    Romanian public administration reform 2.0: using innovative foresight methodologies to engage stakeholders and the public

    Purpose: The purpose of this practice-oriented paper is to look at a recent, late-phase development in public administration (PA) reform in Romania, specifically the drafting of the recently adopted national Strategy on Strengthening the Efficiency of Public Administration (2014-2020). In particular, the paper focuses on the opportunities and limits of outsourcing the building of the vision underlying the strategy and the prioritization of strategic objectives. The article’s story is also placed in the broader context of agencification literature and, more specifically, the involvement of executive agencies in policymaking. Design/methodology/approach: The paper describes the vision-building exercise, developed according to a script already tested in several sectoral strategy-making processes, and the objectives and procedure of the online participatory consultation by using an adapted real-time Delphi format (similarly tested in the recent past). Findings: The paper reports on the ways in which the output of the visioning process and of online consultations may be used to enhance a strategic process already underway. Originality/value: PA reform in post-communist countries has been among the most hotly debated, intensely pursued, yet seemingly elusive policy objectives of the transition and post-transition periods. Among pre-accession and then European Union (EU) member states, the need to get in and then to get involved in European policymaking provided some impetus for such reforms and also set substantial constraints, without however always adding much predictability or significantly streamlining the public sector. The paper contributes to this debate by proving an innovative method of devising a reform strategy by outsourcing the strategy-building process to an agency with the necessary know-how and experience.</p

    This essay investigates how the author Oline Stig creates identities for her main characters in three short stories; Midsommar, Polly Maggoo and Den längsta dagen from the collection Den andra himlen (2007). My investigation is based on concepts chosen from psychology and narratology: First, Jonas Stier’s definition of human identity. In his definition he focuses on a person’s social context. He also considers identity formation as an ongoing, ever- changing process. Second, Gerard Génette’s and Maria Nikolajeva’s concepts concerning focalization and the perspective and voice of narration. My analysis tries to answer the question if the perspective of narration has any effect on the readers understanding for the characters’ processes of identity. I have found that other aspects than the perspectives of narration are more important in portraying a fictional character in these short stories. For example: in one of the stories - Polly Maggoo – narration is part of the identity forming process: the main character is influenced by and portrayed via the stories told by a friend, and later, via the stories she tells another friend about herself.     Materiality Assessment in Sustainability Reporting on the Example of the SA North Estonia Medical Centre

    Euroopa Liidu kehtestatud Euroopa kestlikkusaruandluse direktiivi alusel avaldab SA Põhja-Eesti Regionaalhaigla 2025. aastal majandusaasta aruande tegevusaruande eraldiseisvas osas oma tegevuse kohta kestlikkusaruande. Direktiiv kohustab ettevõtteid raporteerima oma mõjust keskkonna-, sotsiaal- ja juhtimisteemadega seotud aspektidele. Aruande koostamisel põhinetakse Euroopa kestlikkusaruandluse standardi nõuetele ning lähtutakse topeltolulisuse kontseptsioonist, mis on vajalik ettevõtte mõjude, riskide ja võimaluste väljaselgitamiseks. Käesoleva lõputöö eesmärgiks oli läbi viia Regionaalhaiglale kestlikkusaruandluse oluliste teemade hindamine lähtuvalt topeltolulisuse põhimõttest. Lõputöö käigus viis autor läbi viis töötuba Regionaalhaigla töörühma ja patsiendinõukoja liikmetega. Lisaks loodi patsiendinõukoja liikmetele küsimustik oluliste teemade hindamiseks ja kestlikkusaruandlusesse sisendi saamiseks. Oluliste teemade analüüsi tulemused koondati ning kujutati topeltolulisuse maatriksil. Teoreetilises osas anti ülevaade kestlikkusest, säästva arengu eesmärkidest, kestlikkusaruandluse direktiividest, Euroopa kestlikkusaruandluse standarditest ning topeltolulisuse põhimõttest. Töö empiirilises osas tutvustati Regionaalhaiglat, töös kasutatud oluliste teemade hindamise metoodikat ning analüüsiti ja tehti järeldusi saadud tulemuste põhjal. Lisaks loodi Regionaalhaigla kestlikkusteemade topeltolulisuse maatriks. Lõputöö eesmärgi saavutamiseks püstitas autor kolm uurimisülesannet. Esimene uurimisülesanne oli anda ülevaade kestlikkusaruandlusest ja topeltolulisuse nõuetest. Antud teemade mõistmine on vajalik eeltöö, et mõista ja läbi viia kestlikkusaruandluse oluliste teemade hindamise protsessi. Teiseks viidi Regionaalhaiglas läbi oluliste teemade hindamine, mille sooritamisel toetuti Euroopa kestlikkusaruandluse standarditele ning EFRAGi juhendmaterjalidele. Teemade hindamiseks tutvuti Regionaalhaigla väärtusahelaga, koostati nimekiri sidusrühmadest ning loodi skaalad teemade mõju olulisuse ja majandusliku olulisuse hindamiseks. Teemasid hinnati ja koondati Microsoft Excel tabelis. Töö koostamiseks vajaliku sisendi saamiseks, koostati patsiendinõukoja liikmetele küsimustik Microsoft Forms rakenduse abil, kus viieastmelisel skaalal paluti hinnata raviteenuse osutamisega, organisatsiooni juhtimisega, teenuse osutamisega, töötajatega ja haigla tegevusega seotud teemade olulisust. Küsimustikule vastasid 6 inimest. Kõiki teemasid hinnati peamiselt oluliseks või väga oluliseks. Vaid patsiendi ja lähedaste kaasamist patsiendi raviprotsessis hinnati ühel korral vähe oluliseks teemaks. Teine oluline teemade hindamise töörühm koosnes kuuest Regionaalhaigla töötajast, kellega arutleti nii keskkonna, sotsiaalteemade kui juhtimisega seotud kestlikkusaspektide üle ning hinnati neid töös loodud skaalade põhjal. Kõige keerulisemaks osutus antud topeltolulisuse hindamises majandusliku olulisuse osa, mille ressursside kättesaadavuse hindamine vajas põhjalikumat arutelu. Kestlikkusaspektide hindamistulemusi kasutati maatriksi loomisel või on edaspidi abiks kestlikkusaruande koostamisel. Viimasena loodi kogutud tulemuste põhjal Regionaalhaigla topeltolulisuse maatriks, kus hinnatud teemasid kujutati vastavalt nende väärtustele kaheteljeliselt – mõju olulisuse ja majanduslik olulisuse telgedel. Loodud maatriksilt võib järeldada, et Regionaalhaigla peab eriti oluliseks ravikvaliteeti, keskkonnateemasid, töötajate mitmeid töötingimusi, ettevõtte kultuuri ja poliitilist aktiivsust, innovatsiooni ning valdkonna haridusse panustamist. Mitte ühtegi teemat ei hinnatud mõju olulisuse poolest vähe oluliseks. Autori hinnangul sai lõputöö eesmärk täidetud, kuid edaspidi võiks oluliste teemade hindamisel kaasata rohkem sidusrühmi ja erialade spetsialiste, et saada läbipaistvamat ja põhjalikumat sisendit kestlikkusaruande koostamiseks. Lisaks võiks tulevikus anda sidusrühmadele pidevat tagasisidet esialgsete järelduste kohta, et hindamist pidevalt täiustada ja asjakohastada.The aim of this graduation thesis Materiality Assessment in Sustainability Reporting on the Example of the SA North Estonia Medical Centre is to conduct an assessment of sustainability reporting topics for the North Estonia Medical Centre, based on the double materiality principle. On the basis of the European sustainability reporting directive, in 2025 the North Estonia Medical Centre will publish a sustainability report on its activities as a separate section of its annual activity report. The directive obliges companies to report about their impacts, risks and opportunities on aspects related to environmental, social and governance issues. The assessment is based on the European sustainability reporting standards. Throughout this study, author conducted five workshops with the hospital's working group and 6 patient council members. Additionally, a questionnaire was developed for patient council members to assess important topics and gather input for sustainability reporting. The results of this materiality assessment were assembled into a double materiality matrix. The graduation thesis consists of two chapters. The theoretical chapter provides an overview of sustainability in general, sustainable development goals, sustainability reporting directives, European sustainability reporting standards and the double materiality principle. The empirical chapter introduces the North Estonia Medical Centre, describes the methology of materiality assessment, analyzes the findings, and makes conclusions. Based on the results, a double materiality matrix was created. To achieve the target of this thesis, author set three research tasks. The first was to give an overview of sustainability reporting and the double materiality assessment requirements. The second task was to conduct the materiality assessment process at the regional hospital, relying on European sustainability reporting standards and EFRAG implementation guidance. The sustainability topics were evaluated in Microsoft Excel using scales, and additional data from patient council members was gathered through a questionnaire via Microsoft Forms. The topics assessed in workshops and questionnaire were primarily rated as important or very important, with a few exceptions. Lastly, the results were used to create a double materiality matrix, where the sustainability topics where displayed according to their values on two axes: impact materiality and financial materiality. The matrix indicated that the North Estonia Medical Centre places high importance on quality of care, environmental issues, working conditions, corporate culture and political activity, innovation, and contributions to education in the field. In terms of impact materiality, no topics were considered as low importance. The aim of the graduation thesis has been reached. For future enhancements, author suggests involving more stakeholders and specialists in the materiality assessment process to secure more transparent and comprehensive input for the sustainability report. Additionally, in the future, it would be beneficial to provide continous feedback to stakeholders on preliminary findings. This would allow more improvements and updates to the evaluation process

    Intrång i patent på den andra medicinska indikationen : "Skinny labelling" och generisk substitution

    När frågan om möjligheten att patentera nya användningsområden för redan kända läkemedel aktualiserades under det Europeiska patentsystemet, kunde två hinder identifieras. Dels är den aktiva substansen i sig inte ny och dessutom förbjuder patentsystemet uttryckligen patent på medicinska förfaranden för diagnostisering eller terapeutisk och kirurgisk behandling. Genom både rättspraxis och lagstiftning har man dock försökt kringgå dessa hinder och till följd av den uttryckliga bestämmelsen om patent på den så kallade andra medicinska indikationen som EPC 2000 tillhandahåller, kan dess patenterbarhet inte längre ifrågasättas. Med anledning av den speciella karaktär som kravformuleringen för dessa patent åtnjuter och till följd av den snäva tolkning av kravformuleringen som den sparsamma praxis på detta område återspeglar, kan det däremot ifrågasättas om inte kraven för dess upprätthållande är alltför långtgående. Det utgör särskilt ett problem när läkemedelstillverkare använder möjligheten att genom "skinny labelling" utesluta patentskyddade indikationer från produktinformationen, för att kunna introducera generiska läkemedel för icke-patentskyddade indikationer på marknaden. Två motstridiga avgöranden som nyligen meddelats i Storbritannien respektive Nederländerna, vilka särskilt behandlar frågan om intrång i förhållande till "skinny labelling", återspeglar det oklara rättsläge som detta rättsområde präglas av. I Sverige kompliceras intrångsfrågan ytterligare av frågan om i vilken utsträckning dessa patent kan upprätthållas till följd av bestämmelser i folkhälsolagstiftningen om generisk substitution. Enkelt förklarat medför dessa bestämmelser att billiga generikaläkemedel, som enbart innehar försäljningsgodkännande för icke-patentskyddade indikationer, byts ut på apoteken mot originalläkemedel, oavsett för vilken indikation läkemedlet förskrivits. I praktiken innebär det att dessa läkemedelskopior även expedieras för patentskyddade indikationer. För att lösa den problematik som regelverket orsakar och till följd av de höga krav som i praxis tycks ställas upp för upprätthållandet av patent på den andra medicinska indikationen, anser författaren att lagstiftaren bör se över hur den svenska folkhälsolagstiftningen och det Europeiska patentsystemet bättre kan samspela.Two obstacles could be identified when the question of granting patent protection for second medical use of known pharmaceutical products arose in the European patent system. On one hand, the active substance in itself is not new and on the other hand, the system explicitly prohibit method claims for treatment by surgery or therapy and diagnostic methods. However, these barriers have been circumvent in case law and legislation and due to the express provision of second medical use patents in the EPC 2000, its patentability is no longer to be questioned. Due to the special character of second medical use claims and as a result of the narrow interpretation that the sparse case law in this area reflects, it may however be questioned whether the requirement of its enforcement is far to excessive. This is particularly a problem when generic manufacturers uses the possibility of "skinny labelling", in order to exclude patented indications from the product information. As recently announced in the UK and the Netherlands, two conflicting decisions that specifically addresses the issue of patent infringement on second medical use patents in relation to "skinny labelling", reflects the legal uncertainty that characterizes this area of ​​law. In the Swedish context, the issue of enforcement of second medical use patents is further complicated as a result of mandatory provisions on generic substitution. In simple terms, these provisions causes inexpensive generic versions, which solely obtains marketing approval for off-patent indications, to exchange original pharmaceuticals at pharmacies regardless of the indication the drug has been prescribed. In practice, this means that these generic versions will also be dispensed for patented indications. In order to solve the problems that this regulatory framework causes and as a consequence of the high demands set out for the enforcement of second medical use patents, the author believes that it is advisable that the legislator performs a review on how the Swedish public health legislation and the European patent system better can interact on this issue

The article’s story is also placed in the broader context of agencification literature and, more specifically, the involvement of executive agencies in policymaking. Design/methodology/approach The paper describes the vision-building exercise, developed according to a script already tested in several sectoral strategy-making processes, and the objectives and procedure of the online participatory consultation by using an adapted real-time Delphi format (similarly tested in the recent past). Findings The paper reports on the ways in which the output of the visioning process and of online consultations may be used to enhance a strategic process already underway. Originality/value PA reform in post-communist countries has been among the most hotly debated, intensely pursued, yet seemingly elusive policy objectives of the transition and post-transition periods. Among pre-accession and then European Union (EU) member states, the need to get in and then to get involved in European policymaking provided some impetus for such reforms and also set substantial constraints, without however always adding much predictability or significantly streamlining the public sector. The paper contributes to this debate by proving an innovative method of devising a reform strategy by outsourcing the strategy-building process to an agency with the necessary know-how and experience. </jats:sec
