New technologies in the workplace: impacts on labour law
In a very deconstructive labour law scenario that we are facing now (globalization of supply
chains, fissuring of work, spread of platform providers, individualisation and de-unionisation,
decentralisation of collective agreement, ecc.), how could workers’ rights be protected during the
digital age? Is it better to dismantle the standard employment contract and construct in its place a
broader foundation of economic security for all as somebody proposed, or is it better to move
with great precaution towards an updating of concepts and definitions, keeping in force the actual
system of protection with some limited revisions? The answer argued by the Author is in favour
of the second choice
The essay, through a reconstruction of the legislative framework and the guidelines outlined by jurisprudence and by European and national data protection Authorities, examines the principles contained in GDPR and applicable in setting and managing the working relationship. The Author notices how the working relationship makes always more use of computer tools which allow, directly or indirectly, the employee activities to be monitored. Thus, the compromise between opposite interests (privacy protection and corporate assets protection) can be guaranteed through a privacy compliance enhancement within the company policies, with the intent of preventing or at least reducing any kind of illicit data processing

Automation in HRM: the European legal framework
Artificially intelligent (AI) systems are being used more and more in the area of human resource management (HRM). The algorithmic management environment should be regulated and oriented in a human-centered approach, given that ethics-based auditing is not enough to preserve this effective balance; but AI tools should not be banned or un-duly restricted in the area of HRM to avoid the adverse effect of business es-caping from legal rules and constraints, vanishing all the efforts done for a guided evolution of AI
