No full textObiettivo del presente lavoro è descrivere la Direttiva del Parlamento Europeo e del Consiglio 2009/48/CE del 18 giugno 2009 sulla sicurezza dei giocattoli, recepita in Italia con Decreto Legislativo 11 Aprile 2011, n. 54, riguardo a finalità, contenuti e relazioni con la restante normativa europea in tema di prodotti difettosi e responsabilità del produttore. Più in generale, questo lavoro intende illustrare gli sforzi del Legislatore comunitario per dotare di un'adeguata tutela da ogni possibile e prevedibile rischio di utilizzo una fascia particolarmente sensibile e bisognosa di protezione come quella dei minori, ritagliando a tal fine per la categoria merceologica dei giocattoli un'apposita disciplina di settore distinta da quella della commercializzazione generale dei prodotti

Get PDFL'incremento della regolamentazione in materia finanziaria all'interno dell'Unione Europea e della supervisione posta in essere nell'era post-crisi, in aree tradizionalmente disciplinate da leggi private nazionali, accompagnato dalla mancanza di un approccio coerente relativamente al rapporto tra la regolamentazione finanziaria europea e il diritto privato, sono i punti di partenza da cui prende le mosse la presente tesi di dottorato. Ai sensi del diritto privato nazionale, le parti danneggiate hanno rimedi cui fare ricorso nel caso di violazione dei doveri di regolamentazione imposti a livello europeo? E qual è la relazione sussistente tra gli obblighi imposti nell'ordinamento comunitario e i doveri di diritto privato previsti nell'ambito dei sistemi legali nazionali? È forse auspicabile sviluppare una relazione più coordinata tra la regolamentazione finanziaria e la responsabilità civile a livello europeo? Questi alcuni degli interrogativi a cui si è tentato di dare risposta. La mancanza di qualsivoglia armonizzazione delle norme relative alla responsabilità civile è una caratteristica distintiva della regolamentazione finanziaria dell'Unione. In particolare, essa detta discipline specifiche in materia di prodotti finanziari, servizi e capitale, ma non regola il contenuto dei contratti tra partecipanti ai mercati finanziari, né fornisce rimedi per la violazione dei relativi obblighi. Il diritto europeo impone agli Stati membri di prevedere efficaci sanzioni amministrative in caso di mancato rispetto, da parte delle imprese, delle norme di comportamento, ma non impone di stabilire rimedi contrattuali o diritti d'azione privati per le perdite subite con la relativa violazione. Partendo da tali osservazioni, con il presente lavoro si è inteso determinare se e in che misura la regolamentazione finanziaria europea influenzi il diritto nazionale e in che modo tale influenza si rifletta nei diritti e rimedi contrattuali dei partecipanti al mercato
Going Beyond Counting First Authors in Author Co-citation Analysis

counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed
Variations on the Author
Get PDF“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship
Appropriate Similarity Measures for Author Cocitation Analysis
Get PDFWe provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature. Dispelling the Myths Behind First-author Citation Counts

use of first-author citation counts in the evaluation of scholars, such as high correlations between author rankings by first-author citation counts and other citation
counting methods, and high costs of using more realistic citation counting methods that are not well-supported by the ISI databases. No full textThe ideal completeness of Bessarion’s Greek library is mentioned in the Cardinal’s donation of his library to Venice in 1468. This ideal is evaluated in relation to the domain of history through a survey of the manuscripts from Bessarion’s collection now in the Marciana Library. These preserve Greek works spanning the years from Antiquity to the Late Byzantine period, including not only classicizing histories but also Church histories, world chronicles and other kinds of historiographical writings. A close look at the codicological and palaeographical data of these manuscripts and an examination of some of Bessarion’s marginal notes provide a deeper understanding of Bessarion’s relationship with Ancient and Byzantine history
