Le Corti regionali tra Stati e diritti. I sistemi di protezione dei diritti fondamentali europeo, americano e africano a confronto
No full textI tre sistemi regionali di protezione dei diritti umani, europeo, americano ed africano, rappresentano, al contempo, una progressiva trascrizione della Dichiarazione Universale dei diritti dell’uomo del 1948 ed una risposta al problema dell’applicazione concreta dei diritti sulla base della prossimità territoriale tra Stati che condividono una medesima area geopolitica. Tale processo ha raggiunto un alto grado di maturità solamente nel sistema europeo; il sistema inter-americano risulta in fase di sviluppo; mentre il sistema africano, per la sua più recente affermazione, è chiaramente in una fase che si può definire embrionale. Cionondimeno il framework giuridico, le strutture istituzionali e il diritto sostanziale si presentano sotto molti profili omogenei. Al fine di mettere in evidenza differenze e similitudini tra i tre sistemi regionali, il volume propone una loro trattazione separata, muovendo dall’analisi della declinazione del diritto alla vita. La vita, diritto a fondamento di tutti gli altri diritti, diventa un prisma attraverso cui analizzare l’evoluzione di ciascuno dei tre sistemi, consentendo agli autori di interrogarsi ancora sul rapporto tra universalità e tradizioni culturali. L’idea di uomo che scaturisce dalla lettura delle norme convenzionali, e dall’interpretazione fornitane dalle Corti regionali, mette alla prova sia l’aspirazione ad un nucleo condiviso di tutela, sulla scia della Dichiarazione Universale, sia la ricerca delle specificità regionali. Infine, Attraverso l’analisi dei meccanismi di enformcement diretto ed indiretto presenti nei tre sistemi di tutela viene indagato il rapporto tra ordinamenti nazionali e Corti sovranazionali, per metterne in evidenza i successi e le tensioni interne ai tre modelli

No full textCommento all'Articolo 26, Sviluppo progressivo, della Convenzione americana dei diritti umani. Il terzo Capitolo della Convenzione, nonostante l’ambizioso titolo «Diritti economici, sociali e culturali», è composto dalla sola disposizione dell’art. 26 in materia di “sviluppo progressivo”. Letteralmente la fattispecie contiene molti principi e garanzie, rivolti agli Stati parte e finalizzati a favorire, per mezzo degli ordinamenti nazionali, lo sviluppo e la piena realizzazione dei diritti economici, sociali, scientifici e culturali. A prima vista un fine assai ambizioso ed eterogeneo, ma che a ben vedere accoglie una nozione in linea con la tradizione europea di sviluppo, legata al benessere e al miglioramento complessivo della vita dei singoli. L'articolo analizza tale disposizione alla luce delle decisioni della Commissione e della Corte, proponendo anche una comparazione con l'esperienza europea
Going Beyond Counting First Authors in Author Co-citation Analysis

counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed

Prisoners’ Voting Rights and the Long-Lasting Political Resistance to the Implementation of the European Court of Human Rights’ Judgments
No full textIn 2005 the ECtHR ruled that the UK was in breach of Art. 3 of Protocol 1 (Hirst v. The United Kingdom (no. 2)) because of the blanket ban on prisoners’ voting (established in Section 3 of the Representation of the People Act 1983). The issue remained unresolved for over a decade. What could seem a simple matter of executing one of the not-so-many judgments against the UK, simply by making appropriate amendments to the domestic legislation, turned into a real “political war” over the proper allocation of competences between the ECtHR and the UK.
The contribution looks at the period of time 2005–2018, analysing the political and jurisprudential debate played both at national and conventional levels, until the moment when the “war” between the ECtHR and the UK has (quietly) come to an end. The paper looks closely at the Government proposals in order to demonstrate that the administrative measures (accepted by the CoE) fail to respond adequately to the 2005 judgment (and to other clone cases). At the end, the UK has won the war because it has minimised the political and the material costs of compliance
Variations on the Author
Get PDF“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship
Appropriate Similarity Measures for Author Cocitation Analysis
Get PDFWe provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature. Dispelling the Myths Behind First-author Citation Counts
