Ochrona prawna fotografii produktowej w prawie polskim
No full textPrzedmiot badań: Przedmiotem badań w niniejszym opracowaniu jest ustalenie progów ochrony prawnej fotografii produktowych, które powszechnie wykorzystywane są w celu promocji i reklamy towarów i usług, w tym w szczególności w Internecie. Łatwość „zapożyczania” fotografii ze stron internetowych czy aukcji innych przedsiębiorców generuje częste spory, w ramach których poszkodowany coraz częściej domaga się ochrony prawnej.
Cel badawczy: Ustalenie kryteriów, których spełnienie uprawnia poszkodowanego do poszukiwania ochrony prawnej, jak również podstaw prawnych tej ochrony.
Metoda badawcza: W badaniach oparto się na analizie nielicznego orzecznictwa w sprawach dotyczących fotografii produktowych, a także – pomocniczo – innych utworów o podobnym (użytkowym) charakterze, a także wyroku ETS wydanego na tle fotografii portretowej. Odwołano się również do śladowych wypowiedzi doktryny. Część opracowania poświęcona jest analizie typu case study.
Wyniki: Badania wykazały, że fotografia produktowa może być przedmiotem ochrony prawno-autorskiej, przy spełnieniu przesłanek ustawowych. Dla powstania tej ochrony nie ma natomiast znaczenia ani subiektywne przekonanie autora o walorach fotografii, ani nakład jego pracy, ani fotografowany przedmiot, ani używany sprzęt.Background: This article focuses on the legal protection of product photography, which is often used for the purpose of promoting and advertising products and services, especially on the Internet. The ease of using the photographs from other enterpreneurs’ websites or auctions leads to many disputes in which they often seek legal protection.
Research purpose: The purpose of this work is to identify the legal basis of this protection as well as to determine the criteria that, if met, allow the plaintiff to seek legal protection.
Methods: The research is based on the analysis of (still very few) court judgements in cases involving product photography, but also other works of a comparable (commercial) character, as well as on the ECJ ruling on portrait photography. The author also referred to legal literature, although this topic has not yet fully attracted the attention of scholars. Part of the article focuses on the case study analysis.
Conclusions: The research leads to the conclusion that product photography can be protected by copyright if the legal requirements are met. This protection exists regardless of the author’s subjective opinion of the value of the photograph, the amount of work the author did, the subject being photographed, or the equipment used

No full textThis Bachelor thesis Conversion and Artistic Creation of Magdalena V. deals with the change of artistic expression of the Czech graphic artist Magdalena V., in a close connection to her religious conversion to the Catholic faith. The first part summarizes the theoretical knowledge of the psychology of religion. It introduces basic definitions and concepts of religion in relation to a religious conversion. In the second part, the author deals with the psychological analysis of Magdalena V.'s typical work through her life, which is supported by numerous photographs. Using the approach of rožnovská school, the author attempts to interpret this artwork on a hypothetical level, focusing on the M.V.'s life and artistic paralel before and after her conversion. The author draws on Magdalena V.'s testimonies about her life which bring light on the intention and context in her art. Related to the author's identification with Magdalena V.'s work, which later became apparent, this paper evolved further into identifying these moments and thus the potential risks inherent in author's own therapeutic work

First Person is a series of interviews with the first authors of a selection of papers published in Journal of Cell Science, helping early-career researchers promote themselves alongside their papers. Magdalena Woloszynska is the first author on ‘The Elongator complex regulates hypocotyl growth in darkness and during photomorphogenesis’, published in Journal of Cell Science. While completing this work, Magdalena was a postdoctoral fellow in the Chromatin and Growth Control group at the VIB-UGent Center for Plant Systems Biology at Ghent University, Belgium. Her research interests include plant molecular biology, epigenetics, transcriptomics, plant physiology and plant mitochondria.</jats:p
