Kewenangan Penjabat Sementara Kepala Desa dalam Menjalanakan Pemerintahan Desa Silangge Kecamatan Dolok Kabupaten Padang Lawas Utara
Salah satu desa di Kabupaten Padang Lawas Utara yang dipimpin oleh
Penjabat Sementara Kepala Desa sejak tahun 2013 adalah desa Silangge.
Pengangkatan pejabat kepala desa Silangge diakibatkan karena adanya pemberhentian
tetap terhadap kepala desa sebelumnya yaitu Irfan Sihombing yang meninggal dunia,
kemudian Bupati Kab. Padang Lawas Utara mengangkat Ridoan Siregar dan Camat
Kecamatan Dolok sebagai pejabat sementara di Desa Silangge Kec. Dolok Kab.
Padang Lawas Utara hingga tahun 2016. Berdasarkan uraian latar belakang diatas
maka penulis tertarik untuk meneliti kewenangan pejabat kepala desa sementara
dengan judul: “Kewenangan Penjabat Sementara Kepala Desa dalam
Menjalanakan Pemerintahan Desa Silangge Kecamatan Dolok Kabupaten
Padang Lawas Utara”.
Metode Penelitian yang di gunakan dalam penelitian ini adalah sifat penelitian
deskriftif analisis, dengan metode pendekatan yuridis empiris. Studi ini di lakukan
dengan wawancara dengan camatr kecamatan Dolok.
Adapun prosedur penetapan Penjabat Sementara (PJS) ditetapkan melaui
Peraturan Daerah Kabupaten Padang Lawas Utara Nomor 2 Tahun 2015 tentang
Pemberhentian dan Pengangkatan Kepala Desa. Masa jabatan Penjabat Semntara
Kepala Desa berdasarkan Pasal 22 Peraturan Pemerintah Nomor 72 Tahun 2005
tentang Desa adalah 6 (enam) bulan, kemudian Pasal 46 ayat (1) Undang-Undang
Nomor 6 Tahun 2014 tentang Desa menjelaskan dalam hal sisa masa jabatan kepala
desa yang di berhentikan sebagaimana di maksud dalam Pasal 43 tidak lebih dari 1
(satu) tahun, Bupati/walikota mengangkat pegawai negeri sipil dari pemerintah
daerah Kabupaten/Kota sebagai pejabat kepala desa sampai dengan terpilihnya kepala
desa, Pasal 47 ayat (1) menjelaskan dalam hal sisa masa jabatan kepala desa yang
diberhentikan sebagaimana di maksud dalam Pasal 43 lebih dari 1(satu) tahun,
Bupati/Walikota mengangkat pegawai negeri sipil dari pemerintah daerah
Kabupaten/Kota sebagai pejabat kepala desa; Kewenagan Penjabat Sementara Kepala
Desa dalam menjalankan pemerintahan desa Silangge sama halnya dengan kepala
desa, Ridoan Siregar sebagai Penjabat Sementara Kepala Desa Silangge di tahun
2013 memiliki tugas pokok untuk melaksanakan pemilihan kepala desa, kemudian di
angkatnya H Aris Muda Dongoran sebagai Penjabat Sementara Kepala Desa Silangge
di tahun 2015 juga memiliki tugas pokok untuk menyeleggarakan pemilihan kepala
desa. Masa jabatan Penjabat Sementara Kepala Desa Silangge H Aris Muda
Dongoran melakukan pembangunan infrastruktur desa melalui dana desa di tahun
2015 dan tahun 2016 serta melaksanakan pemilihan kepala desa Silangge di tahun
2016; Kendala dan upaya Penjabat Sementara Kepala Desa dalam menjalankan
pemerintahan desa Silangge adalah kendala rangkap jabatan sebagai Penjabat
Sementara Kepala Desa, kendala minimnya sumber daya manusia, kendala sarana dan
prasarana, kendala operasional. Adapun upaya yang dilakukan untuk mengatasinya
adalah dengan melakukan pertemuan antara pemerintah desa Silangge dengan tokoh
masyarakat, melakukan bimbingan teknis, dan sosialisasi
Indonesian national health policy: Legal analysis of the elimination of mandatory health spending
Pusphose: The elimination of mandatory spending in Law No. 17 of 2023 on Health has sparked controversy, particularly because it contradicts the World Health Organization's recommendation that allocates 5-6% of GDP to health budgeting to facilitate better access to healthcare services. This removal also potentially violates the Indonesian Constitution, which through Article 28E, Article 28H paragraph (2), Article 28D paragraph (3), and Article 34 paragraph (3) guarantees the fulfillment of health rights for vulnerable groups.
Method: This study employs a legal dogmatic research method to analyze the constitutionality of eliminating mandatory spending in Law Number 17 of 2023 on Health, as it pertains to the 1945 Constitution of the Republic of Indonesia, using John Rawls' theory of justice as a tool for legal analysis.
Result: Law No. 17 of 2023 on Health has eliminated the mandatory spending provision, which previously stipulated a minimum health budget allocation of 5% from the national budget (called APBN) and 10% from the regional budgets (called APBD), as per Law No. 36 of 2009. The new law introduces performance-based budgeting, but it remains unclear how it will be implemented, especially at the regional level. The main criticism is that this potential elimination could reduce health guarantees for vulnerable groups, contradicting the principles of social justice mandated in the Indonesian Constitution.
Conclusion: Although the Constitutional Court has rejected a formal review of this law, opportunities still remain for a substantive examination of the real impact of this elimination on the health access of vulnerable groups
The position of state-owned enterprises: Towards a health sector super holding company paradigm
Purpose: In Indonesia, the State-Owned Enterprises holding in the healthcare sector operates under the mandate of Article 33 of the 1945 Constitution, consisting of two main holding companies: PT. Bio Farma (Persero), which includes PT Kimia Farma, PT Indofarma, and PT Inuki, as well as Pertamedika IHC that manages SOE hospitals nationwide. The overlap in business activities between PT. Bio Farma and Pertamedika IHC suggests the potential for establishing a super healthcare holding.
Method: This research, conducted normatively, evaluates the principles and legal norms for creating such a super holding, referencing the legislative framework and Constitutional Court decisions.
Result: The proposed super holding would adopt a modern corporate structure led by a Chief Executive Officer, akin to Temasek in Singapore or Khazanah in Malaysia. The establishment of a super healthcare holding company involves PT. Bio Farma with its 410 healthcare clinics and Pertamedika IHC as the parent holding of SOE hospitals, which manages 75 hospitals and 143 healthcare clinics throughout Indonesia.
Conclusion: However, legal challenges, including the state's financial status and the legal relationships between parent and subsidiary companies, necessitate amendments to Law No. 19 of 2003 on SOEs to provide a stronger legal foundation for the formation of the super holding
Handling of Juvenile Brawl Crimes through Criminal Law Policy in Medan City
This study focuses on criminal law policies in dealing with criminal acts of assault or brawls (tawuran) caused by juvenile delinquency in Medan City. Student brawls have become a trend among teenagers, especially at the high school level and equivalent, which are triggered by various internal and external factors, including family influences, school environment, and social pressure. This study aims to determine the legal basis governing criminal acts of brawls, the factors causing brawl behavior among students, and efforts to overcome them made by law enforcement, the community, and schools. The approach used in this study is a qualitative descriptive method, which includes data collection through interviews and direct observation at the Medan Police Headquarters. The results of the study indicate that factors such as frustration, emotional disturbances, and environmental influences contribute to juvenile delinquency behavior that leads to brawls. This study emphasizes the importance of the Restorative Justice approach in resolving brawl cases and proposes the need for collaboration between educational institutions, law enforcement, and the community to prevent and handle these cases effectively
CONTRACT REVIEW ON GOLD LEASING PRACTICES AT BIREUN CITY
Muamalah is the one part of Islamic law that regulates several things that are directly related to the way of life between humans in everyday life. Cooperation and mutual assistance between humans, one of which is now entering the community is the practice of leasing gold. The lease agreement is a contract for taking the benefits of an object, so terms of the use of the object of the lease must be concisely to both parties, this study aims to find out how the gold lease agreement in Bireun, and how the Islamic perspective on the practice of leasing gold. The research he field research, which is a study that aims to obtain data or information on the original situation in the field. Primary data was obtained through interview method. The data analysis method in this research is descriptive qualitative analysis. The approach that the author takes in this article is to use the empirical normative method. The analys described is based on the implementation of gold leases at Kota Juang Bireun Regency, based on the high level of injustice and harm to one party, especially to the tenant. concludes that the author from Islamic law says it is not permissible in accordance with syara provisions where the implementation does not meet the terms and conditions of the lease
Service Transformation as a Tool for Promoting Sustainable Rural Development in Central Java
The current developments in Information Technology (IT) should not only be utilized by the public and the private sectors but also by all parties effectively. The government must also be able to take advantage of these advances in many ways, such as in providing government services. The role of IT in managing government has now become an essential part of the society. This study examines the people\u27s expectations in Melikan Village and focuses on using IT advances to create an independent village. The author then draws upon SDG theories to delineate the service transformation process. It is a qualitative study consisting of primary and secondary data. The data collection techniques used in this study include in-depth interviews, FGD, observations, and document analysis. The findings show that IT has become a vital need for the people in Melikan, but the village government fails to meet those expectations. The study suggests that the local government needs technological innovation to develop Melikan Village and add more personnel to help with government services
MANAJEMEN PIMPINAN CABANG IKATAN PELAJAR NAHDLATUL ULAMA (PC IPNU) KABUPATEN TANGGAMUS DALAM MENINGKATKAN KUALITAS KADER
ABSTRAK
Penelitian ini bertujuan untuk mendeskripsikan tentang
manajemen PC IPNU Kabupaten Tanggamus dalam meningkatkan
kualitas kader dan apa saja faktor penghambat dan pendukung PC IPNU
Kabupaten Tanggamus dalam meningkatkan kualitas kader. PC IPNU
Kabupaten Tanggamus merupakan salah satu cabang yang tergabung
dalam Ikatan Pelajar Nahdlatul Ulama (IPNU) di Provinsi Lampung.
Prestasinya yang luar biasa terbukti dengan meraih akreditasi A,
merupakan buah dari kerja keras, semangat juang, dan sinergi yang kuat
antara para kader IPNU di wilayah tersebut. Kehadiran PC IPNU
Kabupaten Tanggamus yang mendapat predikat baik tidak hanya
mencerminkan kualitas individu kader, tetapi juga menunjukkan
kemampuan kerjasama mereka dalam menghadapi tantangan dan
mencapai tujuan bersama. Peran manajemen dalam kesuksesan ini tidak
dapat diabaikan, karena tanpa adanya manajemen yang baik, pencapaian
maksimal dalam efektivitas dan efisiensi kerja dalam organisasi seperti
PC IPNU Kabupaten Tanggamus akan sulit untuk terwujud.
Penelitian ini menggunakan beberapa metode yang dianggap
relevan dalam menggali data, menganalisis dan menarik kesimpulan
penelitian. Jenis penelitian ini adalah field research atau penelitian
lapangan dengan menggunakan pendekatan kualitatif. Penelitian ini
menggunakan teknik pengumpulan data wawancara, observasi dan
dokumentasi. Dan untuk data penunjang lainnya diperoleh melalui
kepustakaan dan dokumentasi, semua data tersebut merupakan bahan
bahan untuk mendeskripsikan manajemen PC IPNU kabupaten
Tanggamus dalam meningkatkan kualitas kader dan apa saja faktor
penghambat dan pendukung PC IPNU kabupaten Tanggamus dalam
meningkatkan kualitas kader
Dari hasil penelitian yang dilakukan oleh penulis tentang
manajemen pada organisasi PC IPNU Kabupaten Tanggamus dalam
meningkatkan kualitas kader sudah berjalan dengan baik dari seluruh
fungsi manajemen yang ada seperti perencanaan dalam meningkatkan
kualitas kader karena karena sudah berjalan sesuai dengan fungsinya.
Dari segi pengorganisasian belum dapat dikatakan baik secara
keseluruhan karena masih kerap terjadi miskomunikasi antara sesama
anggota. Selanjutnya dalam fungsi pengarahan di PC IPNU untuk
meningkatan dan mengembangkan kualitas kader berjalan sesuai apa
yang direncanakan. Terakhir dalam fungsi pengawasan juga sudah dapat dikatakan baik karena berhasil memainkan peran sentral dalam
memantau, mengevaluasi, dan memastikan efektivitas dari berbagai
kegiatan yang dulakukan. Kemudian faktor penghambat dan pendukung
dalam meningkatkan kualitas kader di PC IPNU menurut analisis SWOT
yang penulis lakukan PC IPNU Kabupaten Tanggamus menempati posisi
kuadran I pada diagram SWOT yang secara umum dianggap sebagai
posisi strategis yang menguntungkan, karena kebijakan pertumbuhan
yang agresif atau growth-oriented strategy cenderung menjadi pilihan
yang tepat. Dalam konteks ini, organisasi dianjurkan untuk fokus pada
pengembangan dan pemanfaatan kekuatan internalnya, sekaligus
memanfaatkan peluang yang ada di lingkungan eksternal.

This study aims to describe the management of PC IPNU
Tanggamus Regency in improving the quality of cadres and what are the
inhibiting and supporting factors of PC IPNU Tanggamus Regency in
improving the quality of cadres. PC IPNU Tanggamus Regency is one of
the branches that are members of the Nahdlatul Ulama Student
Association (IPNU) in Lampung Province. His extraordinary
achievement is proven by achieving A accreditation, which is the fruit of
hard work, fighting spirit, and strong synergy between IPNU cadres in the
region. The presence of the Tanggamus Regency IPNU PC which
received a good predicate not only reflects the quality of individual
cadres, but also shows their cooperative ability in facing challenges and
achieving common goals. The role of management in this success cannot
be ignored, because without good management, maximum achievement
in effectiveness and work efficiency in organizations such as PC IPNU
Tanggamus Regency will be difficult to realize.
This study uses several methods that are considered relevant in
digging data, analyzing and drawing research conclusions. This type of
research is field research using a qualitative approach. This study uses
interview, observation and documentation data collection techniques. And
for other supporting data obtained through literature and documentation,
all of these data are materials to describe the management of PC IPNU
Tanggamus district in improving the quality of cadres and what are the
inhibiting and supporting factors of PC IPNU Tanggamus district in
improving the quality of cadres
From the results of the research conducted by the author on the
management in the PC IPNU organization of Tanggamus Regency in
improving the quality of cadres, all existing management functions have
been running well such as planning in improving the quality of cadres
because it has been running in accordance with its functions. In terms of
organization, it cannot be said to be good as a whole because there is still
often miscommunication between fellow members. Furthermore, in the
direction function at the IPNU PC to improve and develop the quality of
cadres running according to what is planned. Finally, in the supervisory
function, it can also be said to be good because it has succeeded in
playing a central role in monitoring, evaluating, and ensuring the
effectiveness of various activities carried out. Then the inhibiting and
supporting factors in improving the quality of cadres in PC IPNU according to the SWOT analysis conducted by the author, PC IPNU
Tanggamus Regency occupies the first quadrant position in the SWOT
diagram which is generally considered a favorable strategic position,
because aggressive growth policies or growth-oriented strategies tend to
be the right choice. In this context, organizations are encouraged to focus
on developing and utilizing their internal strengths, while taking
advantage of the opportunities that exist in the external environment.
