satu bentuk tindak pidana yang diatur dalam Pasal 100B Undang-Undang No.45 Tahun 2009 yang termasuk dalam delik pelanggaran. Namun demikian, Undang-Undang Nomor 45 Tahun 2009 tentang Perikanan sebagai undang-undang yang bersifat administratif, untuk nelayan kecil yang tidak memiliki Surat Persetejuan Berlayar (SPB) seharusnya dikenakan sanksi administrasi saja seperti membayar ganti kerugian. Apabila sanksi adminstrasi tidak dilaksanakan, maka dapat diberlakukan asas ultimum remedium sebagai upaya terakhir dalam penanganan pelanggaran tindak pidana perikanan. Pertanggungjawaban pidana dalam tindak pidana pengoperasian kapal penangkap ikan tanpa disertai Surat Persetujuan Berlayar (SPB) pada Putusan Mahkamah Agung No.2520 K/Pid.Sus/2011, menerapkan asas kesalahan, yaitu tiada pertanggungjawaban pidana tanpa kesalahan. Berdasarkan adanya pelanggaran ketentuan tersebut maka unsur kesalahan sebagai syarat mutlak untuk meminta pertanggungjawaban pidana telah terpenuhi. Oleh karena itu ketentuan pidana yang diatur dalam Pasal 100B Undang-Undnag Perikanan dapat dimintakan pertanggungjawaban kepada La Rusu selaku Nahkoda sekaligus pemilik kapal. Untuk memberikan pelayanan pada nelayan kecil di daerah terpencil, hendaknya pemerintah menyediakan Syahbandar yang berwenang di daerah tersebut sehingga nelayan kecil tidak mengalami kesulitan dalam memperoleh Surat Persetujuan Berlayar.
