Non è compito della giurisdizione sindacare, sul piano etico e sociale, il comportamento dei consociati in una determinataepocastorica, poiché ilprocessocivile (e in particolare quelloaventeadoggetto vicende di responsabilità civile) è funzionale ad offrire precise risposte, rigorosamente circoscritte al piano del diritto, a singole vicende che riguardano singole persone che chiedono tutela al giudice. Ma, specularmente, il giudice civile, nella valutazione e liquidazione del quantum debeatur, non può e non deve ignorare - quasi che la dimensione della giurisdizione si collochi entro un asettico territorio di pensiero tanto avulso dal reale, quanto insensibile ai mutamenti sociali e culturali incui essa viene esercitata - il preoccupante climadi intolleranza e di violenza,nonsoltanto verbale, nel quale vivono oggi coloro cui è demandato il processo educativo e formativo delle giovani e giovanissime generazioni. Alla stregua del così compiuto accertamento dell’an debeatur, è compito del giudice del rinvio procedere alla liquidazione del danno sul piano equitativo, valutando tutte le circostanze emerse nel corso del giudizio. Nonostante le - pur caute - aperture delle Sezioni Unite in tema di astratta compatibilità dei danni punitivi con l’ordinamento interno (n. 16601/2017), nutrita è la schiera di Autori sospettosi dall’avanzata delle sanzioni civili ultracompensative. L’articolo si occupa di fornire risposta ai luoghi comuni che inducono a guardare con diffidenza l’ultracompensazione in funzione punitivo-deterrente. Come banco di prova del principio di differenziazione nell’attuazione dei rimedi civilistici più ad ampio raggio, è affrontato anche il tema delle sanzioni civili in ipotesi di licenziamento ritorsivo-discriminatorio
Financing the Development of Technology Startups
In the modern knowledge society, technological entrepreneurship represents a potential engine for the socioeconomic development of regions and territories. Skilled human capital endowed with social attitudes and transversal skills, the open configuration of working environments, and the change attitude of individuals, organizations, and society today represent the complementary factors to the new technologies for the development of a modern entrepreneurial society. Moreover, there is a possibility of access to financial sources that public and private actors decide to reserve for supporting technology entrepreneurship. This constitutes the final element that closes the entire process. It thus allows transforming a smart and innovative idea into a successful company. In particular, it becomes crucial to provide a clear and valuable support to each phase of startup creation (e.g., ideation, validation, build, launch, growth, and maturity), with a specific focus on the financial sources that can be used to implement each phase. In such a perspective, this chapter provides an overview of the main instruments, processes, and actors that can support the development of an entrepreneurial idea and the growth of a startup during the different stages by describing exemplary cases and initiatives of 3Fs funds, public funding, business angels, crowdfunding, venture capital, initial public offerings, corporate venture capital, banks, incubators, and accelerators
Going Beyond Counting First Authors in Author Co-citation Analysis
The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation
counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed
Ultra-Low Power and Green TSCH-Based WSNs With Proactive Reduction of Idle Listening
Wireless sensor networks are characterized by low power consumption because motes are typically battery-powered. Time slotted channel hopping (TSCH) relies on a fixed transmission schedule, which enables the receiver module of wireless motes to be switched off every time it is not needed. Unfortunately, in many practical contexts most of the reserved slots remain unused, which leads to appreciable energy waste. For periodic traffic, proactive reduction of idle listening (PRIL) techniques have been proven able to mitigate this problem. In this paper, PRIL multi-hop (PRIL-M) is introduced with the aim to improve existing PRIL techniques, by lowering energy waste further in large real-world mesh networks. PRIL-M is advantageous in all those contexts where ultra-low power consumption is more important than end-to-end latency. Applications that can benefit from PRIL-M include, e.g., environmental monitoring, where sensors are deployed over the target area and must operate for years without maintenance. A thorough simulation campaign showed that, in these scenarios, energy consumption of PRIL-M is 75% less than standard TSCH, while the average latency is about 20 times larger
Variations on the Author
“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship
Appropriate Similarity Measures for Author Cocitation Analysis
We provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature. The use of equity crowdfunding to launch innovative ventures: insights from three cases
Crowdfunding is the process of collecting money from a large
audience to launch an entrepreneurial project. It is mostly based on the use of
internet to gather financial resources and leverage the ‘wisdom of crowds’ to
pre-validate the potential of a business idea. In particular, equity crowdfunding
allows broad groups of investors to fund new companies in return for
ownership of a piece of the business. It is thus an interesting option for
supporting the launch of innovative companies, although its adoption is still
limited by a number of complexities and an incomplete awareness of potential
benefits. In such vein, this paper delineates the status of equity crowdfunding in
Italy and presents the analysis of three successful equity crowdfunding
campaigns, with the purpose to collect a set of lessons learned and provide
useful insights for entrepreneurs and investors as well
Dispelling the Myths Behind First-author Citation Counts
We conducted a full-scale evaluative citation analysis study of scholars in the XML research field to explore just how different from each other author rankings resulting from different citation counting methods actually are, and to demonstrate the capability of emerging data and tools on the Web in supporting more realistic citation counting methods. Our results contest some common arguments for the continued
use of first-author citation counts in the evaluation of scholars, such as high correlations between author rankings by first-author citation counts and other citation
counting methods, and high costs of using more realistic citation counting methods that are not well-supported by the ISI databases. It is argued that increasingly available digital full text research papers make it possible for citation analysis studies to go beyond what the ISI databases have directly supported and to employ more
