The role of the accused in English and Islamic criminal justice

    No full text
This thesis is a comparative study of the role of the accused in the systems of English and Islamic criminal justice. It seeks to explore the underlying relationship between the individual and the state through an historical, structural and contextual analysis of their rules relating to questioning and of confessions. The analysis of the English system covers the period 1800 to 1984, with particular reference to developments during the nineteenth century when the foundations for the modern English state were established. The analysis of the Islamic system combines traditionally Islamic and modern methods, assessing the "Islamisation" movement in Malaysia through a religico-structural understanding of juristic opinion from the four main schools of Sunnite jurisprudence. The thesis contributes to existing knowledge on a number of levels: first, it questions and revises the "myth" of "progress" that has dominated observations of the history of the English criminal justice system; second, it elucidates the relationship between Islamic law in theory and the law that is applied and proposed in its name in Muslim states; third, it provides an analytical framework for drawing comparisons between the underlying values of the systems of English and Islamic criminal justice. While acknowledging fundamental differences in terms of outlook and articulation, the author concludes there are important similarities expressed through such notions as "suspect" in the English system and "kafir"I"fasiq" in the Islamic. These act as intermediate constitutional categories to whom the state owe less protection. But the author notes also that these similarities are not observed necessarily in the "law" which is implemented or proposed in Muslim states; exact correspondence depends upon the over-arching political structure and the institution of Caliphate. The thesis is divided into six chapters: chapter one sets out the conventional view of the historical development of English criminal procedure and evidence; chapter two subjects that to a critique and chapter three offers a revised thesis. Chapter four, explores methods for interpreting and explaining Islam; chapter five sets out rules relating to confessions and questioning according to the four Sunni schools; chapter six puts them into "context" through an examination of the "Islamisation" process in Malaysia

Pak Kaduk (PK) is a prominent character in folk literature, particularly humorous stories, characterized by their comedic elements. These narratives frequently possess a profound impact on audiences, as they draw upon the experiences of traditional Malay communities. The primary intent behind crafting such humorous tales lies in providing entertainment, critiquing societal norms, and imparting moral lessons to readers. Thus, this study endeavours to dissect Pak Kaduk's narrative style, focusing specifically on his use of colour and emotion. This qualitative investigation employs document analysis as its primary methodology, based on the reputable framework of Relevance Theory (Sperber & Wilson, 1986; 1995). The research data was obtained from two significant works, namely 'Lukisan Zaman' by Shari (1991) and 'Collection of 336 Malaysian Folktales' by Puteh and Said (2008). The findings reveal that the author uses cape flowers and colours as symbols of diversity, which encapsulates Pak Kaduks myriad emotions. The plethora of colours available in cape flowers serves to emphasize the notion of diversity, with each hue representing distinct emotional states. Notably, white, and yellow signify positivity, while red and black connote negativity. This study not only sheds light on Pak Kaduks storytelling techniques, but also provides insights into the societal critiques embedded within these narratives. It also shows how important it is to acknowledge and interpret the nuanced relationship between colour and emotion in folk literature

Abstract This paper presents a novel design for a four-port transmitter antenna circuit tailored for an ambient backscatter communication system (ABCS) operating at 433 MHz, aimed at enhancing human activity recognition (HAR) in healthcare monitoring applications. The proposed system captures the ability of the ABCS to utilize ambient radio frequency (RF) signals, such as those from Wi-Fi, to transmit data without the need for active RF sources. This feature is particularly advantageous in low-power, data-intensive environments. The paper introduces the development of the ABCS framework, comprising a four-port antenna circuit and a Nooelec NESDR Mini USB RTL-SDR receiver, to accurately detect eight specific human activities, including new healthcare monitoring activities like “standing while dizzy,” “standing and suddenly collapsing,” and “sitting while shaking.” The experiment was conducted with five participants performing eight activities, and the results demonstrated distinct signal patterns corresponding to each activity. The findings show that the proposed system is a promising solution for the real-time, non-intrusive monitoring of human activities, which is crucial for early detection and intervention in healthcare scenarios.Abstract This paper presents a novel design for a four-port transmitter antenna circuit tailored for an ambient backscatter communication system (ABCS) operating at 433 MHz, aimed at enhancing human activity recognition (HAR) in healthcare monitoring applications. Abstract In response to the challenges posed by the recent pandemic on traditional farming in Malaysia, this paper proposes DuWIMS, an innovative smart irrigation system that integrates a modern web interface with an IoT-based system. Utilizing an array of sensors for real-time data collection, the system enhances irrigation efficiency through a dual-mode operation: manual remote control and automated irrigation via a fuzzy logic model. This system, tested on a durian farm in Kedah, Malaysia, significantly reduced irrigation time from two hours to approximately 50 minutes for 65 trees and decreased water usage by about 25%. Furthermore, durian trees irrigated with this system exhibited improved growth compared to those under traditional irrigation methods. Operational efficiency was bolstered with remote irrigation control and reliable performance, as evidenced by no system downtime over a three-month period. The deployment of the fuzzy logic model on a cloud server, serving as a backend API, also proved cost-effective by negating the need for on-site computing units. These findings underscore the potential of DuWIMS to revolutionize agricultural practices, particularly in challenging times, by optimizing resource usage and promoting sustainable farming.Abstract In response to the challenges posed by the recent pandemic on traditional farming in Malaysia, this paper proposes DuWIMS, an innovative smart irrigation system that integrates a modern web interface with an IoT-based system.
