    Going Beyond Counting First Authors in Author Co-citation Analysis

    The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed.     Variations on the Author

    “Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship

    Legal character of counterpurchase contracts

    The article presents the analysis of legal qualification of counterpurchase contracts in the light of the Polish law. The subject-matter of the analysis are: the counterpurchase contract as a final sale contract, as a contract for negotiations, as a preliminary contract, and as a frame contract.     Appropriate Similarity Measures for Author Cocitation Analysis

    We provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature.     The contens of counterpurchase contract in international trade

    Counterpurchase contract is one of more frequently concluded countertrade transactions in international trade. Like other countertrade transactions, it is not separately regulated in Polish law. The basis of any attempts to systematize these phenomena and to examine their legal character must be the analysis of their contents. In particular, the analysis of stipulations of a counterpurchase contract, i.e. a specific and characteristic type of such transactions, should be carried out. The author defines a counterpurchase contract as a type of a countertrade transaction in which the exporter obliges himself to purchase from the importer, or from any other person indicated by the latter, goods for the value being usually in proportion to the cost of the export transaction. In his article the author analyses: the stipulation of a counterpurchase contract formulating the duty to conclude in future the execution contracts — the indication of the volume of an obligation, type of goods and prices (sec. 3), clauses typical for international trade contracts — reexport clause, binding force clause, arbitration clause and property clause (sec. 4), stipulations determining the performance of an obligation — time limit, the certificate releasing from the obligation (sec. 5), indications of legal consequences of non-performance — stipulated penalties and the consequences of paying them.Digitalizacja i deponowanie archiwalnych zeszytów RPEiS sfinansowane przez MNiSW w ramach realizacji umowy nr 541/P-DUN/201

    Dispelling the Myths Behind First-author Citation Counts

    We conducted a full-scale evaluative citation analysis study of scholars in the XML research field to explore just how different from each other author rankings resulting from different citation counting methods actually are, and to demonstrate the capability of emerging data and tools on the Web in supporting more realistic citation counting methods. Our results contest some common arguments for the continued use of first-author citation counts in the evaluation of scholars, such as high correlations between author rankings by first-author citation counts and other citation counting methods, and high costs of using more realistic citation counting methods that are not well-supported by the ISI databases. It is argued that increasingly available digital full text research papers make it possible for citation analysis studies to go beyond what the ISI databases have directly supported and to employ more sophisticated methods

    Wydział Prawa i Administracji: Katedra Prawa Cywilnego, Handlowego i UbezpieczeniowegoPraca analizuje tzw. czynności podobne do czynności prawnych (oświadczenia podobne do oświadczeń woli). Do badań nad takimi czynnościami wykorzystano hipotetystyczny paradygmat metodologiczny. Do sformułowania hipotez dotyczących przedmiotu badań wykorzystano semiotykę, filozofię analityczną, teorię prawa i teorię argumentacji. Przyjęte i uzasadnione hipotezy wyznaczyły definicję czynności podobnych. Czynności podobne do czynności prawnych są to takie czynności konwencjonalne mające charakter performatywu, których reguły sensu nie są konstruowane przez prawodawcę, a z których wytworami prawodawca w określonych okolicznościach wiąże określone skutki prawne. Definicja pozwoliła na wskazanie konkretnych zdarzeń prawnych z KC i KRiO mających charakter czynności podobnych. W dalszej kolejności zbadano możliwość stosowania do czynności podobnych norm prawa cywilnego odnoszących się expressis verbis jedynie do czynności prawnych, względnie oświadczeń woli.In der Arbeit analisiert man die sog. rechtsgeschäftsähnlichen Geschäften. Die Untersuchungen wurde auf Grund der allgemeinen Hipothesen durchgeführt. Um die Hipothesen zu formulieren, verwert man die Semiotik, die analytysche Philosophie, die Rechtstheorie und die Theorie der Komunikation. Die angenohmenen und begründeten Hipothese gaben die Definition der „rechtsgeschäftsähnlichen Geschäften“. Die rechtsgeschäftsähnlichen Geschäften sind also solche konventionelle Geschäfte, die die Charakter eines Performatives haben, ihren Sinn-Regeln nicht durch Gesetzgeber in Gesetzbücher konstruirt worden und denen durchsetzung der Gesetzgeber bestimmte Rechtsfolgen zuschreibt. Die Definition gab eine Möglichkeit, die bestimmten Rechtsereignissen von ZGB und Familien-Gesetzbuch als rechtsgeschäftsähnlichen Geschäften zu interpretieren. Dann untersucht man, welche Vorschriften, die vörtlich nur Rechtsgeschäften (Willenserklärungen) betreffen, kann man auch auf rechtsgeschäftsähnlichen Geschäften ausbreiten

    Wydział Prawa i AdministracjiPrzedmiotem rozprawy jest umowa przekazania nieruchomości – instytucja prawa zobowiązań. Wskazana umowa stanowi instrument prawny pozwalający na nieodpłatną rezygnację z własności nieruchomości. W pracy przedstawiono genezę rzeczonej instytucji i jej konstytucyjnoprawne aspekty. Dokonano analizy treści stosunku prawnego kreowanego umową przekazania nieruchomości, jego stron, jak również charakteru prawnego umowy. Poczyniono rozważania dotyczące możliwości stosowania per analogiam przepisów o darowiźnie do umowy przekazania nieruchomości. Praca dotyczy też trybu zawarcia umowy przekazania nieruchomości. Ponadto poruszono m.in. problematykę umowy przekazania użytkowania wieczystego.The subject matter of the dissertation is a real estate alienation contract - an institution of the law of obligations. The mentioned contract is a legal instrument for a free of charge relinquishment of the ownership of real estate. The paper presents the genesis of a real estate alienation contract and its constitutional aspects. The dissertation analyzes the content of a legal relationship created by a real estate alientation contract, its parties, as well as the legal character of the contract. Considerations have been made regarding the possibility of applying legal provisions on donation by analogy to a real estate alienation contract. Furthermore, the paper deals with the procedure for concluding a real estate alienation contract. It also discusses, among others, the issue of a perpetual usufruct alienation contract
