    Badges of trade: the protection of trade marks and related intangibles in unfair competition law

    PhDThe increasing efforts within the European Union to harmonise intellectual property law also lead to the approximation of some aspects of unfair competition law. Despite these efforts, common standards for unfair competition law are still not present. To find a common legal norm defining the scope of protection of trade marks and related intangibles in unfair competition law, similarities and differences between various national unfair competition provisions are explored in the light of the Paris Convention. Setting aside the clear examples of tortious behaviour in competition, the difficulty surrounding the definition of clear norms in other unfair competition cases is recognised. Protection of intangible subject matter on an other basis than tort can lead to idiosyncratic and circular reasoning. It is shown that property theories and policy decisions have to be dismissed as the sole basis in the determination whether protection is due. The author describes how a legal concept bearing close resemblance to tort can overcome these problems. He describes and argues for an action for 'malign competition', based on the concept of unjust enrichment. In examining selected legal systems in more detail, several key aspects of the proposed action appear to be in operation already, albeit not recognised. Selected cases from several jurisdictions are subsequently tested according to the model of the proposed action for malign competition. It is demonstrated that the legal reasoning is more satisfactory, offering a clear norm and takingway the old idiosyncrasies. Where the outcome on the basis of the same facts is different, it is shown that this is the result of a more satisfactory implementation of the notions of preemption and equitable remuneration than is currently employed. The fact that the principle of unjust enrichment is universally recognised will in the opinion of the author advance the prospects for future harmonisat

    Hybrid simulation of wake vortices of landing aircraft in a turbulent environment

    Wake-vortex evolution during landing of a long range aircraft is investigated in a turbulent environment. The simulations cover final approach, touchdown on the tarmac, and the evolution of the wake after touchdown. An ambient turbulent crosswind and headwind field is generated in a pre-simulation. The wake is initialized using a RANS-LES coupling approach. The further development of the vortical wake is investigated by large-eddy simulation until final decay. Strong three-dimensional deformations appearing after touchdown and linkings with the ground are studied. The downwind vortex is strongly advected with crosswind and decays quickly. The interaction of plate line disturbances and end effects in a turbulent environment leads to irregular decay pattern

The attention is then turned to linear models Yn×1 = Xn×pβp×1 + En×1 with the errors Ei ∼ F, i = 1, . . . , n fulfilling the do- main of attraction condition. We examine the properties of the regression quantiles of Koenker and Basset (1978) under this setting we develop theory dealing with extremal characteristics of linear models. Our methods are based on an approximation of the regression quantile process for α ∈ [0, 1] expanding older results of Gutenbrunner et al. (1993). Our result holds in [α∗ n, 1 − α∗ n] with a better rate of α∗ n → 0 than the other approximations described previously in the literature. Consecutively we provide an ap- proximation of the tails of regression quantile. The approximations of the tails enable to develop theory of the smooth functionals, which are used to establish a new class of estimates of extreme value index.     Does strict employment protection discourage job creation? Evidence from Croatia

    Employment protection legislation in Croatia is among the most strict in Europe. Firing is difficult and costly, and flexible forms of employment are limited. Is this apparent rigidity reflected-as one would expect based on standard economic theory-in low labor market dynamics? Is job creation low and hiring limited? Is the job security of insiders achieved at the cost of outsiders not being able to enter thelabor market? The author attempts to answer these questions by examining job flows. If the employment protection legislation is binding, then job and worker turnover should be low. He shows that this is indeed the case. Hiring is limited and the average job tenure is very long in Croatia. Job destruction is low, however job creation is still lower. The result is accumulation of unemployment, in large part due to new labor market entrants not being able to find a job. The high degree of job protection also seems to strengthen the bargaining position of insiders and results in relatively high wages. So, wages in Croatia are higher than among its competitors, even after adjusting for productivity. These high labor costs are likely to contribute to limited job creation in existing firms, but also are likely to discourage the entry of-and thus job creation in-new firms. The author presents evidence that firm growth has been indeed limited in Croatia, contributing to the low employment level. The author examines other potential causes of high unemployment in Croatia (the unemployment benefit system, labor taxation, the wage structure, and skill and spatial mismatches). He argues that they do not play a substantial part in accounting for poor labor market outcomes in Croatia. The author concludes that the stringent employment protection legislation is the key labor market institution behind low job creation and high unemployment.     Literature is a form of creativity idea from the author. One of the forms is roman. There are characters in a roman. In the source of the data which was used is written data of Der Fürst spricht roman by Jan Peter. In this research selected roman Der Fürst spricht of Jan Peter Bremer as research objects. Roman Der Fürst spricht tells about der Fürst and his servants, if it is associated with a sense of romance, there is also the linkages between der Fürst and his servants. Therefore, need to know these linkages to understand the story well. Then, there are figures in a roman. For making the figures live, the author needs the characterization.. According to Minderop, characterization is character description. The research question of this research is: How the characterization of the characters in Der Fürst spricht roman by Jan Peter Bremer?. The purpose of this research is finding the characterization of the figures in Der Fürst spricht roman by Jan Peter Bremer. This research included into descriptive qualitative research. For analyzing the research problem, the research used a theory about indirectly characterization from Albertine Minderop and Enneagram theory from Oscar Ichazo dan Claudio Naranjo . The result of analysis showed that the roman of Der Fürst spricht by Jan Peter Bremer had, 1 figure tempered leader, 1 figure tempered wicked, 1 figure tempered liar, 3 characters tempered friendly, 1 figure tempered rescuer, 1 figure tempered romantic, 1 figure tempered generalist, 3 figures tempered faithful, 1 figure tempered careful, and 1 figure cruel character. Once found the character it can be seen that in the roman Der Fürst spricht more inclined to depictions through sociological terms, because the author depicts characters through figures interaction in the environment.
