Possibilità, opportunità e rischi del finanziamento privato alla cultura. Alcuni esempi dal modello italiano e inglese
In un contesto nel quale il finanziamento statale nei confronti delle
istituzioni culturali diminuisce o rimane statico, queste ultime sono
soggette a pressioni sempre maggiori nell’attrarre fondi provenienti
dal settore privato. Ma il sovvenzionamento dei privati alle istituzioni
culturali pubbliche se da un lato rappresenta una necessità, porta
anche con sé dei rischi legati alla natura dei proventi e dei soggetti
che li detengono. Tale situazione ha determinato, in alcuni contesti,
l’insorgere di proteste di ordine etico e politico, ponendo le istituzioni
culturali e gli attori pubblici davanti a questioni di opportunità
sempre più pressanti.
L’articolo analizza quali sono le regole che, in Italia e in Inghilterra,
determinano la possibilità per i musei nazionali di accettare sponsorship
da soggetti privati o per permettere l’uso di riproduzioni
digitali dei beni culturali custoditi nelle collezioni statali. Attraverso
la disamina di alcuni casi controversi ed emblematici del rapporto
tra pubblico e privato nella gestione delle istituzioni culturali vengono
messe in evidenza le scelte e gli strumenti che i musei nazionali,
le istituzioni e i governi centrali hanno adottato per fronteggiare
tali situazioni
Translating the concept of “cultural identity” in public policies: Between the international and the national, and the tangible and intangible dimension.
A concept such as that of “cultural identity” seems primarily belonging to the historic-artistic domain, but understanding its meaning is also fundamental for legal scholars dealing with cultural heritage policies and administration. This article examines how that notion has been shaped by legislators at different levels, revealing specific meanings depending on whether we are dealing with international conventions or national norms, and with tangible or intangible cultural heritage. The comparison of international conventions and national legislation highlights the clash between different orientations in the cultural heritage sector, namely between nationalists and internationalists. From a regulatory perspective, this clash of interests is reflected in the opposing concepts of “common heritage of mankind” and “national cultural identity,” whose legal implications need to be addressed. These two definitions are examined and challenged in an effort to understand whether they still have a legal meaning or if they have been replaced by a “global” notion of cultural identity. From a more general perspective, through an analysis of three case studies, the article reveals the role played by legal traditions when the same matter is regulated both by national and international legislative interventions enacted in different time periods

The article analyses the Italian regulation that allows for the dation in payment of cultural property with regard to direct and inheritance taxes. In particular, it describes the historical evolution of the existing legislation, the applicable rules, their modus operandi, and it pieces together their implementation over the years. Finally, a comparison to the French system is instrumental to a better understanding of strengths and weaknesses of the Italian one

Questo scritto analizza la riorganizzazione del Ministero per i beni e le attività culturali e per il turismo entrata in vigore nel febbraio 2020 proponendo un confronto con i precedenti regolamenti del 2014 e del 2019. Si tenterà di comprendere in che modo le tre riorganizzazioni susseguitesi nell'arco di cinque anni siano intervenute sulle funzioni amministrative di tutela e valorizzazione del patrimonio culturale e ambientale. Tale contributo, inoltre, intende effettuare un confronto tra l'attuale organizzazione del MiBACT e quella predisposta per lo stesso Ministero al momento della sua prima configurazione nel 1975

This article intends to analyse the topic of art export controls putting into relation national and supranational legislation. After having illustrated the main goal and objective that each legislator aims to achieve by implementing this administrative function (while national legislation pursues the objective of preserving and constituting the national cultural heritage, the supranational one is aimed at preventing phenomena of illicit trafficking), the analysis addresses their comparison. More specifically, we try to highlight how much these two legislative levels are linked one to the other, while they are often presented as distinctly separate. In addition to this aspect, the article underlines the necessity for national and supranational legislators to implement effective administrative tools and soft power mechanisms in controlling the export of cultural property, while contrasting their illicit circulation. Ensuring the proper functioning of the administrative system, in fact, can often prove more important than intervening in the matter with new regulations or legislative reforms
