No full textL'autore evidenzia come larga fortuna abbia avuto nella dottrina e giurisprudenza successive lo spunto di Domenico Rubino in tema di patti sulla responsabilità del venditore e, nella specie, con riguardo al rapporto tra garanzie (per evizione e per vizi) e autonomia privata. La diretta riconduzione delle garanzie nel contratto di vendita e dunque entro l’alveo della disciplina generale dell’inadempimento, condotta dal Maestro, rivela la valenza sistematica del principio "ne dolus aut culpa lata praestetur" (art. 1229, comma 1, c.c.) e i suoi connessi riflessi applicativi. Di qui si coglie l’insegnamento di Domenico Rubino nei suoi profili evolutivi, rimarcando le potenzialità applicative del principio prima ricordato ("ne dolus aut culpa lata praestetur") a tutti i patti sulla responsabilità (sull’an, quando, quid, quantum della "responsabilità debitoria") e l'attuale fondamento costituzionale/europeo del divieto ex art. 1229 c.c. Le conclusioni del lavoro si spingono fino ad indagare il complesso tema del rapporto fra autonomia privata e responsabilità del debitore alla stregua del controllo di liceità, del giudizio di meritevolezza e dello scrutinio di onerosità/vessatorietà, nonché ad attualizzare l’insegnamento di Domenico Rubino con particolare riferimento alla più recente questione della ricostruzione dei rimedi contrattuali
Going Beyond Counting First Authors in Author Co-citation Analysis
Get PDFThe present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation
counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed
Variations on the Author
Get PDF“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship
Welfare Enhancing Coordination in Consumer Cooperatives under Mixed Oligopoly
No full textThe recent globalization of world economies has led the retail markets of developed countries towards increasing levels of integration and strategic interdependence. A non negligible share of retail and food markets is currently served by co-operative societies. Consistently with this trend, the consumer cooperatives have recently experienced increasing levels of integration. The main aim of this paper is to study the welfare effects of coordination among consumer cooperatives competing in quantities in a mixed oligopoly against profit-maximizing firms. We show that, in absence of agency problems, under increasing or constant returns to scale a higher output coordination of the consumer cooperatives does not affect the total welfare as long as a nonnegative profit constraint holds in these firms. On the other hand, under decreasing returns to scale, the consumer cooperatives contribute more to social welfare when acting on behalf of all consumers. This is because, by coordinating consumers’ preferences, these firms can reduce their market output, thus helping the market to come closer to the first best. All together these results seem to provide an argument in favour of the recent process of integration involving consumer cooperatives in many developed countries
