    In this thesis, we consider a new generalization of the Fourier transform, depending on four complex parameters and all the powers of the Fourier transform. This new transform is studied in some Lebesgue spaces. In fact, taking into account the values of the parameters of the operator, we can have very different kernels and so, the corresponding operator is studied in different Lebesgue spaces, accordingly with its kernel. We begin with the characterization of each operator by its characteristic polynomial. This characterization serves as a basis for the study of the forthcoming properties. Following this, we present, for each case, the spectrum of the corresponding operator, necessary and sufficient conditions for which the operator is invertible, Parseval-type identities and conditions for which the operator is unitary and an involution of order n. After this, we contruct new convolutions associated with those operators and obtain the corresponding factorization identities and some norm inequalities. By using these new operators and convolutions, we construct new integral equations and study their solvability. In this sense, we have equations generated by the studied operators and also a class of equations of convolution-type depending on multi-dimensional Hermite functions. Furthermore, we study the solvability of classical integral equations, using the new operators and convolutions, namely a class of Wiener-Hopf plus Hankel equations, whose solution is written in terms of a Fourier-type series. For one case of this generalization of the Fourier transform, that only depends on the cosine and sine Fourier transforms, we obtain PaleyWiener and Wiener’s Tauberian results, using the associated convolution and a new translation induced by that convolution. Heisenberg uncertainty principles for the one-dimensional case and for the multi-dimensional case are obtained for a particular case of the introduced operator. At the end, as an application outside of mathematics, we obtain a new result in signal processing, more properly, in a filtering processing, by applying one of our new convolutions.Nesta tese, consideramos uma nova generalização da transformação de Fourier, dependente de quatro parâmetros complexos e de todas as potências da transformação de Fourier. Esta nova transformação é estudada em alguns espaços de Lebesgue. De facto, tendo em conta os valores dos parâmetros, podemos ter núcleos muito diferentes e assim, o correspondente operador é estudado em diferentes espaços de Lebesgue, de acordo com o seu núcleo. Começamos com a caracterização de cada operador pelo seu polinómio característico. Esta caracterização serve de base para o estudo das propriedades seguintes. Seguindo isto, apresentamos, para cada caso, o espetro do correspondente operador, condições necessárias e suficientes para as quais o operador é invertível, identidades do tipo de Parseval e condições para as quais o operador é unitário e uma involução de ordem n. Depois disto, construímos novas convoluções associadas àqueles operadores e obtemos as correspondentes identidades de factorização e algumas desigualdades da norma. Usando estes novos operadores e convoluções, construímos novas equações integrais e estudamos a sua solvabilidade. Neste sentido, temos equações geradas pelos operadores estudados e também uma classe de equações do tipo de convolução dependendo de funções de Hermite multidimensionais. Além disso, estudamos a solvabilidade de equações integrais clássicas, usando os novos operadores e convoluções, nomeadamente uma classe de equações de Wiener-Hopf mais Hankel, cuja solução é escrita em termos de uma série do tipo de Fourier. Para um caso desta generalização da transformação de Fourier, que depende apenas das transformações de Fourier do cosseno e do seno, obtemos resultados de Paley-Wiener e resultados Tauberianos de Wiener, usando a convolução associada e uma nova translação induzida por essa convolução. Princípios de incerteza de Heisenberg para os casos unidimensional e multidimensional são obtidos para um caso particular do operador introduzido. No final, como uma aplicação fora da matemática, obtemos um novo resultado em processamento de sinal, mais propriamente, num processo de filtragem, por aplicação de uma das nossas novas convoluções.Programa Doutoral em Matemática Aplicad

    Haftung für staatliches Unrecht nach deutscher und vietnamesischer Rechtslage im Vergleich

    Das Staatshaftungsrecht (vietnam.: “Luật trách nhiệm bồi thường nhà nước”) wird als eine der Nagelproben des Rechtsstaats angesehen. Wenn der Rechtsstaat sich ebenso wie seine Bürger an die Gesetze halten muss, ist es nur konsequent, wenn er auch für das von ihm verursachte Unrecht verantwortlich ist. Mit anderen Worten: Der Staat muss für die Schäden einstehen, die durch seine Amtswalter verursacht wurden. In Vietnam ist das “Staatshaftungsrecht” im Vergleich zu Deutschland ein relativ junges Rechtsgebiet. Schon vor mehr als hundert Jahren diskutierten deutsche Juristen über eine Reihe von Ideen über das Staatshaftungsrecht. Die Staatshaftung im engeren Sinne wurde in Deutschland bereits 1919 durch Art. 131 der Weimarer Reichsverfassung (WRV) begrün-det. Viel zu spät dagegen – erst seit 1959 – normierte die Vietnamesische Verfassung (VV) das Recht auf Schadensersatz in Art. 29. Das vietnamesische Staatshaftungsgesetz trat erst am 1. Januar 2010 in Kraft. Deswegen ist eine Harmonisierung des vietnamesischen Rechts mit fremden Rechtssystemen zur Anpassung an die internationale Integration erfor-derlich. Die Dissertation dient auch als Reformvorschlag zum Staatshaftungsrecht, insbesondere in der vietnamesischen Rechtsordnung. Die vorliegende Arbeit gliedert sich in sechs Kapitel. Im ersten Kapitel stellt der Verfasser die unterschiedlichen gesellschaftlichen Hintergründe des Rechts in Vietnam und in Deutsch-land dar, die das Recht – insbesondere das Staatshaftungsrecht – beeinflussen. Im zweiten Kapitel werden die Begriffe Staatshaftung und Amtshaftung interpretiert und ihre jeweiligen verschiedenen Facetten beleuchtet. Es folgen im dritten Kapitel die Analyse der rechtlichen Grundlagen und die Klärung der wesentlichen Inhalte des vietnamesischen Staatshaftungs-gesetzes. Die praktische Situation des vietnamesischen Staatshaftungsrechts wird anhand ausgewählter Probleme dargestellt, gefolgt von einer kritischen Würdigung von Vorschlägen zur Verbesserung. Im vierten Kapitel der Arbeit werden die verfassungsrechtlichen und son-stigen Rechtsgrundlagen des deutschen Amtshaftungsrechts, die jeweiligen Voraussetzun-gen, die Haftungsbeschränkungen sowie der Regressanspruch des Staates herausgearbei-tet. Das fünfte Kapitel vergleicht die Gemeinsamkeiten und Unterschiede der staatshaftungs-rechtlichen Anspruchsgrundlagen, deren konkrete Inhalte und Beschränkungen. Gegenstand des abschließenden sechsten Kapitels sind die wichtigsten Erkenntnisse der Dissertation sowie Vorschläge zur Reform des Systems des Staatshaftungsrechts.The so-called “law on state liability” (Vietnamese: “Luật trách nhiệm bồi thường nhà nước”) is considered to be one of the essential requirements of the rule of law. The state under the rule of law is bound to the law just like its citizens. Hence, the state must likewise be respon-sible for its violations of the law. In other words, the state must be liable for damages caused by its agents and representatives. In comparison to Germany the “law on state liability” is a recently opened new field of law in Vietnam. For more than one hundred years, German jurists have discussed and developed a range of different ideas and aspects of state liability (German: “Staatshaftung”). The state liability was first stipulated by Art. 131 of the Constitution of the German Reich of 1919 (Weimar Constitution). In contrast, the Vietnamese law on state liability has not come into force until 1 January 2010. The main purpose of this thesis is to give suggestions for im-provements of the Vietnamese law on state liability in the context of international integration and strengthening of the rule of law. The thesis consists of six chapters. In the first chapter, the author analyzes the common-alitites and differences of political, cultural and social circumstances in Germany and Vi-etnam. Those directly affect the legal setting, especially the law on state liability. In the sec-ond chapter the author points out the term “state liability” and also deals with its legal and historical aspects. Subject of the third chapter is the legal basis and the fundamental con-tents of the Vietnamese law on state liability, which was passed on 18 June 2009 by the 12th Vietnamese National Assembly and came into effect on 1 January 2010. Regarding the Vi-etnamese law on state liability, the author analyzes practical cases and also makes sugges-tions for improvements of the Vietnamese law on state liability. The fourth chapter deals with issues concerning the German law on state liability, such as legal preconditions, restrictions as well as reimbursement liability. Afterwards, in the fifth chapter, the author summarizes, compares and points out the commons and differences between German and Vietnamese law on state liability. The sixth chapter addresses the most important results of the thesis as well as proposals for a sustainable development of the law on state liability in Vietnam, satis-fying the requirements of international integration and strengthening of the rule of law

    Going Beyond Counting First Authors in Author Co-citation Analysis

    The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed

    “Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship

    Appropriate Similarity Measures for Author Cocitation Analysis

    We provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature. The practical part concentrates on the company Coca Cola where the case study of the selected successful marketing campaign is stated within social networks. The campaign is further explored through applied research that analyses besides social network activities of commpanies and users mainly its influence on consumer awareness within the networks
