    Governmental predominance in Italian law-making: undemocratic or illiberal?

    Italy has experienced different kinds of involution of parliamentary democracy and the legislative output over the course of the past couple of decades. Following the ‘Berlusconi-era’ (1994–2011) two major issues have dominated the evolution of Italian politics: technocratic governments (predominantly that of Monti in 2011–2013) and the recent emergence of populist parties (e.g. the Five Star Movement, the League). Despite the apparent opposition of these phenomena, they do share many commonalities with regard to their approaches to the legislative process. They both fostered an acceleration of established in Italian law-making, which also become more apparent in the last decade. The constraints provided for by the 1948 Constitution (including the Head of State and the independent and powerful Constitutional Court) had so far limited impact on these problematic trends

    The essay advocates in favour of qualifying the nature of the pending constitutional amendment to the Italian Constitution as a (text for a) "constitutional law" instead of a "constitutional revision law" on the basis of the rules concerning the formulation of the question to appear on the ballot for the constitutional referendum. With the occasion of replying to a previous essay by Paolo Carnevale, who proposed the opposite interpretation, the essay recalls the way of approving titles of ordinary and constitutional law and their role in unambiguously identifying the act

    Prospettive di organizzazione del "nuovo" Senato

    Il testo di legge costituzionale approvato dalle Camere lo scorso 12 aprile lascia aperte molte incognite sul ruolo del Senato nel sistema costituzionale e sui suoi meccanismi interni di funzionamento. Tuttavia, accanto alle diverse possibili evoluzioni dell’interpretazione del testo e del suo completamento in sede attuativa, esistono una serie di “punti fermi” rispetto ai quali è possibile ragionare delle prospettive di organizzazione interna del Senato. Ne risulta un quadro di bassa innovazione nei meccanismi di funzionamento che sembrano condurre a dinamiche decisionali interne al nuovo Senato non dissimili da quelle di una Camera pienamente “politica”, rivelando che la “rappresentanza delle istituzioni territoriali" – pur proclamata all’art. 55, quinto comma, Cost. – resti alquanto difficile da praticare in concreto. The pending constitutional amendment passed by the Parliament on 12 April 2016 leaves many open questions related to the role of the Senate in the constitutional system as well as to its internal functioning. However, beyond the possible divergent interpretations of some of its clauses and the possible solutions at the implementation stage, there are some fundamental points that can be assumed as the framework around which elaborating on the prospects of the organisation of the Senate. The result of the analysis is that the innovation in the internal mechanisms of the Senate is quite poor, so that its functioning cannot be too dissimilar from that of a fully political assembly. Thus, the “representation of territorial institutions” although proclaimed at art. 55.5 of the Constitution seems difficult to be pursued in concrete
