Identità in movimento : diario di un'esperienza didattica alla casa di reclusione Ucciardone di Palermo
Nella primavera del 2023, all’interno della casa di Reclusione Ucciardone di Palermo, dodici docenti afferenti a diversi dipartimenti universitari, uno studente e undici studentesse non ristrette, e nove studenti ristretti hanno condiviso un’esperienza particolare di concretizzazione del diritto allo studio in un istituto penitenziario, che ha rimesso in discussione ruoli, metodologie, confini disciplinari e, soprattutto, distanze biografiche e spaziali nella ricerca di una narrazione condivisa, aperta, sincretica e in costante divenire, dell’identità e della condizione umana. Seguendo i “diari di bordo” tenuti per tutta la durata dell’esperienza, i contenuti dei diversi seminari vengono ricostruiti nei capitoli di questo volume per come sono stati discussi e rielaborati nel corso di ogni giornata, provando a restituire la complessità e la ricchezza dello scambio che ha avuto luogo in ogni tappa di questo percorso comune, anche allo scopo di offrire una traccia per immaginare di replicare altrove esperienze simili
Le parole dell'asilo: un diritto di confine
Chi riesce ad attraversare le frontiere dell’Unione europea per chiedere asilo deve rispondere adeguatamente a domande come: “Chi sei?”; “Da dove vieni?”; “Che valori e che storia porti con te?” Queste stesse domande sono però, al contempo, quelle che ogni richiedente asilo pone oggi all’Europa: “Chi sei?”; “Da dove vieni?”; “Di che valori e di che storia sei portatrice?”. Il diritto d’asilo affiora dalla storia millenaria di un istituto giuridico e religioso che accompagna l’evoluzione delle civiltà occidentali da quando se ne rinviene traccia. Una storia che viene qui indagata ricostruendo il filo conduttore delineato da alcune parole-chiave, le parole dell’asilo, appunto: ospitalità, protezione, diritto/diritti, cultura, riconoscimento, accoglienza. L’obiettivo è quello di superare il pericoloso riduzionismo dei discorsi ideologici, che le utilizzano in maniera univoca, semplificata, divisiva, e riaffermare la centralità del diritto d’asilo rispetto alla tenuta e alla credibilità dell’intero sistema dei diritti umani.Those who manage to cross the borders of the European Union to seek asylum must adequately answer questions such as: "Who are you?"; "Where are you from?"; "What values and what history do you carry with you?" However, these same questions are, at the same time, those that every asylum seeker asks Europe today: "Who are you?"; "Where are you from?"; "What values and what history do you carry with you?". The right of asylum emerges from the millenary history of a legal and religious institution that has accompanied the evolution of Western civilizations since traces of it have been found. A story that is investigated here by reconstructing the common thread outlined by some key words, the words of asylum, precisely: hospitality, protection, right / rights, culture, recognition, welcoming. The goal is to overcome the dangerous reductionism of ideological discourses, which use these words in a univocal, simplified, divisive way, and to reaffirm the centrality of the right of asylum with respect to the stability and credibility of the entire system of human rights
Aylan e Colonia. Dalla guerra ai migranti al respingimento dei refugees
Recent EU migration policies, traditionally centred on migrants’ mobility governance, have increasingly been focused, since 2015, on the managing of the so-called refugee crisis. This transition has been accompanied by a new discursive and visual representation of migration, within which the impressive image of Aylan Kurdi and the chaotic and confused images of the Sylvester Night in Colonia, in 2015, take a significant role. This article analyses the impact of these two events, as they were narrated by the media, by identifying a nonlinear process which has led from the perception of a migrant crisis to the one of a refugee crisis and, consequently, from the implementation of EU anti-migration policies to the implementation of anti-refugee policies
Princìpi e naufragi: alcune critiche alla nuova filosofia per il diritto internazionale di Ronald Dworkin e il caso emblematico delle politiche in atto nel Mediterraneo centrale
This contribution critically analyzes Ronald Dworkin's New Philosophy for International Law, by underlying how, his theory of law as interpretation, if transposed to the level of the relations between states, more clearly shows some weaknesses which are mainly connected with the ideality of its fundamental assumptions.
After having introduced the fundamental aspects of Dworkin's reflection on international law, the specific contents of the particular principles - of mitigation and salience - that Dworkin places at the basis of his vision of international law are critically analyzed in the face of the prerogatives of contemporary national sovereignty and in relation to the structural limits of human rights.
Migration policies in the Central Mediterranean Sea are therefore taken as an example not only of how far the contemporary condition is from accepting the normativity of Dowrkin's theory of international law, but also of how fragile its assumptions can be, even revealing themselves to be counterproductive precisely with respect to the objectives which Dworkin set out to achieve
Quale scontro culturale? L’urgenza di risignificare l’universalità dei diritti (e di salvarli)
This paper challenges the overestimation of the risks for human rights of a cultural
pluralism defined by using vague definitions of ethnic groups, or peoples, or nations.
Both communitarian and universalist positions have taken for granted the existence of
cultural juridifiable instances that, in the best of cases, can coexist in a multiculturalist
perspective. I underline the ideological dangers and the «identity traps» implicit in this
perspective, in the context of the contemporary turning point that sees the crisis not only
of the effectiveness of human rights, but also of their definition as a limit to political
power. Two examples concretely decline these criticisms: the culturalist instrumentalization of women’s rights and the contemporary exercise of the right to asylum by
people defined as belonging to other cultures in the face of the cancellation of this right
by countries that claim to be founded on a culture of rights. In conclusion, these pages
pose the question of how to re-signify the universality of rights in order to save them,
in the context of the only significant cultural clash between an institutional culture of
cancellation of rights, and a culture of a critical resistance for rights

Muovendo da una riflessione teorica che definisce l’asilo come il “diritto di confine” dei diritti umani, il presente contributo analizza criticamente il sistema di accoglienza e le procedure stragiudiziali che coinvolgono i richiedenti asilo, dall’arrivo in Italia fino all’audizione presso le Commissioni territoriali per il riconoscimento della protezione internazionale. A questo riguardo, viene descritto per ogni fase, sottolineandone l’importanza, il lavoro degli operatori legali delle associazioni e delle cliniche legali che, assistendo gratuitamente chi chiede protezione in Italia, rappresentano molte volte l’unica garanzia di accesso a un diritto universale troppo spesso violato nella sua concreta essenza
Categorizing migrants by undermining the right to asylum. The implementation of the «hotspot approach» in Sicily
This contribution aims to shed light on the specific mechanism of migrant categorization implemented by the so-called «Hotspot approach», which was launched by the EU Agenda on Migration in May 2015. This approach is here envisaged as a response to the current changes in the composition of migration towards Europe.
Provisions contained in EU and Italian policy documents are compared with concrete practices enacted on the ground by investigating two case studies: the initial opening of the Hotspot at Milo, in Trapani, and the first months of functioning of the Hotspot on Lampedusa. The empirical research covers the period between the last months of 2015 and the beginning of 2016.
The short-term consequences of the hotspot system have been the creation of thousands of irregularized migrants within the Italian territory, and a massive violation of the principles grounding the right to asylum. These consequences were so blatant to oblige Italian authorities to interrupt some of these practices. Yet, in the long term, this experimental phase can be regarded as a laboratory for the subsequent development of EU policies on migration and asylum

This paper questions the basis of the power of States to regulate immigration on their territory, by highlighting the contradictions, hypocrisies and omissions that mark both the institutional management of immigration and some theories, such as the one outlined in John Rawls' The Law of Peoples, that this management legitimize more or less directly. The perpetration of injustice on the international arena and the violations of law and rights that derive from it are therefore underlined, taking for example the hypocrisies connected with the application of international refugee law, also in light of the recent terrible evolutions to which the Ukrainian crisis has led
