    La proportio quale trait d’union tra continuum e discretum nel diritto

    Al fine di trarre in luce le ricadute profonde della rivoluzione digitale sul modo di comprendere e attuare il diritto, il saggio analizza la distinzione tra analogico e digitale partendo da quella tra continuum e del discretum. Rilevata l’impossibilità di dissolvere il continuum nel discretum ed insieme la necessità di non dissociarli, lo scritto riprende la definizione del diritto data da Dante, imperniata sulla nozione di proportio, rilevandone lo stretto legame con l’analogia sia in accezione filosofica che matematica. In chiusura si abbozza un’applicazione della proportio nel campo giuridico, prendendola come filtri categoriale del famoso giudizio di Re Salomone.The proportio as trait d’union between Continuum and Discretum in Law Aiming to shed light on the profound effects of the digital revolution on the way of understanding and implementing law, the essay analyses the distinguishing between analogue and digital starting from the distinction between continuum and discretum. After ascertaining the impossibility of dissolving the continuum in the discretum and at the same time the impossibility of dissociating the two, the essay takes up Dante's definition of law, centred on the notion of proportio, noting its close link with analogy in both philosophical and mathematical terms. Finally, an application of proportio in the legal field is sketched out, taking it as a categorial filter of King Solomon's famous sentence

    Il ricostruisce per sommi capi gli interventi tenuti da Giorgio La Pira, Palmiro Togliatti e Benedetto Croce all’Assemblea costituente l’11 marzo 1947 in relazione al Progetto di Costituzione repubblicana. I loro interventi, esponenti di punta delle culture cattolica, marxista e laico liberale, muovono da tradizioni culturali e politiche diverse, quella metafisica ma non astorica di La Pira, quella storicistica e prevalentemente politica di Togliatti, quella più critica e preoccupata di Croce, che rivendica il ruolo storico del liberalismo nel costruire l’unità d’Italia, ma convergono nella ricerca delle condizioni di una vera pace sociale e religiosa nel quadro di una autentica democrazia fondata sulla sovranità del popolo

Terr’s (1981) studies helped to describe this behavioral distortion as post-traumatic child’s play (PTCP). This study aimed to evaluate whether child victims of Adverse Childhood Experiences (ACEs) engaging in semi-structured play present the markers of post-traumatic child’s play (PTCP) during the administration of the Manchester Child Attachment Story Task (MCAST), whose playful stories activate the attachment system. Methods: The sample comprised 17 child victims of ACEs (mean age = 6.76). Children were evaluated using the Manchester Child Attachment Story Task. Results: The analysis of the play clearly revealed the presence of markers associated with the characteristics of the post-traumatic play described by Terr (1981), namely, repetition, revisiting, hyperarousal, and danger. In particular, the intrusiveness dimension was observed, which can be identified in the post-traumatic play by the presence of recurrent memories, dreams, and dissociative symptoms.     L’autore analizza il rapporto tra il diritto e la morale nel contesto della ricerca sull’essenza del diritto. Partendo da alcune considerazioni introduttive, si individuano una dicoltà di fondo ed alcune linee tematiche. L’autore procede con l’analisi del diritto sul piano discorsivo per poi ampliare l’analisi focalizzando i concetti di forma, nalità e controversia. Nella parte nale del lavoro, egli presenta una ricerca del diritto come la ipsa res iusta riportandola sul piano epistemico nel quadro del senso classico della dialettica.The author analyzes the relationship between right and morality in the context of the research on the essence of right. Starting form certain introductory considerations, he identies a foundational problem and then delineates from it some thematic lines of argument. He proceeds with the analysis of right on a discoursive plain before turning to extend his research along the focal points of the form, nality and controversy. In the nal part of the paper, he presents a line of research of the right as the ipsa res iusta by imerging this conception in the classical meaning of dialectics on an epistemological plain

    Lithasia spicula sp. nov. Sharp­tongued Rocksnail Type Designations and Locality: Holotype NCSM 26807, Harpeth River, Highway 100 bridge, near Bellevue, Davidson County, Tennessee, U.S.A., 36 º 03' 17 " N, 86 º 55 ' 43 " W. Paratypes NCSM P 4678, UAG 405. Etymology: From Latin spiculum, a sharp point, referring to the pointed cusps on the lateral teeth. Diagnosis: A species of Lithasia endemic to the Harpeth River in shoals under and immediately downstream of the Highway 100 bridge near Bellevue, Davidson County, Tennessee. The snail differs from other Leptoxis by having a shell morphology most like Li. armigera, from Lithasia by having three to four large, rounded denticles on the marginals, and from eastern North American pleurocerids by having pointed, triangular cusps on the lateral teeth. Description: Shell to 35 mm long with 4­5 whorls, ovately conic, green­brown, with lateral brown­purple bands (Figure 3 C). Sutures slightly impressed. Body whorl smooth, or with single row of small to well­developed tubercles; preceding whorls smooth or beaded in appearance near the suture. Aperture one­half shell length, fusiform, with a slight anterior channel. Posterior and anterior calluses on the columella absent. Radula rachidian wider than high, with nine pointed cusps, central cusp longest and broadest. Laterals with five to seven pointed cusps, central cusp longest and broadest. Outer marginals with three to four evenly sized, rounded denticles; inner marginals with eight to twelve evenly sized, blunt denticles. Habitat and Distribution: The species is restricted to the shoals under and immediately downstream of the Highway 100 bridge. Individuals occur sympatrically with Le. praerosa on algae covered rocks and the gravel riverbed. No Lithasia have been found up to 100 m upstream of the bridge, and Li. spicula is replaced by Li. armigera further downstream. Material Examined: Tennessee (all in Harpeth River): UMMZ 133988. Remarks: This species is tentatively placed in Lithasia based on conchological features. While data suggest it is not a Lithasia, it will most likely be identified as such in the field, and keeping it in Lithasia will allow future researchers and agencies to collect specimens accurately. Additional data is needed to determine the true generic placement of this unique pleurocerid. It was thought that this population may be an example of an old, persistent, highly divergent haplotype of Li. armigera. Similar examples have been seen in Asian freshwater snails (D. O’ Foighil pers. comm.) and proposed in North American Elimia (Dillon and Frankis 2004), where rare, highly divergent haplotypes randomly appear at low frequencies in populations and form clades away from their cohorts.     Analisi di 17 perizie psichiatriche di donne ree di figlicidio, reati compiuti tra il 2000 e il 2003 in tutta Italia: 1) che tipo di relazione con il partner queste donne dichiarassero di avere prima di compiere il delitto; 2) se il movente potesse essere legato a disturbi psichiatrici, a maltrattamenti/abusi, alla sindrome di Medea, alla conflittualità coniugale; 3) se il comportamento prima del reato avesse a che fare con comportamenti violenti con i figli, di liti con il coniuge, di abuso di alcool e/o psicofarmaci. I risultati ci dicono che: La maggior parte dei soggetti del campione esaminato: - ha affermato di avere una rapporto con il proprio partner negativo e tendente al patologico; -presentava svariati disturbi psichiatrici; - viveva in contesti violenti, connotati da maltrattamenti/abusi subiti dal partner; -aveva vissuti infantile di violenze e riproponeva questi modelli, sovente, con i propri figli

    Il diritto tra i numeri, riprendendo l’analisi del sapere giuridico svolta dall’Autore in Diritto ed episteme, si appoggia sulla valenza del numero come guida epistemica per ricostruirne alcune parti dell’arco categoriale, che ne rende possibile l’elaborazione e sensati i suoi risultati sia teorici che operativi. La Parte prima è dedicata all’analisi della complessità del diritto nella sua concretezza e segue il filo euristico ed isomorfico dei vettori complessi. La Parte seconda approfondisce, mediante la riformulazione algebrica del metaxy platonico, l’infrastruttura categoriale e trascendentale del luogo in cui si concretizza ed opera il diritto; qui la chiave filosofica è la composizione dello zero con l’aleph. La Parte conclusiva tenta di mostrare come la sintesi tra la lettura del concreto nella sua complessità, resa possibile da un adeguato quadro categoriale, e la comprensione trascendentale del metaxy, siano condizioni per pensare e vivere il diritto quale coniugazione del bonum ordinis con la relazione di riconoscimento e per offrire alle realtà istituzionali, di fronte alle molte spinte deformanti e disgreganti odierne, un equilibrato canale di differenziazione.Il diritto tra i numeri, starting from the analysis of legal knowledge carried out by the author in Diritto ed episteme, bases itself on the value of the number as an epistemic guideline to reconstruct some parts of the categorical range, which makes its elaboration possible and its results both theoretical and operational. Part One is dedicated to the analysis of the complexity of law in its concreteness and follows the heuristic and isomorphic outline of complex vectors. Part two explores, through the algebraic reformulation of the platonic metaxy, the categorial and transcendental infrastructure of the place, the in-between where law is concretized and operates; here the philosophical key is the composition of the zero with the aleph (infinitum). The concluding part tries to show how the synthesis between the reading of the concrete in its complexity, made possible by an adequate categorial framework, and the transcendental understanding of the metaxy, are conditions to think and live the law as a mediation of the bonum ordinis with the relationship of recognition and to offer to institutional realities, in the face of today's many deforming and disruptive drives, a balanced channel of differentiation

    The paper analyses the issue of the relationship between international investment agreements (IIAs), with particular regard to intra-EU bilateral investment treaties (BITs) and the Energy Charter Treaty (ECT), on the one hand, and the EU treaties from the perspective of the argumentative structures underlying the arbitral investment awards and the positions of the EU institutions and Member States, on the other hand. The author argues that, following the Achmea judgment, the arbitration community is currently facing an embarrassing incommunicability between international investment law and EU law: a new Babel’s Tower that threatens the reliability of the EU legal order vis-à-vis investors and the arbitration system, as well. A reasonable coordination could and should be achieved not only at the level of jurisdiction, but also at the merits stage of the arbitral proceedings. Arbitral tribunals should retain their jurisdiction. However, they should pay the utmost attention to the substantive standards which have to be applied within the territory of EU Member States towards European investors. Indeed, the real risk of discrimination lies in the use of different legal standards in the appreciation of state measures depending on whether the dispute is decided by national judges and the CJEU (in dialogue with the ECtHR) or by arbitral tribunals in radically different ways. The efforts of substantive coordination between international investment law and EU law could reach a sustainable result suitable to constitute an appropriate reviewing parameter in the enforcement phase of arbitral awards before Member States’ courts
