    This thesis evaluates the legal concept of mens rea to better understand its meaning and significance in criminal law. Included in this thesis is the examination of the evolution of criminal law from Roman law to today's Canadian criminal law, through the lens of the foundational principle of mens rea, through its application in numerous Supreme Court of Canada cases, has either reinforced the interpretation of laws or set out a new framework on how the law should be interpreted. The purpose of this paper is to illustrate how mens rea guided criminal law by emphasizing the purpose of the justice system, the purpose and significance of the mental element within an offence; how the law is interpreted using the concept of mens rea, the degree of culpability within an offence; and a higher standard of burden of proof. Mens rea has many functions such as to guard against the wrongful conviction of morally innocent individuals and to protect our society from those who caused harm. Mens rea also helps distinguish between the degrees of moral blameworthiness within each crime and to understand the concept of burden of proof. Lastly, mens rea is critical in a court's determining of appropriate punishment. Finally, this thesis links the concept of mens rea to legal defences in criminal law

    Specifics of Ukrainian Radio Broadcasts During the Russian-Ukrainian War

    <p>The article examines the specifics of Ukrainian Radio activities, the radio platform of the Public Broadcaster of Ukraine, and the National Public Broadcasting Company in the context of Russia's full-scale war against Ukraine. The author considers the importance of its functioning during the period of military operations and in the conditions when the Russian Federation uses radio as one of the tools of information warfare and influence on the mass consciousness. It demonstrates how Ukraine counteracts enemy propaganda, in particular, by trying to «drown out» Russian radio broadcasting. The author examines the methods and tools used by Ukrainian Radio journalists to deliver timely, reliable, thoroughly verified information throughout Ukraine, debunking fakes, provocations, distortions, and fabrications of the enemy. The methods described in this article are primarily prompt. As an example, when Russia spreads IPSO (information disseminated by the enemy to psychologically influence the Ukrainian population), journalists immediately look for confirmation or refutation of this information and immediately report on air. There are also ongoing negotiations to increase the capacity of transmitters in the frontline areas. This allows us to broadcast in the occupied territories. Among journalists' tools, the article highlights such forms of materials presentation as live broadcasts, where the news is reported immediately, and new programmes in which the authors explain how to act in a given situation. They primarily address residents of the frontline regions or occupied territories. The author substantiates the thesis of why the state should develop radio broadcasting during military operations. The author believes that by strengthening the capacity of Ukrainian Radio, the country is contributing to a more global delivery of truthful information to the occupied territories, where it is currently almost absent. As soon as the power of our transmitters increases, it becomes much more difficult for Russians to block our signal. Thus, if the transmitter is located near the villages and towns captured by Russia, it will be possible to catch Ukrainian Radio, even in the hinterland of the occupied territories, where Ukrainian websites and television are currently blocked.</p><p><a href="http://ukrinfospace.knukim.edu.ua/article/view/291173">http://ukrinfospace.knukim.edu.ua/article/view/291173</a></p&gt

    Peculiarities of spectroscopy of thermal plasma with copper and molybdenum vapour admixtures

    This study presents an investigation of arc discharge plasma generated between asymmetric pair of single-component copper and molybdenum electrodes. Optical emission spectra were registered in absolute intensity units with spatial resolution from the midsection of the arc column. Simultaneously laser absorption spectroscopy was carried out as well in order to determine radial distribution of optical thickness at the center of Cu I 510.5 nm spectral line. Particular attention was paid to assessing the influence of self-absorption effects, which can significantly distort the intensity of strong spectral transitions and lead to an underestimation of the spectral line intensity and, consequently, to a significant error in determining the temperature and number densities of metal atoms

    Customer Oriented Ideation and its Impact on Customer Adoption of New Solutions

    Customer adoption of new solutions is critical for the development of the modern business environment, and both academics and practitioners have been investigating this notion to uncover the customer adoption patterns to progress business and withstand competition. Despite the variety of marketing research techniques and practices commonly used to obtain customer data it has been said that the customers that “talk the talk” do not always “walk the walk” of innovation adoption. The challenge remains unchanged: making innovation accessible and easy to adopt in consumers’ everyday lives. This thesis is looking into the processes of creating new solutions to identify the key drivers within the ideation processes that facilitate adoption. The research inquiry is supported by the tendencies in the industry, where, despite the increasing number of new technologies and approaches aimed to develop better products, the success-to-failure ratios remain quite low. The aim of the study is to design an integrative theoretical framework, explaining the drivers of ideation, the impact of customer orientation within ideation, and the influence it has on innovation adoption. The author used integrated methodology, combining the best practices of the deductive approach, commonly applied in conceptual works, and qualitative research methodology, where further insights were uncovered via interviews and a focus group. In this research project, the integrated methodology has been applied to combine the strengths of each of the research techniques and uncover insights into the complex notions and relationships under investigation. The findings include the introduction of COI and the three-dimensional model, facilitating the solutions development practice, aiming to help achieve a more sustainable growth within the service industries. The author has introduced a novel notion of Customer Oriented Ideation (COI) that focuses on the use of customer insights within the solutions development process and its impact on the market success. The author has also developed a questionnaire for further quantitative investigation of the framework, and further refined it via a pilot study

    Political frictions and public policy outcomes

    AbstractWe study the role of political frictions in public policy outcomes. We propose a simple model of fiscal policy that combines a lack of commitment by the government, political turnover, and another political friction that can be interpreted either as political polarization or as public rent-seeking. We show that political turnover increases public debt levels, while political polarization or public rent-seeking leads to higher public spending. We evaluate the importance of different political frictions for fiscal policy outcomes using a sample of twenty developed countries. We find that the data on political instability combined with the data on public rent-seeking explain 25% of the variation in public debt levels

The general and special psychological and pedagogical sources of interpretation of the category "support" are analyzed. Based on modern interpretations of the support of domestic scientists, the author provides a generalized, own understanding of "psychological and pedagogical support" of preschool children with intellectual disabilities

Наведено приклади корекційних ігор, які можуть використовувати у своїй діяльності вчителі-дефектологи (тифлопедагоги). Приділення уваги сенсорному розвитку дитини зі зниженим зором сприяє удосконаленню органів відчуття, накопиченню уявлень про навколишній світ.In the article, the author highlighted the problem of conducting remedial classes for the sensory development of children with reduced vision. The experience of working on the formation and development of preschool children’s basic sensory functions, such as distinguishing by color, shape, and size, is disclosed. Examples of correctional games that special education teachers (special education teachers) can use in their activities are given. Paying attention to the sensory development of a child with reduced vision contributes to the improvement of the senses, the accumulation of ideas about the surrounding world
