Free legal aid under martial law: peculiarities of provision
The article examines the issue of providing free legal aid to the population of Ukraine under martial law. It is the provision of such assistance that realizes the right of Ukrainians to legal protection and to solve their life problems in a legal manner.The article analyzes the provision of free legal aid to particularly vulnerable categories of persons, internally displaced persons in difficult financial and psychological conditions. It is these categories of the population that require high-quality, professional, effective and free-of-charge assistance from individuals and legal entities in accordance with the current legislation.The author identifies the advantages and disadvantages of providing free legal aid under martial law and the reasons for its ineffectiveness in the current conditions of Russia’s armed aggression against Ukraine.Legal aid is divided into primary and secondary legal aid. Each type of assistance is distinguished by the subjects of its provision and the circle of recipients. The article emphasizes that after Russia’s invasion of Ukraine, the number of people in need of free legal professional assistance and psychological support is increasing.The article pays special attention to the provision of free legal aid to children, vulnerable groups of the population and persons affected by the Russian-Ukrainian war. Protection of the rights and interests of children is one of the important tasks of the free legal aid system.The author proposes ways to improve the quality of free legal aid provision to the population under martial law, namely: providing free legal aid in a remote format, using applications for mobile devices, spreading the volunteer movement, conducting legal education, improving legislation, etc.Today, the provision of free legal aid has become possible remotely via the Internet and special applications, which has made it easier for people to resolve a significant number of legal issues under martial law
Violations of children’s rights during the war in Ukraine
The article focuses on the fact that a child belongs to a special socio-demographic group of the age population, and has age criteria, special needs, interests and rights defined by law. Every child should feel protected, loved and cared for by his or her closest people, and his or her opinion should be respected. Focusing on the rights of the most vulnerable and disadvantaged categories, including children, demonstrates society’s desire to ensure the further development of civilization, as children are our future.It is emphasized that the rights of the child are certain opportunities that are necessary for the child’s existence, development and maturity. In any modern democratic society, children are considered the highest value. Children’s rights cannot be violated even in difficult life circumstances. Children should feel fully protected by adults and the state.It is worth noting that children suffer the most during armed conflicts because they are too trusting, vulnerable and unable to take care of their own safety and protection.However, today, as a result of the full-scale invasion of Ukraine, the Russian Federation violates all children’s rights and commits grave crimes against them, namely: abducts and illegally transports them; recruits them; deprives them of liberty and parental care; uses various forms of violence against children, especially in the occupied territories; deprives them of life and maims them, etc.All children, regardless of their personal qualities and characteristics, are equally under the legal protection of the state. It is worth noting that in recent years, domestic legislation has improved its regulatory framework concerning child protection. However, today, due to Russia’s aggression against Ukraine, the sphere of children’s rights protection requires substantial enhancement.It should be emphasized that as a result of armed aggression, there is an urgent issue of ensuring and protecting the violated rights and freedoms of children. Russia is committing war crimes and crimes against humanity, which have no statute of limitations, and it must be held legally accountable. Поняття естетичної культури юриста: теоретико-правовий аспект
The article studies the concept, essence, structure, and significance of the aesthetic culture of a lawyer in their practice. It also provides examples of definitions for understanding the aesthetic culture of a lawyer.The article reveals the functions and principles of the aesthetic culture of a lawyer in their professional activity. It is mentioned that the successful resolution of significant state issues depends on the high level of aesthetic culture of lawyers and their professionalism. It is emphasized that aesthetic culture must serve as the basis of contemporary Ukrainian higher education in order to prepare future attorneys.The most significant aspect of a lawyer’s aesthetic culture is their awareness of the appropriateness of the chosen profession, contentment with his or her professional activity, and commitment to legal values, as they have discovered the vocation to help people. This perception of the lawyer indicates their inner harmony, which is the beauty of a person.The main factors of influence on the aesthetic culture of a lawyer can be identified as follows: phenomena of the surrounding reality; the specificity of the lawyer’s activity and their professionalism; aesthetic culture of colleagues and clients; works of art that evoke positive emotions, etc.A lawyer’s aesthetic culture is a complex formation with a unique structure. The structural elements of a lawyer’s aesthetic culture include the aesthetics of communication, the culture of language, the culture of appearance, the culture of work organization, the culture of preparing and executing legal documents, the aesthetic worldview, aesthetic and legal values, aesthetic and legal taste, etc.The high level of aesthetic culture of a lawyer brings about positive changes in his inner world, in his practical activity, and in the effective regulation of legal relations in Ukraine. The aesthetic culture of a lawyer is revealed through a specific manifestation of a lawyer’s value attitude towards themselves, through admiration for their profession, and building harmonious relationships with colleagues and clients.У статті досліджується поняття, сутність, структура та значення естетичної культури юриста у його практичній діяльності. Наведено приклади дефініцій щодо розуміння естетичної культури правника.У статті розкрито функції та принципи естетичної культури юриста у його професійній діяльності. Зазначено, що від високого рівня естетичної культури правників, від їх професіоналізму залежить успішне вирішення важливих проблем у державі. Підкреслено, що естетична культура повинна бути основою навчально-освітнього процесу сучасної вищої освіти в Україні щодо підготовки майбутніх фахівців юристів.Найважливішою ознакою естетичної культури правника є усвідомлення ним правильності вибраної професії, задоволення власною професійною діяльністю, дотримання ним правових цінностей, оскільки він знайшов своє покликання допомагати людям. Таке сприйняття юристом самого себе вказує на його внутрішню гармонію, що і є красою людини.Основними факторами впливу на естетичну культуру юриста можна виділити наступні: явища навколишньої дійсності; специфіка діяльності юриста та його професіоналізм; естетична культура колег та клієнтів; твори мистецтва, які викликають позитивні емоції тощо.Естетична культура юриста є складним утворенням, яке має своєрідну структуру. До структурних елементів естетичної культури юриста відносить наступні: естетику спілкування, культуру мови, культуру зовнішнього вигляду, культуру організації робочого місця, культуру підготовки та оформлення юридичних документів, естетичний світогляд, естетично-правові цінності, естетично-правовий смак тощо. Завдяки високому рівню естетичної культури правника відбуваються позитивні зміни у його внутрішньому світі, у його практичній діяльності та у ефективному регулюванні правовідносин в Україні. Going Beyond Counting First Authors in Author Co-citation Analysis
The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation
counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed
Variations on the Author
“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship
Appropriate Similarity Measures for Author Cocitation Analysis
We provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature. Dispelling the Myths Behind First-author Citation Counts
We conducted a full-scale evaluative citation analysis study of scholars in the XML research field to explore just how different from each other author rankings resulting from different citation counting methods actually are, and to demonstrate the capability of emerging data and tools on the Web in supporting more realistic citation counting methods. Our results contest some common arguments for the continued
use of first-author citation counts in the evaluation of scholars, such as high correlations between author rankings by first-author citation counts and other citation
counting methods, and high costs of using more realistic citation counting methods that are not well-supported by the ISI databases. We have done our best to complete the author checklist relating to the use of animals in the hut study. Note that the objective for the hut study was to evaluate the IRS treatment applications for residual efficacy against Anopheles mosquitoes, including the local An. coluzzii mosquito population. Cows were only used to attract mosquitoes into the huts and no tests were carried out directly on the cows. The author checklist is intended for use with studies where experiments are carried out on animals, which is why we have had such difficulty in completing this for the hut study, as many of the questions do not relate to how the cows were used
