تهدف هذه الدراسة الى إلقاء الضوء على مقاصد تكوين الأسرة باعتبارها اللبنة الأولى لبناء المجتمع، وذلك من منظور القرآن الكريم في الحفاظ عليها. ومن المعلوم أن تكريم القرآن للأسرة أحد أسباب بقاء النوع الإنساني في الكون، والحفاظ عليه من الاندثار والفناء، حيث جعل حفظ النسل من مقاصد الشريعة الخمسة كي تتحقق غاية وجوده؛ وهي العبودية المطلقة لله. وقد اعتمد الباحثان على المنهج الاستقرائي من خلال جمع الآيات القرآنية والأحاديث النبوية الشريفة التي تحدثت عن مقاصد تكوين الأسرة، كما سلكت الدراسة المنهج الوصفي التحليلي لبيان أهمية تكوين الأسرة في ضوء الآيات القرآنية وتفسيرها مستعينة على أقوال المفسرين والعلماء، ومن ثم تحليلها واستنباط دلالاتها وتحقيق الغاية الكبرى في خلق الانسان. وقد خلص البحث إلى أهم النتائج ومنها: أثبت البحث أن من أهم مقاصد تكوين الأسرة مقصد تعزيز الدين، ومقصد تعزيز العلاقات الاجتماعية ومقصد تنمية الموارد الاقتصادية.

This study aims to shed light on the purposes of family formation as the first building block of society, from the perspective of the Holy Qur’an to preserve it. It is known that the Qur’an’s honoring of the family is one of the reasons for the survival of the human species in the universe, and its preservation from extinction and annihilation. It is absolute servitude to God. With the presence of the family, the complete and absolute servitude to God is realized. The two researchers relied on the inductive approach by collecting Qur’anic verses and the noble Prophetic hadiths that spoke about the purposes of family formation. The study also took the descriptive analytical approach to show the importance of family formation in the light of the Qur’anic verses and its interpretation using the sayings of the commentators and scholars, and then analyzing it and eliciting its connotations and achieving the major goal in creating the human being. The research concluded the most important results, including that one of the most important purposes of family formation is the goal of strengthening religion, the goal of strengthening social relations and the goal of developing economic resources.

Syed Anwer Ali and his Methodological Approaches in Tafsīr “Qur’ān the Fundamental Law of Human Life”
Get PDFTafsīr “Qur’ān the Fundamental Law of Human Life” is an English Qur’ānic commentary by Syed Anwer Ali. This work is primarily inspired by Urdu and English commentaries written in 20th century. Although it is considered an elaborate work on tafsīr, no research has so far been conducted to explore its methodological pattern or to provide a critical analysis of this commentary. This study aims at dissecting the structure and analyzing the general methodological pattern of this commentary. More specifically, current study provides a comprehensive introduction of Syed Anwer Ali and his literary contributions, a brief introduction of his Qur’ānic commentary, the basic features and methodological analysis of this commentary. The methodological analysis reveals that Syed Anwer has not solely relied on the conventional method of tafīsr but he used a hybridized approach by aggregating conventional and modern methods. The structural dissection of this commentary reveals that it is seemingly inspired from the Urdu commentaries of 20th century and his adopted methodology is consistent with the existing prominent tafāsīr originated from the subcontinent
Polygamy in the Light of Maqāsid Al-Sharī‘a

Intent of Sharia is to provide these rights to all followers irrespective of their gender, marital, social or economic status. From marital point of view, the widow and divorced woman has right of second marriage, either with a married man or unmarried. Similarly, a man has a right to have four wives at a time and this system is known as polygamy. This paper, in this context, explores the wisdom behind polygamy in the light of Maqāsīd Al-Sharī‘a. It tries to answer these questions: Is the law of polygamy allowed to fulfil one’s sexual desires legally? Secondly: what are the implication of polygamy in the preservation of family/ human race and nipping the social evils like prostitution, suicidal intentions, and mental issues? This study is divided into three sections including: (1) A brief introduction to Maāsid-Al-Shariah; (2) Polygamy and its brief history; and (3) Wisdom behind polygamy in the light of Maqāsid Al-Sharī‘a
منهج المراغي في التفسير السياسي للقرآن
No full textيصنف تفسير المراغي من التفاسير السياسية والاجتماعية المعاصرة التي اعتمدت على لغة يسيرة اهتمت ببيان معاني القرآن، مع مراعاة أفهام الناس والمجتمع رغم اختلاف مشاربهم العلمية. ونظراً لما مرّ به المفسر من أحداث سياسية كثيرة، فقد ظهر أثر ذلك على تفسيره من حيث بيان ما تضمنه القرآن من قضايا ومسائل سياسية مهمة. من أجل ذلك هَدَف هذا البحث إلى الكشف عن معالم منهج المراغي في التفسير السياسي للقرآن الخاصة بقضايا العدل والمساواة والشورى وغيرها. ولتحقيق مقصد هذا البحث اعتمد كاتباه على منهجين: الاستقرائي، وذلك لمحاولة تتبع ما تضمنه تفسير المراغي من التركيز على الجوانب السياسية. ومن أجل إتمام هذا البحث تم الاعتماد على المنهج التحليلي، لدراسة ومناقشة وتصنيف محتوى الجوانب السياسية في تفسير المراغي. وقد توصل البحث إلى أن المراغي اعتمد على ثلاث مناهج رئيسة تمكن من خلالها إلى إبراز التفسير السياسي للقرآن، وهي: تنزيل الآيات على الواقع الذي كان يعاصره، وإبراز السنن الإلهية في الأفراد والمجتمعات، وأخيراً الاعتبار بتاريخ الأمم والحضارات.Al Marāghī’s interpretation is regarded as one of the finest contemporary interpretations that focused on elaborating the meanings of the Qur’an while taking people's understandings and society at the time into account. The impact of the various political scenarios the interpreter experienced was evident in his interpretation of discovering the significant political issues and concerns found in the Qur'an. As a result, this study aims to reveal the political interpretation approach of al Marāghī, so that it can be used to comprehend the dimensions of the Qur'anic meanings in these issues. To accomplish this, the study used two approaches: the inductive approach, which attempted to identify the political aspects contained in al Marāghī's interpretations, and then the analytical approach which studies and analyses the content of the political aspects in his interpretation. The study concluded that al Marāghī relied on three main approaches to highlight the political interpretation of the Qur'an, namely: placing the Qur’anic verses in modern contexts, highlighting divine universal principles in individuals and societies, and finally considering the history of the nations and civilizations
The goods and services tax (GST) on takāful products: a critical Sharīʿah appraisal
No full textPurpose: This paper aims to ascertain the Sharīʿah (Islamic law) stance on the imposition of goods and services tax (GST) on tabarruʿ-based takāful (donation-based Islamic insurance) products in Malaysia. The paper aims to do so by analysing the philosophy, Purpose:s and structure of GST on takāful products and comparing the imposition of GST on tabarruʿ-based takāful with its imposition on conventional insurance while probing into the Sharīʿah texts and opinions of classical and contemporary scholars about taxation in Islam. Design/methodology/approach The paper uses a qualitative research methodology. In addition to the literature and text on websites, the information on how GST is applied in practice is also obtained through interviews, discussions and documents from takāful operators. To determine the Sharīʿah position on GST, reference has been made to classical and contemporary Sharīʿah literature, including local and international Sharīʿah advisory bodies' resolutions and standards. Findings This study finds that a strict interpretation of Sharīʿah does not allow for the imposition of GST; however, there is still room for the government to justify it using a broader interpretation of maṣlaḥah (public interest). Takāful has become a need for the society and is subscribed to by all income groups, and not only by the rich. Hence, the government should consider exempting takāful products from GST. The basis of tabarruʿ in takāful does not provide conclusive Sharīʿah evidence for takāful to be exempted from GST. Originality/value This research paves the way for the industry to propose further measures on GST for takāful products such as the exemption of GST on the tabarruʿ amount or imposition of a zero rate of GST on the relevant takāful fees and charges that are currently burdensome to consumers

The practice of takaful benefit (nomination) in the context of IFSA 2013: a critical appraisal
No full textNomination, in the context of takaful (Islamic insurance), involves the takaful participant nominating a person to receive the takaful benefits in the event of the participant's death before the maturity of the takaful plan. Distribution of the takaful benefits that are to be received upon maturity of the takaful plan is a main concern arising in family takaful, an Islamic alternative to life insurance. Upon the death of the participant, the takaful benefits may either be payable to the estate of the participant or to a person nominated by the participant as the sole recipient of the benefits of such a takaful policy. The effect of such a nomination is the central focus of this research paper. Reference to the Islamic Financial Services Act 2013 (IFSA) is crucial to identify the nature, position and effect of nomination in Malaysia
