Public-Private Partnerships After Murthy v. Missouri
This Essay considers the future of public-private collaboration in the wake of the Murthy v. Missouri litigation, which cast doubt on the constitutionality of information sharing between federal agencies and social media companies. The litigation has been a good and a bad teacher. On one hand, the lower court decisions made legible the risks to free expression, accountability, transparency, and intimate privacy posed by government-industry collaborations. On the other hand, the litigation chilled information sharing between federal agencies, state election officials, and social media companies at the moment that such collaboration could and should help protect against foreign malign influence operations designed to undermine the integrity of the 2024 elections and beyond. We must rebuild public-private collaborations that protect democratic processes, guided by these lessons. Government can work cooperatively with tech companies without sacrificing free speech, but it must do so with commitments to accountability, transparency, and intimate privacy in mind
Management control of work-life balance. A narrative study of an Australian financial institution
Purpose – This paper aims to understand how managers in an Australian financial institution coordinated different organisational actions for the management of the work health of employees, by adopting “work-life balance” initiatives.
Design/methodology/approach – The paper uses a narrative approach to analyse various internal and external documents and has also collected “self-accounts” of employees.
Findings – It was found that management used “work-life balance” initiatives to manage both the physical and emotional health of employees. Management’s main focus was on community volunteering, which was satisfying for employees, but also of significant benefit to the organisation in terms of marketing and branding. Thus, management was able to use these initiatives to motivate employees to work towards organisational goals.
Originality/value – The paper contributes to the developing literature on human competence accounting by using employee “self-accounts” to compare with organisational statements in relation to worker health.

Valutazione del processo di taglio con filo diamantato in due cave di marmo
Le tagliatrici a filo diamantato sono comunemente impiegate in Italia per l'estrazione di rocce ornamentali (sia marmi sia rocce dure, come graniti e gneiss) fin dagli anni ‘70. La loro introduzione ha notevolmente influito sulla produttività e sull'efficienza del lavoro. Nonostante la diffusione di queste macchine sia avvenuta a livello mondiale, si registra, ancora oggi, la mancanza di una ricerca in grado di migliorare le condizioni operative e l'efficacia del processo. Inoltre, gli studi fin qui condotti per determinare a priori i fattori che influenzano le prestazioni delle perline diamantate nel taglio di diversi tipi di materiali non sono esaustivi. La perlina diamantata interagisce con la roccia durante la segagione e la velocità di taglio dipende dalle proprietà fisiche e meccaniche di quest'ultima. La tensione del filo crea una reazione sulla superficie che a sua volta provoca un'azione abrasiva tra la perlina e il materiale lapideo. Questa azione di taglio dipende dall'abrasività, così come dalla resistenza della roccia. Sulla base di queste premesse è stata effettuata in 2 cave di marmo una ricerca congiunta tra Italia e India per confrontare le caratteristiche dei diversi fili diamantati utilizzati, attraverso l'analisi delle loro prestazioni. La ricerca ha avuto come obiettivo anche quello di permettere uno scambio di know-how sui metodi di estrazione e sulle tecniche di taglio: le diverse prove sono state effettuate sia sul posto che in laboratorio e sono stati raccolti i relativi dati. Sono stati studiati i siti di Carrara e di Ambaji (India). In entrambe le cave è stata utilizzata una tecnica di taglio mista "a filo diamantato e a catena", ma la ricerca si è concentrata principalmente sulle prestazioni del filo. Sono stati raccolti dati sul filo diamantato per delineare le prestazioni del processo, vale a dire: potenza installata, geometria di taglio, velocità di taglio, lunghezza del filo, tensione applicata, diametro del cavetto e delle perline, numero di perline/metro. Inoltre, sono stati raccolti campioni di marmo, per effettuare le prove meccaniche di laboratorio. La presente ricerca effettua un confronto tra le prestazioni delle macchine e dei fili utilizzati nelle due cave e offre suggerimenti per aumentare la durata e la produttività del processo. Mediante la correlazione dei dati ottenuti dai campioni indiani e italiani, si è stabilito che i fili utilizzati a Carrara hanno avuto un rendimento migliore rispetto agli altri. Accounting for workplace flexibility: internal communication in an Australian financial institution
Purpose ‐ The purpose of this paper is to consider the impact of social accounting at the micro level and examines the use of social reporting for constructive purposes through internal communication devices. It explores the discourse adopted by a large organisation in social accounting and reporting (workplace flexibility) through employee newsletters. In doing so the paper seeks to answer two research questions. First, what workplace flexibility practices are evident in the employee newsletters? Second, do management use discourse (including self-accounts) in newsletters for self-serving management control purposes or for the emancipatory purposes of benefiting employees?
Design/methodology/approach ‐ Content and discourse analysis are used to examine "workplace flexibility" practices portrayed within the newsletters. This study explores the discourse adopted by a large Australian financial institution, in its social accounting disclosure in employee newsletters. It does so by examining the discourse adopted by the organisation in relation to one aspect of social accounting, that is, "workplace flexibility" in the employee newsletters over the period 2003-2007.
Findings ‐ The paper finds the financial institution used its internal newsletters to influence employee attitude and behaviour, not as claimed for social "betterment" ‐ justice, welfare, emancipation. The possibility of social accounting\u27s emancipatory potential was suppressed by those responsible for providing the accounts. The paper found that management used discourse (including self-accounts) in the newsletters for self-serving management control purposes and not as claimed for benefiting employees.
Originality/value ‐ The idea that the organisation provides workplace flexibility for the sake of benefitting employees is questionable. The discourse found in the newsletters suggests that flexible work options instead appear to be aimed at garnering employee loyalty, with subsequent employer benefits of improved organisational performance. The organisation used the discourse on workplace flexibility to blur the boundaries of work and life and persuade the employees to work harder and longer, to continuously increase productivity. In doing so, the organisation camouflaged its own economic sustainability and profitability as workplace flexibility
Going Beyond Counting First Authors in Author Co-citation Analysis
The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation
counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. The Question Not Presented: Government and Social Media Corruption After Murthy v. Missouri
The Supreme Court in Murthy v. Missouri in 2024 dismissed a suit by multiple plaintiffs alleging that the Biden Administration’s efforts to persuade social media platforms to monitor content violated the First Amendment. Although the Court did not directly decide the constitutionality of the government policy, the Court imposed a high bar for plaintiffs other than social media platforms to show standing to challenge the constitutionality of government pressure on the platforms. But the coercion problem is not the only troubling aspect of this government policy. The question not presented to the Court was the corruption problem. What happens when powerful politicians pressure social media platforms to do what they want for their own political advantage and then suggest that government regulation of the platforms will be impacted by “voluntary” adherence to content moderation norms? Politicians could seek more moderation or less moderation of platform content depending on their political objectives. Is this a proper use of government power, and will more of it be encouraged by the Court’s decision in Murthy v. Missouri?This Article addresses the heightened risk of quid pro quo relationships between public officials and social media platforms after the Murthy holding made it difficult for plaintiffs to sue the federal government for pressuring social media on content moderation. Government pressure on social media platforms exerted with corrupt intent presumably will be outside the reach of the courts when most affected platform users don’t have standing to sue.This Article explains why bribery laws are insufficient to deal with this corruption problem. A case study is presented by an October 2019 meeting between Facebook CEO Mark Zuckerberg and President Donald Trump and his son-in-law Jared Kushner at the White House. President Trump, as one next president, has close relationships with titans of the social media industry, including Elon Musk, owner of X. Trump also is the controlling shareholder of his own social media platform, Truth Social. The potential for quid pro quobetween politicians and social media now is stronger than ever. This Article also addresses legislative and regulatory solutions to this problem
Variations on the Author
“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship
