Cross-linguistic approaches and applications to phraseology in legal and institutional discourse
The collection of articles in this book presents some of the latest developments in the study of the phenomenon of phraseology in legal and institutional discourse. These contributions come from two main sources: selected papers from a workshop devoted to Corpus Approaches to Legal Phraseology organised by the editors of this volume during the XX European Symposium on Languages for Special Purposes held in Vienna in July 2015 and some recent invited contributions to the topic made by both renowned linguists and young promising researchers. This book is an attempt to continue, update and extend different avenues of research signalled in our earlier edited publication of a special issue Legal Phraseology Today. A Corpus- Based View in Fachsprache: The International Journal of Specialised Communication, in 2015. Much of the ground covered in the next two sections has already been explored in the introduction to that special issue (Gozdz- Roszkowski and Pontrandolfo 2015)
The present paper stems from a contrastive corpus-based study of phraseology in Spanish, Italian and English criminal judgments (Pontrandolfo 2013). By exploring the Corpus of Criminal Judgments (COSPE), a large comparable trilingual corpus (Spanish, Italian, English) of approximately 6 million words, the present paper aims at investigating the close relationship among specialised discourse, discourse markers and translation.
The focus of the study is on special particles which play a pivotal role in judicial texts: “contrargumentative markers” (Portolés 1998, Montolío 2001) or “antioriented argumentative markers” (Escandell 2013), which, following Rudolph (1996) have been labeled “argumentative markers of contrast”.
The primary objective of the paper is to carry out a quantitative analysis of the distribution of this type of discourse markers in COSPE, as well as a qualitative analysis aimed at characterising the markers uses in COSPE and identifying trends of use in judicial discourse. The secondary objective, which nevertheless guides the whole study, is to carry out a legal translation-oriented analysis. Indeed, studying discourse markers is a necessary precondition for translators, since the semantic and pragmatic relations conveyed by these particles and their distributional differences represent the guidelines for the selection of adequate translation solutions (cf. Visconti 2000, Garofalo 2006).
From a methodological point of view, the study combines a qualitative approach oriented at the discourse genre (cf. Bhatia 1993, Garofalo 2009) with a more qualiquantitative approach based on corpus linguistics, more specifi cally on corpus-assisted discourse studies (Partington 2004, Partington et al. 2013)

Sensibly and appropriately the judge considered...A corpus-based study of sentence adverbs in judicial language
The paper presents a contrastive corpus-assisted discourse study of sentence adverbs in Italian, English and Spanish judicial discourse. The hypothesis guiding the study is that, although judges’ attitude is supposed to be impartial, as they represent the so-called “bouche de la loi”, their opinion is present in the texts and sentence adverbs are one of the pragmatic vehicles used to express their stance. The corpus used for the analysis is a trilingual subcorpus of COSPE (Pontrandolfo 2016) that has been POS-tagged (194,000 tokens for each language). The focus has then been placed exclusively on adverbs ending in -mente and -ly for being those that more than others contribute to express evaluative nuances in judicial discourse. Results demonstrate that quantitatively adverbs in -mente/-ly do not account for a significant percentage, which is in line with Biber et al.’s (1999) findings in other registers (conversation, academic prose). However, qualitatively and discursively, these adverbs play a pivotal role at a pragmatic level, since they contribute to judicial argumentation (cf., among others, Mazzi 2014)
