    Micro, Small and Medium Enterprises (MSMEs) are the most important pillar in the economic sector to dominate economic growth in Indonesia. Business legality is very necessary for MSMEs bisiness actors. The fact in the field is that there are still many business actors wh don’t have business legality. The Obstacles encountered include the lack of knowledge about business legality and the low education of MSMEs business actors. This has resulted in the inhibition of the development of MSMEs in Indonesia. In Government Regulation Number 7 of 2021 concerning the Ease of Protection and Empowerment of Cooperatives and MSMEs, it is stated that economic growth in Indonesia requires the empowernment and licensing of MSMEs. With the existence of the government regulation, the business license that has been designed in such a way by the Government to make it easier for business actors to issue their business legality. The legal issue that the author will examine is regarding the licensing of MSMEs that provide legal protection and realize a welfare state. MSMEs licensing as a form of legal protection is very important an has an impact, namely that the business license can be used for capital application with the aim of improving the MSMEs business for the better, being able to compete with other products in a larger market, getting assistance and empowerment from the Government so that it can realize a welfare stat

    Dental artisan is a dentist's specialty. The large number of dental artisan who do not follow the health benchmarks set out in Minister of Health Regulation Number 39 of 2014 makes it seem as if the norms created are meaningless. In fact, there are quite a few cases where dental artisan carry out fixed braces treatment on their patients. This research will discuss the legal regulation of dental artisan that exceed their authority in terms of Minister of Health Regulation No. 39 of 2014. The aim of this research is to find out the legal regulations regarding permits to practice dental artisan in Indonesia based on Minister of Health Regulation Number 39 of 2014 and to find out legal sanctions for providers of dental artisan who exceed their authority. In completing this research, the method used was the normative juridical method. The study results show that dentists based on Minister of Health Regulation no. 39/2014 is only allowed to make and install partial and/or full removable dentures using heat curing acrylic material. The sanctions that can be imposed on dentists who exceed their authority can be subject to administrative sanctions in the form of a written warning, temporary or permanent license revocation.Tukang Gigi adalah prefensi dari dokter gigi. Banyaknya jumlah tukang gigi yang tidak mengikuti tolak ukur kesehatan yang ditetapkan dalam Peraturan Menteri Kesehatan Nomor 39 Tahun 2014 membuat seolah-olah norma yang dibuat tidak berarti. Bahkan, tidak sedikit kasus bahwa tukang gigi melakukan treatment pemasangan kawat gigi cekat kepada pasiennya. Penelitian ini akan membahas mengenai pengaturan hukum jasa tukang gigi yang melebihi wewenangnya ditinjau dari Permenkes No.39 Tahun 2014. Tujuan penelitian ini untuk mengetahui pengaturan hukum mengenai ijin praktik jasa tukang gigi di Indonesia berdasarkan Peraturan Menteri Kesehatan Nomor 39 Tahun 2014 dan untuk mengetahui sanksi hukum bagi penyedia jasa tukang gigi yang melebihi wewenangnya. Dalam menyelesaikan penelitian ini, metode yang digunakan ialah metode yuridis normatif. Hasil studi menunjukkan bahwa Tukang Gigi berdasarkan Permenkes No. 39/2014 hanya diperbolehkan membuat dan memasang gigi tiruan lepasan sebagian dan/atau penuh dengan bahan heat curing acrylic. Adapun sanksi yang dapat dikenakan kepada Tukang Gigi yang melebihi wewenangnya dapat dikenakan sanksi administrasi berupa teguran tertulis, pencabutan ijin sementara maupun tetap

    Abstract: The background of this research is the Constitutional Court decision Number 65/PUU-XIX/2021, which review the Sharia Banking Law related to the Fatwa of the National Sharia Council of the Indonesian Ulema Council (DSN-MUI) and Sharia banking regulations in Indonesia. From this decision the author analyzes it by applying Gustav Radbruch\u27s concept of law, namely legal certainty. This research will use a normative juridical approach. Whereas the DSN-MUI Fatwa is not a positive law but rather a doctrine, which is called a source of law in a material sense. Given the principles and position of Islamic banking, which has specificity compared to conventional banking, namely applying Sharia principles, in which the DSN-MUI is involved. In order to guarantee legal certainty for stakeholders, the involvement of the DSN-MUI does not contain any legal issues at all as long as it is limited to issuing fatwas related to sharia principles, which are their authority. In this case, the state takes on the role of adopting sharia principles that have been stipulated by the DSN-MUI to become positive law that is enforced in the administration of state affairs in the field of sharia banking. Whereas this is in line with Radburch\u27s opinion where normativity has legal certainty, factual matters that develop in the banking world can be studied and supervised first by the DSN-MUI before finally entering the juridical stage by mentaqninkan (making positive law) the DSN-MUI Fatwa as outlined in the form of PBI and/or POJK
