    Legal Issues in the COVID-19 Pandemic

    The legal issues arising from the COVID-19 outbreak are mostly unexperienced, with several fields of law involved—from human rights to market regulation—all with consequences that need to be further scrutinized. In their chapters, Aldo Schiavello and Guido Smorto investigate two, complementary, legal questions connected with the current pandemic. In his contribution on “Rights, balancing and certainty,” Aldo Schiavello analyzes the legal measures taken by Italian public authorities to contrast the virus, by focusing on indeterminacy as one of the main characteristics of the law in contemporary constitutional States. According to the author, the ways in which the legislator, at different levels, faces the COVID-19 current pandemic offer an interesting perspective to analyze the positive and negative effects produced by the indeterminacy of contemporary law. In doing this, the chapter ponders on the challenges to the objectualist conceptions of law that reduce law to a system of norms or a set of facts, and on those conceptions that regard the law as an interpretative social practice. Legal systems’ constitutionalization, as the chapter argues, increases legal flexibility at the expense of legal certainty, and it imposes to legislators, judges and individuals the responsibility and the associated risks of individuating the law. In the second article of the section titled “The right to health and resource allocation. Who gets what and why in the COVID-19 pandemic,” Guido Smorto reflects on the right to health and resource allocation during the pandemic. As the COVID-19 outbreak has led to a worldwide, substantial increase in the demand for resources that are essential to deliver health care—pharmaceuticals, hospital beds, ventilators, medical supplies—the article scrutinizes the rationales for prioritization of these resources in times of severe shortage, such as during a global pandemic. When needs suddenly exceed demand worldwide, resources may quickly become scarce in relation to potential demand, so that strict rationing is the only viable response. Against this backdrop, the paper scrutinizes the rationales for prioritization of scarce resources, with a special focus on the COVID-19 vaccine, and it questions the actual role and reach of the market with regard to resources that are essential to deliver health care, especially in times of severe shortage, such as during a global pandemic

    Schwartz e colleghi (2012) hanno recentemente proposto un aggiornamento della teoria dei valori, sviluppata dallo stesso autore alla fine degli anni ottanta (Schwartz e Bilsky, 1987; Schwartz, 1992). Gli autori hanno frazionato il continuum motivazionale in 19 dimensioni, molte delle quali rappresentano dei sottotipi dei 10 valori proposti originariamente. Il presente studio si propone di fornire un contributo alla validazione italiana del Portrait Values Questionnaire-Revised (PVQ-R), lo strumento sviluppato da Schwartz e colleghi (2012) per la misura dei 19 valori. Sono state esaminate le proprietà psicometriche del PVQ-R, con particolare riferimento alla possibilità di discriminare i 19 valori e alla coerenza interna delle dimensioni. È stata inoltre esaminata la posizione relativa dei 19 valori lungo il continuum motivazionale. Hanno partecipato alla ricerca 713 soggetti (43% femmine), con un’età media di 26.5 (DS = 13.6). I risultati evidenziano che i 19 valori sono distinguibili empiricamente, e che i vari sottotipi sono riconducibili ai 10 valori di base del modello originale. La maggior parte delle dimensioni presenta indici di coerenza interna buoni o accettabili. I 19 valori si collocano nella posizione attesa, con scostamenti minimi rispetto al modello teorico. Sono infine discusse le potenziali applicazioni dello strumento alla ricerca sui valoriSchwartz and colleagues (2012) have recently proposed a refinement of value theory, developed by the same author at end of the eighties (Schwartz & Bilsky, 1987; Schwartz, 1992). The authors partitioned the motivational continuum into 19 dimensions, most of which represent subtypes of the 10 original values. The present study aims to validate an Italian version of the Portrait Values Questionnaire-Revised (PVQR), the instrument proposed by Schwartz and colleagues (2012) for the assessment of the 19 refined values. The psychometric properties of the PVQ-R have been assessed, focusing on the possibility to discriminate the 19 values and the internal consistency of the scales. Moreover, the locations of the 19 values around the circular motivational continuum have been examined. Seven hundred and thirteen respondents (43% females), with a mean age of 26.5 (SD = 13.6), participated in the study. Results showed that the 19 values can be distinguished empirically. Moreover, they can be combined into the 10 values of the original theory. Most scales have good or acceptable levels of internal consistency.     The European Charter for Sustainable Tourism (ECST) in Protected Areas is a voluntary management tool and certification that enables protected areas to develop sustainable tourism for the benefit of the environment, local populations, businesses, and visitors. The EUROPARC Federation, of which Federparchi has been the Italian section since 2008, issues the internationally recognized Charter. The entire process is participative and integrated through a strategic approach that includes defining the strategic objectives to be pursued through an Action Plan, allocating the necessary resources, and monitoring the results achieved. This contribution aims to propose a critical analysis of the documentation produced by the managers of the Torre del Cerrano Marine Protected Areas (in Italy) following the process implemented during the months when the Charter was renewed (between autumn 2018 and spring 2019) and contained in the Strategy and Action Plan document.     The essay aims to clarify whether the Italian juridical-institutional tools available are adequate to solve the problems raised by the Covid-19 pandemic. According to the author, the pandemic has not brought about, and does not require, significant changes in the legal system, essentially more virtuous civil and political behaviour being necessary. The thesis is illustrated by analyzing four profiles: compliance with the Constitution and the constitutional framework of some administrative sources and measures to manage the pandemic emergency caused by Covid-19; the relationship between scientific knowledge and public decision making; the relationship between the State, Regions and local territorial bodies; the delineation of a new boundary between public and private action, which increasingly favors the latter, through the liberalization and/or simplification of administrative powers

The infection can be life threatening and require intensive care treatment. The transmission of the disease poses a risk to both patients and healthcare workers. The number of patients requiring hospital admission and intensive care may overwhelm health systems and negatively affect standard care for patients presenting with conditions needing emergency interventions. This position statements aims to assist cardiologists in the invasive management of acute coronary syndrome (ACS) patients in the context of the COVID-19 pandemic. To that end, we assembled a panel of interventional cardiologists and acute cardiac care specialists appointed by the European Association of Percutaneous Cardiovascular Interventions (EAPCI) and from the Acute Cardiovascular Care Association (ACVC) and included the experience from the first and worst affected areas in Europe. Modified diagnostic and treatment algorithms are proposed to adapt evidence-based protocols for this unprecedented challenge. Various clinical scenarios, as well as management algorithms for patients with a diagnosed or suspected COVID-19 infection, presenting with ST- and non-ST-segment elevation ACS are described. In addition, we address the need for re-organization of ACS networks, with redistribution of hub and spoke hospitals, as well as for in-hospital reorganization of emergency rooms and cardiac units, with examples coming from multiple European countries. Furthermore, we provide a guidance to reorganization of catheterization laboratories and, importantly, measures for protection of healthcare providers involved with invasive procedures

    A microstructure-based elastoplastic model to describe the behaviour of a compacted clayey silt in isotropic and triaxial compression

    The paper focuses on the hydro-mechanical behaviour of an unsaturated compacted clayey silt, accounting for fabric changes induced by drying-wetting cycles occurring at low-stress levels. The response along isotropic compression and triaxial compression (shear) at constant water content was investigated by laboratory tests on both as compacted and dried-wetted samples. Compaction induces a micro-structural porosity pertinent to clay peds and a macro-structural porosity external to the peds. Drying-wetting cycles decrease the micro-porosity and increase the macro-porosity, which reduces the water retention capacity, increases the compressibility and promotes higher peak strengths with more brittle behaviour during triaxial compression. A coupled double porosity elastic-plastic model was formulated to simulate the experimental results. A non-associated flow rule was defined for the macrostructure, modifying a stress-dilatancy relationship for saturated granular soils to account for the increase in dilatancy with suction observed in the experiments. The average skeleton stress and suction were adopted as stress variables. Consistently with model predictions, the shear strength at critical state is not significantly influenced by the degree of saturation or by the hydraulic history. On the other contrary, the higher peak strength, brittleness and dilatancy of the dried wetted samples are mostly explained by their reduced water retention capacity
