    From the Introduction. The rejection by the French National Assembly of the ill-fated European Defense Community (EDC) Treaty in August 30, 1954, together with the automatic shelving of the equally faulty European Political Community (EPC) proposal, put an end, at least for the time being, to any form of political and military union of the existing Western Europe on a supranational level. The times were difficult in Europe and the international atmosphere was cloudy. The end of the Korean War coincided with the insistence of the Soviets to stick to a policy of détente, leading to the suppression of the Hungarian rebellion. France was facing opposition to her colonial presence in Indochina, as well as in North Africa. But the crisis of Suez prompted the French government to distance itself from the British and the United States. The defeat of the EDC and EPC was not going to be the end of the story and the dream inaugurated by Monnet and Schuman in 1950. It was not long before plans in favor of a European re-launch were taking shape.

    How would you feel if even though you were making regular monthly payments, your mortgage bank sold your house? This may seem like an odd question, but this type of situation happens every day in financial markets in a practice known as rehypothecation. Although such practices may be hard for nontraders to understand, rehypothecation is widespread in financial markets. Following the crisis of 2007-2009, the Dodd-Frank Act put restrictions on rehypothecation for derivatives. To understand the scope of these restrictions, we need to understand the role of rehypothecation in financial trades. In this article, Cyril Monnet discusses questions such as: Which party to a financial trade does rehypothecation benefit? Are there limits to its advantages? And how should it be regulated?     [spa] El presente working paper tiene su origen en la ponencia presentada por la autora en el marco del “Col·loqui amb joves investigadors: l’actualitat del Dret privat europeu” en mayo de 2016, organizado por la Dra. Esther Arroyo, titular de la Càtedra Jean Monnet de Dret Privat Europeu UB. Se centra en ciertas cuestiones del análisis desde el Derecho internacional privado de la protección de adultos que la autora pretende desarrollar en un futura contribución a elaborar en este ámbito: se trata de la actual falta de un Reglamento específico de la UE que aborde la materia, las perspectivas de acoger novedades legislativas al respecto y en particular la interacción entre ciertos instrumentos internacionales que cubren algunos aspectos en este marco, lo cual conduce a la necesidad de evitar incoherencias y propiciar la compatibilidad entre los mismos.     Jean Monnet, le père de l’Europe, un inconnu ? Des historiens européens et d’Amérique, spécialistes de l’Europe, ont rassemblé leurs connaissances acquises dans les archives de Jean Monnet et dans celles de leurs pays ou glanées dans les entretiens avec les témoins, pour faire un bilan sans complaisance de Jean Monnet. Ce volume ne fournira pas une biographie ronde et lisse mais plutôt des interprétations parfois contradictoires de la personnalité et de l’œuvre de Monnet, de l’inspirateur selon l’apostrophe fameuse du général de Gaulle. L’espace considéré est celui du siècle : depuis le premier engagement public de Monnet pendant la Grande Guerre jusqu’à la période du Comité d’Action pour les Etats-Unis d’Europe des années 1960 et 1970. La multiplicité des formes de l’action de Monnet révèle l’extraordinaire pouvoir de persuasion et de transformation de cet homme, issu du vieux terroir français des Charentes, mais embrassant aussi les lointains horizons de l’Atlantique. En ces temps d’hésitations internationales, de mondialisation redoutée, Monnet a poursuivi une idée simple, mais forte : la Paix et l’union des Européens. Le rapprochement entre la France et l’Allemagne en constituait la pierre angulaire. Dépasser les vieux antagonismes, fusionner les souverainetés, donner une identité à l’Europe, telle était son ambition. Ce livre d’histoire explique comment Monnet a su utiliser les grands événements du XXe siècle en travaillant avec les plus éminents responsables politiques pour réaliser, en partie, ces objectifs

    The bankruptcy of Lehman Brothers in 2008 will certainly be featured in history books as one of the greatest financial failures so far, but it will also be recorded as yet another episode of the historically successful performance of clearing arrangements in ensuring the resiliency of markets. Recognizing the usefulness of safe and sound clearing and settlement procedures, the Federal Reserve has recently supported the attempt to shift the clearing of some contracts to a central counterparty. In this article, Cyril Monnet outlines the arguments in favor of central counterparty clearing, the economic rationale for trade clearing through a central counterparty, and some possible limits to the advantages of clearing trades through a central counterparty.Bankruptcy ; Risk
