    Freedom of religion or belief is a fundamental right recognized in all the international acts concerning human rights. This contribution investigates the content and the contours of this right considering the interpretative and applicative acts adopted by those international organs called to clarify and apply the right. In particular, it considers the activity of the Human Rights Committee and of the Special Rapporteur on Freedom of Religion and Belief, and the case-law of the European Court of Human Rights. The analysis focuses on both dimensions of the right: the right to adopt, change and renounce to one’s religion, further enriched by the prohibition on forcing others to believe or not; and the right to manifest one’s religion, with the addition of the prohibition on requiring people to reveal their beliefs

    Il diritto alla libertà di religione, riconosciuto come fondamentale in tutti gli strumenti a garanzia dei diritti umani, è sempre più oggetto di attenzione nelle società pluriculturali contemporanee. La prassi delle autorità nazionali e delle istituzioni internazionali che se ne occupano è dunque considerevolmente aumentata nel corso del tempo.     The right to freedom of religion, recognized as fundamental in all instruments guaranteeing human rights, is increasingly the object of attention in contemporary pluricultural societies.     Social media contribute to the spread of hate speech. For this reason the European Union, with its action in the fight against hate speech, has identified, through acts of soft law, some tasks that social media could pursue in order to prevent and to remove hatred contents. However, this empowerment creates some problematic issues, because the web platforms become the new judges of what is lawful or unlawful online. This study investigates the contents of these acts with the goal to verify if the outlined responsibilities are adequate to achieve the intended purpose and their impact on the rights involved

    The article analyses the rules of the European Union concerning comparative advertising as interpreted by the European Court of Justice, in particular on the occasion of judgements relating to the advertising of food products. The Court has admitted the possibility to compare foods and has adopted a positive orientation, interpreting the lawfulness conditions of com- parative advertising in a wide manner. It has, for example, established that the fact that food products may differ in terms of conditions and place of pro- duction, their ingredients, who produced them, and the pleasure that derives from consuming them, cannot preclude the possibility of the comparison. It has moreover approved those advertisements that compare the price trends of different supermarkets. However, in concrete terms this kind of advertising is of hard implementation because it often reveals itself as misleading, and therefore prohibited

    The article investigates the European Community provisions on the "safe country of origin" and the "safe third country" practices. The analysis focuses on Council Directive 2005/85 concerning the procedures for granting and withdrawing refugee status as well as the Dublin Convention and the subsequent Regulation denominated "Dublin II". These norms provide for the criteria and mechanisms to determine which Member State is responsible for examining asylum applications and they give concrete application to the "safe third country" rule. Notwithstanding the fact that these practices were introduced in order to eliminate abuses in asylum seeking, they do not comply with the international provisions that safeguard refugees and the fundamental rights of individuals

    Applications for international protection by women fleeing gender-based violence are mostly traced back to persecution for ‘membership of a particular social group’. This persecution ground is, however, caged in rigid criteria that lend themselves to arbitrary interpretations, which the Court of Justice in its WS judgment (C-621/21) has in fact ended up confirming. However, at the same time, by qualifying the Istanbul Convention as an interpretative instrument of the common European policy on asylum and subsidiary protection, the Court has imposed a more gender-sensitive reading of the European Union's rules, which should lead to a better identification of the situations in which migrant women victims of violence must find protection
