Riflessioni in tema di giustizia, economia e certezza del diritto
Full text linkThe paper examines the interrelation between justice, economics and law and tends to highlight, in particular, how the economic and financial crisis influenced the choices of representative institutions to the point of sacrificing social rights on the altar of the economy. The prevalence of the economy in political choices determined a rift with the people who addressed its demands to the jurisdiction that ended up being charged, in some cases, even with functions not related to its institutional role.Il lavoro esamina le interrelazioni esistenti tra giustizia, economia e diritto e tende ad evidenziare, in particolare, come la crisi economica e finanziaria abbia condizionato le scelte delle istituzioni rappresentative fino al punto di sacrificare i diritti sociali sull’altare dell’economia. La prevalenza di quest’ultima nelle scelte politiche ha determinato infatti una frattura con il corpo sociale, il quale ha indirizzato le proprie istanze al potere giurisdizionale che ha finito col farsi carico, in taluni casi, anche di funzioni estranee al proprio ruolo istituzionale
Il casellario informatico ANAC, la prevenzione della corruzione e la libertà di iniziativa economica privata
Full text linkThe article focuses on the analysis of art. 213, comma 10, of the Public Contracts Code. The Code establishes the creation of an ANAC computer records for collecting data to provide the necessary information about economic operators to the contracting Authority. The Code states that ANAC may insert additional information deemed “useful”. The database has the function of preventing the corruption. The data bank in question has the specific function to prevent corruption phenomena. Anyway, it must be balanced with the freedom of private economic initiative which, in turn, might suffer a widespread compression in case such data were not properly managed.L’articolo si sofferma sull’analisi dell’art. 213, comma 10, del codice dei Contratti pubblici il quale prevede l’istituzione del casellario informatico presso l’ANAC, la cui funzione è quella di raccogliere alcuni dati relativi agli operatori economici per fornire alle stazioni appaltanti talune informazioni. Il novero di tali informazione assume una dimensione particolarmente ampia e discrezionale laddove la disposizione prevede che l’Autorità possa inserire ulteriori informazioni ritenute “utili”. La banca dati in parola ha la funzione di prevenire il fenomeno corruttivo, tuttavia essa deve essere bilanciata con la libertà di iniziativa economica privata la quale può subire un’ampia compressione qualora i dati in parola non fossero correttamente gestiti

No full textIl presente lavoro analizza gli effetti della diffusione ed implementazione delle tecnologie delle informazioni e comunicazioni sull’efficienza della pubblica amministrazione. La digitalizzazione può costituire un valido strumento per rendere più “trasparente” l’amministrazione e in tal modo prevenire la corruzione.
L’accesso e la circolazione delle informazioni funzionali alla corretta azione amministrativa non possono, però, sacrificare altri diritti costituzionalmente garantiti, come il diritto alla riservatezza e alla tutela dei dati personali.This paper analyses the effects of the diffusion and implementation of information and communication technologies on the efficiency of the public administration. Indeed digitization can be a valuable tool to make the administration more “transparent” and prevent corruption. The access and circulation of information for efficient administrative actions may not, however, sacrifice other constitutionally guaranteed rights such as the right to privacy and the protection of personal data

Going Beyond Counting First Authors in Author Co-citation Analysis
Full text linkThe present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation
counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed
Variations on the Author
Full text link“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship
