Kriteria Alat Bukti Elektronik yang Sah dalam urgensi pembaharuan KUHAP
The background of this journal writing is the absence of clear provisions in the Indonesian Criminal Procedure Code (KUHAP) or other specific laws that comprehensively regulate the criteria for valid electronic evidence. Therefore, a legal reform is needed in Indonesia's national criminal procedure law that is more relevant in addressing the current legal developments. Through legal research methodologies such as the statutory approach, case approach, historical approach, comparative approach, and conceptual approach, the author identifies the importance of reliable, credible, relevant, and material requirements in determining the criteria for valid electronic evidence. Furthermore, the acquisition of such electronic evidence should also adhere to the principles of Exclusionary Rules in order to uphold human rights. Subsequently, the Draft Criminal Procedure Code (RUU KUHAP) has regulated electronic evidence, which was previously not addressed in the previous version of the KUHAP. Thus, the importance of KUHAP reform is to establish a fair and adversarial criminal procedure legal principle
Relevansi Pertanggungjawaban Pidana atas Culpability Kecerdasan Buatan (Artificial Intelegence)
Peran kecerdasan buatan sangat besar dalam kehidupan manusia terutama saat ini kecerdasan buatan juga menggunakan data pribadi pemegang ponsel pintar untuk meramalkan perilaku manusia. Hukum Pidana bertujuan untuk melindungi dengan mencegah orang melakukan perbuatan pidana dan menghukum orang yang melakukan tindak pidana, tentu dengan prosedur hukum yang telah ditentukan. Selama ini hukum pidana hanya bertujuan untuk menghukum manusia yang memiliki kesadaran dan dengan adanya kesadaran manusia tersebut dapat diukur kemampuan pertanggungjawaban pidana dan alasan penghapus pidana. Akan tetapi bagaimana jika kecerdasan buatan yang melakukan tindak pidana? Apakah hukum pidana dapat menjangkau pertanggungjawaban pidana? Penelitian ini menggunakan metode penelitian hukum normatife. Tujuan dari penelitian ini adalah untuk mengetahui bagaimana hukum pidana di Indonesia mengatur kecerdasaan buatan saat ini dan bagaiamana Pertanggungjawaban pidana yang dilakukan oleh kecerdasan buatan. Hasil penelitian ini meyebutkan bahwa perlu adanya regulasi pidana terkait kecerdasan buatan yang mampu menghukum pelaku dan melindungi kepentingan pengembangan teknologi kecerdasan buatan serta diperlukannya konsep pertanggungjawaban pidana pengganti untuk menghukum pelaku kejahatan kecerdasan buatan dan melindungi Masyarakat dari bahaya kecerdasan buatan
Konsep Penyelesaian Sengketa Pertanahan Di Indonesia Berlandaskan Prinsip Keadilan Restoratif
Land conflicts are often resolved through litigation considering the legal regulations that force land disputes to lead to criminal and civil justice as well as the TUN. The Land Office as the organizer of the management and registration of land rights can carry out mediation in accordance with the provisions of the Minister of Agrarian and Spatial Planning Regulation Number 21 of 2020 concerning Handling and Settlement of Land Cases. However, it is limited to certain criteria and cannot resolve problems related to land crimes and civil rights disputes. Through this research, the author proposes the concept of institutions and special rules that regulate penal mediation and civil mediation related to land conflicts in order to achieve restorative justice for the parties to the dispute. Because of this, there is a need for special institutions and special rules regarding the resolution of land conflicts through mediation in order to achieve restorative justice that is cost-effective and has a short resolution period
Hak Keperdataan Korban Tindak Pidana pada putusan nomor 365 PK/Pid.Sus/2022 kasus “First Travelâ€
Peradilan pidana saat ini masih fokus menghukum pelaku dan kurang memperhatikan hak korban hal ini dapat dilihat dari contoh kasus penipuan first travel yang telah diputus pada putusan nomor 365 PK/Pid.Sus/2022 juncto 84/Pid.B/2018/PN.Dpk, 196/PID/2018/PT.BDG dan 3095K/PID.SUS/2018, meskipun pada putusan peninjauan kembali terdapat amar yang memerintahkan untuk mengembalikan asset rampasan negara kepada korban akan tetapi pada putusan tingkat pertama, banding dan tingkat kasasi memiliki amar yang tidak memperhatikan kondisi kerugian korban, hal ini menunjukan paradigma penegakan hukum pidana masih kurang memperhatikan kajian viktimologi, sehingga pada tulisan ini penulis akan mencoba mengulas tentang 1) Bagaimana hak keperdataan korban tindak pidana pada putusan nomor 365 PK/Pid.Sus/2022? dan 2) Bagaimana peraturan hak keperdataan korban tindak pidana di masa mendatang?, Penulis menggunakan pendekatan undang-undang (statute approach) untuk membandingkan ketentuan hak keperdataan korban tindak pidana pada beberapan aturan hukum yang ada, selain itu juga penulis menggunakan pendekatan kasus (case approach) untuk mengetahui sejauh mana peran aturan hukum dalam mengakomodir hak keperdataan korban tindak pidana serta menggunakan pendekatan konseptual (conceptual approach) untuk membandingkan teori hukum dan peraturan yang ada agar tercapai kemanfaatan dan kepastian hukum, lalu menulis mengemukakan bahwa Hak keperdataan korban tindak pidana pada putusan kasasi nomor nomor 365 PK/Pid.Sus/2022 didasarkan pada kententuan pasal 194 ayat (1) KUHAP yaitu pengembalian barang bukti kepada yang berhak (para calon Jemaah umrath PT. First Anugerah Karya Wisata atau First Travel) yang mana menimbulkan permasalahan lain dalam pelaksaanaan putusan tersebut dan diperlukan suatu aturan yang lebih baik dalam mengakomodir ganti rugi korban tindak pidana Pada masa mendatang yaitu tahun 2026 terdapat ketentuan pada pasal 66 ayat 1 huruf d Undang-Undang Republik Indonesia Nomor 1 Tahun 2023 Tentang Kitab Undang-Undang Hukum Pidana yang dapat dikenakan pidana tambahan seperti aturan-aturan sebelumnya yang khusus mengatur restitusi terkait tindak pidana, hal ini mempermudah korban untuk mendapatkan akses hak keperdataannya
Going Beyond Counting First Authors in Author Co-citation Analysis
The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation
counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed
Variations on the Author
“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship
Appropriate Similarity Measures for Author Cocitation Analysis
We provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature. Dispelling the Myths Behind First-author Citation Counts
We conducted a full-scale evaluative citation analysis study of scholars in the XML research field to explore just how different from each other author rankings resulting from different citation counting methods actually are, and to demonstrate the capability of emerging data and tools on the Web in supporting more realistic citation counting methods. Our results contest some common arguments for the continued
use of first-author citation counts in the evaluation of scholars, such as high correlations between author rankings by first-author citation counts and other citation
counting methods, and high costs of using more realistic citation counting methods that are not well-supported by the ISI databases.
