    The Nevada Division of Insurance’s (the Division) enabling statutes provide it with authority to promulgate regulations protecting against unfair use of consumer credit information. Its new regulation, R087-20, imposes only limitations and not a blanket ban on the use of consumer credit information and does not interfere with existing statutory provisions. The Legislature has provided adequate interpretation and guidance standards to the Division to constitute a constitutional delegation of authority such that the Division’s approved promulgation of R087-20 does not mean its enabling statutes are unconstitutional delegations of authority

    Professional negligence complaints are distinct from elder abuse complaints, with only the former requiring an affidavit of merit attached to the complaint. Where the type of complaint is unclear in regard to professional negligence and elder abuse, courts must look to the substance of the complaint to determine the scope and assess whether attachment of an affidavit of merit is statutorily required

    The Ninth Circuit certified the following question to the Court: Under Nevada law, must a series LLC created pursuant to Nev. Rev. Stat. Section 86.296 be sued in its own name for a court to obtain jurisdiction over it, or may the master LLC under which the series is created be sued instead? In 2005, the legislature amended NRS 86.296 to allow for the creation of Series LLCs. NRS 86.2962(2) “provides a list of optional, but not mandatory, attributes for a Series LLC.” The statutory language of NRS 86.292(2) further provides that series LLCs “may” sue or be sued in their own names. However, this Court finds that “the plain language of NRS 86.296(2) does not allow a party to sue a master LLC in lieu of a series LLC,” and answers the certified question as follows: “A series LLC created pursuant to NRS 86.292 must be sued in its own name for the court to obtain jurisdiction over it, provided the series LLC has observed the corporate formalities provided for in NRS 86.292(3).

    Going Beyond Counting First Authors in Author Co-citation Analysis

    The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed

    “Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship
