O CONTROLE DE CONSTITUCIONALIDADE DA PORTARIA CONJUNTA SEGER/SESA N.º 03-R, DE 26 DE NOVEMBRO DE 2021
No full textO presente artigo tem como objetivo precípuo analisar os reflexos da Portaria Conjunta SEGER/SESA N. ° 03-R, de 26 de novembro de 2021, que delimita o acesso às dependências físicas dos órgãos e entidades do Poder Executivo Estadual aos agentes públicos que estiverem devidamente imunizados contra a covid-19, possuindo como análise central a inconstitucionalidade do referido ato normativo do Poder Executivo do Estado do Espírito Santo que, traz à tona transfigurações de todo o sistema afetando as relações jurídicas preexistentes. Primeiramente, a fim de contextualizar a questão, foi identificada as características da referida portaria, como sua classificação perante o ordenamento jurídico pátrio. Em seguida, abordou-se sobre o conceito de inconstitucionalidade aprofundando na hipótese de controle concentrado. Por fim, houve a análise se a portaria em referência seenquadra como objeto de Ação Direta de Inconstitucionalidade (ADI) à luz da jurisprudência pátria.
