Пересмотр судебных решений: гарантирует ли Украина право на справедливое судебное разбирательство в апелляционном порядке?
The right to appeal to the court of appeal instance and cassation instance was enshrined in the 1996 Constitution of Ukraine, which formed the basis for the creation of special courts of cassation in 2010, making the four-levels structure of judiciary review in Ukraine. At the same time, this did not help to solve the problem of the number of cases brought annually to the courts of cassation. Currently, we have a three-levels structure according to the provisions of amended Constitution 2016 and the reformed legislation, though, the same problem of overcrowded court of cassation despite the existing restrictions and the role of court of cassation exists. The main object of this article is the following question - does Ukraine develop the national system of appeal the judicial decisions, ensuring the right to a fair trial, given the citizens an access to justice and right to appeal to the court of higher instances, or not? We are trying to answer, using the methods of investigating the legal doctrine and generalizing the national judicial practice, as well as the case-law of the European court of Human Rights (ECtHR). In conclusion we found out the right answer on the question, chosen for our research, and proposed to regulate strictly the possible objects available for appeal by parties, according to the principle of rei judicata in line with the conception of a fair trial.Право на апеляцію до апеляційної інстанції та касаційної інстанції було закріплено Конституцією України 1996 р., Яка стала основою для створення спеціальних касаційних судів у 2010 році, що дозволило переглядати чотирирівневу структуру судової влади в Україні. У той же час це не допомогло вирішити проблему кількості справ, які щорічно передаються до касаційних судів. Наразі у нас є трирівнева структура відповідно до положень зміненої Конституції 2016 та реформованого законодавства, однак однакова проблема переповненого касаційного суду, незважаючи на існуючі обмеження та роль касаційної інстанції, існує. Основним об'єктом цієї статті є наступне питання - чи розвиває Україна національну систему оскарження судових рішень, забезпечуючи право на справедливий суд, надаючи громадянам доступ до правосуддя та право на апеляцію до суду вищих інстанцій, або ні? Ми намагаємось відповісти, використовуючи методи дослідження юридичної доктрини та узагальнення національної судової практики, а також судової практики Європейського суду з прав людини (ЄСПЛ). На закінчення ми з'ясували правильну відповідь на питання, обране для нашого дослідження, і запропонували чітко регулювати можливі об'єкти, доступні для оскарження сторонами, за принципом rei judicata відповідно до концепції справедливого судового розгляду
The path to the introduction of automated funds seizure in Ukraine: international experience and prospects for its implementation
CC BYThis article addresses the procedure of the automated seizure of a debtor’s funds in Ukraine in the process of enforcement of
judgements of all categories. Similar mechanisms provided for in European countries are also studied for the sake of comparison and with
a view to using the best international practices to improve Ukrainian law. One of the core drawbacks of the existing mechanism is
considered to be the lack of a consolidated register of individuals’ bank accounts. This hinders the effective detection of the debtor’s
account and may lead to the duplication of funds seizure whenever a person holds two or more accounts in different financial institutions.
The legal framework for the procedure is aimed at striking a balance between the interests of the creditors and the debtor. In this vein, there
are several ways to safeguard the debtor from disproportionate burden. According to existing rules, some of categories of income cannot
be seized. However, it might be more effective to set a minimum amount of funds that must be safe from seizure. The other flaw in the
operation of the system is the lack of instant communication between enforcement officers and banking institutions
MEDIATION IN THE EU: COMMON CHARACTERISTICS AND ADVANTAGES OVER LITIGATION
Mediation is an alternative extrajudicial procedure intended to resolve a dispute quickly and efficiently. One of the tasks of mediation is also to relieve the judicial system because disputes whose parties can find a compromise in their legal conflict can be successfully resolved without court involvement. Although many EU Member States have adopted specific legislation on mediation and the courts fully encourage the parties to resolve their disputes through extrajudicial procedures, mediation is still not widespread in the EU. This is largely due to the lack of structured information about mediation and its advantages over litigation. The purpose of this article is to present the main features of mediation in the EU and to highlight why mediation is more convenient, faster, more efficient, and more cost-effective. The advantages over litigation and the possibility of application in many disputes should contribute to the development of mediation which the European community strives to achieve
Going Beyond Counting First Authors in Author Co-citation Analysis
The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation
counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed
Variations on the Author
“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship
Appropriate Similarity Measures for Author Cocitation Analysis
We provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature. Dispelling the Myths Behind First-author Citation Counts
We conducted a full-scale evaluative citation analysis study of scholars in the XML research field to explore just how different from each other author rankings resulting from different citation counting methods actually are, and to demonstrate the capability of emerging data and tools on the Web in supporting more realistic citation counting methods. Our results contest some common arguments for the continued
use of first-author citation counts in the evaluation of scholars, such as high correlations between author rankings by first-author citation counts and other citation
counting methods, and high costs of using more realistic citation counting methods that are not well-supported by the ISI databases. It is argued that increasingly available digital full text research papers make it possible for citation analysis studies to go beyond what the ISI databases have directly supported and to employ more

We have done our best to complete the author checklist relating to the use of animals in the hut study. Note that the objective for the hut study was to evaluate the IRS treatment applications for residual efficacy against Anopheles mosquitoes, including the local An. coluzzii mosquito population. Cows were only used to attract mosquitoes into the huts and no tests were carried out directly on the cows. The author checklist is intended for use with studies where experiments are carried out on animals, which is why we have had such difficulty in completing this for the hut study, as many of the questions do not relate to how the cows were used
