CULTURAL APPROACHES IN CYBERPORN CRIME PREVENTION
Limitations of law in cyberporn law enforcement demands the need for non-penal approach as pre-ventive effort to eliminate causes of Cyberporn crimes. This approach includes crime prevention which aims to prevent a crime from being recurred. This approach can be implemented through situ-ational control by active involvement of cultural roles in community. However, it cannot be separat-ed from observing human life variations including childhood, youth, family, school, gender, peer group which play significant role during productive period. Those variations cane be taken as a theo-retical base for cyberporn crime prevention.Keywords: pornography, internet, crime prevention</jats:p
The Paradigm of Cyberporn On Legal Culture and Religion Perspective
Indonesia as the largest Muslim country should ideally have a society with good legal culture. Criminal offense or a violation related to cyberporn, does not need to happen. Cyberporn crime is not only a legal issue, but it is more complex. The weakness of the legislation, as well as the technological advances that are supported by the low legal awareness of society, it will difficult to tackle the cyberporn crime. The role of religion is needed as ethical teachings. Indonesia, which recognizes the principle of the Deity as its first principle, mean idealizing the condition of religious society. Awareness of the law will also be easily formed in communities that implement the teachings of their religion well, including public awareness for not accessing the cyberporn. : Indonesia sebagai Negara umat muslim terbesar idealnya memiliki masyarakat dengan budaya hukum yang baik. Tindak pidana atau bentuk pelanggaran yang berkaitan dengan cyberporn tidak perlu terjadi. Kejahatan cyberporn tidak hanya merupakan permasalahan hukum, tetapi lebih kompleks. Kelemahan peraturan perundang-undangan serta kemajuan teknologi yang didukung dengan kesadaran hukum masyarakat yang sangat rendah mengakibatkan akan sulit menanggulangi kejahatan cyberporn. Peran agama dibutuhkan sebagai sebuah ajaran etika. Indonesia yang mengakui sila Ketuhanan sebagai sila pertamanya, berarti mengidealkan kondisi masyarakat Indonesia yang religius. Kesadaran terhadap hukum pun juga akan mudah dibentuk dalam masyarakat yang mengamalkan ajaran agamanya dengan baik, termasuk kesadaran masyarakat untuk tidak mengakses cyberporn. Going Beyond Counting First Authors in Author Co-citation Analysis
The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation
counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed
Variations on the Author
“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship
KONSTITUSI DAN KEBIJAKAN PUBLIK: IMPLIKASI TERHADAP PENEGAKAN HUKUM DI INDONESIA
Konstitusi sebagai hukum dasar tertinggi di Indonesia mengatur hak-hak fundamental, struktur kelembagaan negara, dan prinsip-prinsip umum dalam pembuatan kebijakan publik. Di sisi lain, kebijakan publik merupakan instrumen pemerintah untuk menerjemahkan mandat konstitusional menjadi program-program konkret yang berdampak pada masyarakat. Artikel ini menganalisis hubungan antara konstitusi dan kebijakan publik serta implikasinya terhadap penegakan hukum di Indonesia. Fokus utama adalah bagaimana konstitusi membatasi dan mengarahkan kebijakan publik, serta peran lembaga negara dalam memastikan penegakan hukum yang adil sesuai dengan prinsip-prinsip konstitusional. Penelitian ini menggunakan pendekatan yuridis normatif dan empiris, dengan menganalisis kasus-kasus penegakan hukum yang dipengaruhi oleh kebijakan publik dan peran Mahkamah Konstitusi dalam meninjau konstitusionalitas kebijakan publik
Direction of Islamic Law Compilation Reform: Efforts to Codify Indonesian Islamic Family Law
This article examines the problems and new directions of the reform of the Compilation of Islamic Law (KHI) towards the codification of the Islamic Family Law Law. KHI nevertheless has problems, the absence of a formal legislative process and a textualistic fiqh approach make the norms in the KHI less responsive to issues such as justice, equality and the social dynamics of Indonesian Muslim society. This article aims to identify the normative and legal roots of the KHI, as well as the legal political strategies that can be used to transform it into an Islamic Family Law Act in the national legal system. This research is a literature study with a historical and doctrinal approach, using Mahfud MD legal political theory and Jasser Auda maqāṣid al-syari’ah. The first finding shows that the legal position of the KHI is weak because it does not have a legitimate legislative basis in the post-reform national legal system, and its substance reflects a patriarchal construction that is not in line with constitutional values. The second finding shows that the renewal requires a legal political strategy that is transformational, multidisciplinary and participatory, therefore that the resulting Islamic family law is not only legally-formally valid, owever also socially legitimate and substantively just.
Appropriate Similarity Measures for Author Cocitation Analysis
We provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature. Dispelling the Myths Behind First-author Citation Counts
We conducted a full-scale evaluative citation analysis study of scholars in the XML research field to explore just how different from each other author rankings resulting from different citation counting methods actually are, and to demonstrate the capability of emerging data and tools on the Web in supporting more realistic citation counting methods. Our results contest some common arguments for the continued
use of first-author citation counts in the evaluation of scholars, such as high correlations between author rankings by first-author citation counts and other citation
counting methods, and high costs of using more realistic citation counting methods that are not well-supported by the ISI databases.
