A RATIO DECIDENDI E A ATUAÇÃO DO SUPREMO TRIBUNAL FEDERAL COMO CORTE DE PRECEDENTES: É NECESSÁRIA A DEFINIÇÃO DE UM CONCEITO ESTANQUE?
O artigo, por meio de uma revisão bibliográfica, evidencia peculiaridades do conceito de ratio decidendi, como elemento vinculante na teoria dos precedentes, que auxiliam em sua aplicação prática. Para isso, enfatiza a importância da atuação do Supremo Tribunal Federal (STF) como Corte de precedentes. A seguir, destaca a necessidade de compreensão do conceito de ratio decidendi para o aprimoramento da atuação do STF como Corte de precedentes, especificando traços do conceito, especialmente, seu aspecto interpretativo; o papel das Cortes posteriores; a possibilidade de existência de mais de uma ratio decidendi em um mesmo precedente e as particularidades da delimitação da ratio decidendi nas decisões colegiadas. Por fim, sustenta a prescindibilidade de um conceito estanque e de um método fixo de delimitação da ratio para sua compreensão e aplicação prática, realçando os principais aspectos do conceito
A utilização dos precedentes pelo poder judiciário brasileiro e o CPC/2015 : os precedentes vinculantes e o microsistema de resolução de casos repetitivos

Tendo em vista esses problemas, o presente trabalho tem como hipótese de investigação a utilização dos precedentes pelo Poder Judiciário brasileiro, a partir da proposta do Código de Processo Civil de 2015 de um modelo de teses vinculantes e de um microssistema de solução de casos repetitivos. Para tanto, parte-se de um breve exame sobre as distinções entre os sistemas do civil law e do common law e da opção do Código de Processo Civil de 2015 pelo fortalecimento dos precedentes judiciais. A partir de tal panorama, investiga-se a utilização dos precedentes pelo Poder Judiciário brasileiro, por meio de uma análise das peculiaridades do sistema brasileiro frente aos conceitos clássicos adotados pelo common law. Por fim, aponta-se a opção do Código de Processo Civil de 2015 pela adoção de um microssistema de solução de casos repetitivos, avaliando-se a previsão normativa e realizando uma análise crítica do Incidente de Resolução de Demandas Repetitivas e dos Recursos Extraordinário e Especial Repetitivos
Processo decisório, fundamentação e diálogo com a sociedade : uma análise das decisões colegiadas do STF à luz da teoria dos precedentes judiciais e da doutrina de Dworkin

Defesa : Curitiba, 30/04/2020Inclui referências: p. 255-274Resumo: Em um cenário em que o Supremo Tribunal Federal (STF) possui um amplo espaço interpretativo e é chamado a se manifestar sobre questões de natureza política e moral, a teoria dos precedentes judiciais ganha importância para resolução dos casos difíceis, especialmente, para a garantia da segurança jurídica e da isonomia aos jurisdicionados. Nesse contexto, o presente estudo analisa como determinados aspectos internos e externos às decisões colegiadas do plenário do STF se relacionam com o fortalecimento da teoria dos precedentes e, em que medida, podem ser aprimorados. Para tanto, utiliza como principal metodologia a pesquisa bibliográfica e adota como marco teórico Dworkin. Em um primeiro momento, realça que a experiência do common law pode contribuir para o aprimoramento do uso dos precedentes no STF, destacando a importância da Corte buscar um consenso quanto aos fundamentos determinantes da decisão e explorar interpretativamente os casos anteriores. Ademais, explicita como a teoria de Dworkin, do direito como integridade e como prática interpretativa, pode contribuir para o aprimoramento das decisões colegiadas e do uso dos precedentes no STF. Delimitados os alicerces teóricos do trabalho, quanto aos aspectos internos, enfatiza a importância da deliberação para o fortalecimento dos precedentes judiciais, sugerindo que o relator circule entre os ministros informações sobre o caso antes do julgamento, que a Corte altere o modo de realização das sustentações orais, dos debates e da votação, bem como que modifique a forma de utilização do pedido de vista. Após, aponta os problemas relativos ao modelo de decisão seriatim não deliberativa adotada pela Corte, recomendando a adoção de um modelo de decisão per curiam, que permita a manifestação de votos dissidentes e concorrentes. Para enfim, quanto à fundamentação das decisões colegiadas, ressaltar as dificuldades enfrentadas pela Corte quanto ao uso dos precedentes e à forma de argumentação. Já quanto aos aspectos externos, destaca o cenário de enfraquecimento da imagem institucional da Corte perante a opinião pública, salientando a importância da teoria dos precedentes judiciais como alicerce argumentativo e, da alteração de determinadas práticas da Corte, incluindo o uso dos precedentes, para o fortalecimento institucional. Posteriormente, sublinha os impactos negativos do modelo de ampla publicidade adotado pela Corte, frisando a necessidade de aprimoramento das práticas deliberativas e do modo de utilização de seus mecanismos de comunicação com o público. Para então, evidenciar o papel dos amicus curiae e das audiências públicas como instrumentos da fase pré-decisória que, se bem utilizados pelo tribunal, podem contribuir para a pluralidade do debate e para melhora da qualidade das decisões, auxiliando os ministros a desvelarem a moralidade política da comunidade e a construírem argumentativamente a resposta certa para o caso. Por fim, conclui que a consolidação da doutrina de respeito aos precedentes judiciais, essencial para garantia da segurança jurídica, da isonomia e para o fortalecimento da imagem do STF como instituição, perpassa alterações em procedimentos e práticas que dependem, em grande medida, apenas da própria Corte.Abstract: In a scenario where the Brazilian Supreme Court (STF) has ample space for interpretation and is called to speak on issues of a political and moral nature, the theory of precedents gains importance for the resolution of hard cases, especially, for the guarantee of legal security and isonomy. In this context, the present study analyzes how certain internal and external aspects of the STF plenary collegiate decisions are related to the strengthening of the theory of precedents and, in what extent, they can be improved. To this end, it uses bibliographic research as its main methodology and adopts Dworkin as a theoretical framework. At first, it emphasizes that the experience of common law can contribute to improvement of precedents use in the STF, highlighting the importance of the Court to seek a consensus on the main fundamentals of the decision and to interpretatively explore the previous cases. Furthermore, it explains how Dworkin's theory, of law as integrity and as an interpretive practice, can contribute to the improvement of collegiate decisions and to the better use of precedents in the STF. Outlined the theoretical foundations, in terms of internal aspects, it emphasizes the importance of deliberation in order to strengthen precedents, suggesting that the rapporteur should circulate information about the case before the trial, that the court change the way oral arguments, debates and voting are carried out, as well as change the way in which the request for examinations of the case records is used. Then, it points out the problems related to the non-deliberative seriatim decision model adopted by the Court, recommending the adoption of a decision model per curiam, which allows dissident and concurrent votes. Finally, in relation to the reasoning, demonstrates the difficulties faced by the Court in the use of precedents and in the form of argumentation. In terms of external aspects, highlights the scenario of the weakening institutional image of the Court in the face of public opinion, emphasizing the importance of the theory of precedents as an argumentative basis and, of change for certain court practices, including the use of precedents, for institutional strengthening. Subsequently, it underlines the negative impacts of the model of wide publicity adopted by the Court, accentuating the need to improve deliberative practices and the use of public communication mechanisms. Then, it highlights the role of amicus curiae and public hearings as instruments of the pre-decision phase that, if well used by the Court, can contribute to the plurality of the debate and to improve the quality of decisions, helping ministers to unveil the community's political morality and to construct argumentatively the right answer for the case. Lastly, it concludes that the consolidation of the doctrine of respect for precedents, essential for guaranteeing legal security, isonomy and to strengthen the image of the STF as an institution, involves changes in procedures and practices that depend, to a large extent, only on the Court itself
Going Beyond Counting First Authors in Author Co-citation Analysis
The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation
counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed
Variations on the Author
“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship
Appropriate Similarity Measures for Author Cocitation Analysis
We provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature. Dispelling the Myths Behind First-author Citation Counts
We conducted a full-scale evaluative citation analysis study of scholars in the XML research field to explore just how different from each other author rankings resulting from different citation counting methods actually are, and to demonstrate the capability of emerging data and tools on the Web in supporting more realistic citation counting methods. Our results contest some common arguments for the continued
use of first-author citation counts in the evaluation of scholars, such as high correlations between author rankings by first-author citation counts and other citation
counting methods, and high costs of using more realistic citation counting methods that are not well-supported by the ISI databases. We have done our best to complete the author checklist relating to the use of animals in the hut study. Note that the objective for the hut study was to evaluate the IRS treatment applications for residual efficacy against Anopheles mosquitoes, including the local An. coluzzii mosquito population. Cows were only used to attract mosquitoes into the huts and no tests were carried out directly on the cows. The author checklist is intended for use with studies where experiments are carried out on animals, which is why we have had such difficulty in completing this for the hut study, as many of the questions do not relate to how the cows were used
