ADMINISTRATION OF ESTATES IN MALAYSIA: JURISDICTION AND MISCONCEPTION

Abstract: The administration of estate formally commences upon the application by the beneficiaries to the related administrative bodies. The application marks the beginning step in the administration of estate since the application is an essential process in obtaining the letters of representation. With the existence of multiple administrative bodies in Malaysia, one needs to ensure that the application is made to the right administrative body. Furthermore, the administration of estate needs to be promptly settled to avoid any unwanted consequences, hence justifying the need for the early application by the beneficiaries. However, some beneficiaries deliberately stall the application, which is detrimental to the administration of estate. Confusion in identifying the right administrative body as well as the wrong perception of the beneficiaries of the administrative bodies have been identified as the causes behind the late application. This paper addressed the jurisdiction of the administrative bodies in the administration of the deceased’s estate in Malaysia through the comparative approach in classifying the different roles and authorities of each administrative body. The writing involved the research method by way of a library-based study whereby the data were collected from multiple sources including conference papers, textbooks, statutes, case laws, journals and other materials. The finding points out several suggestions including the need for collaboration between the society and the government in relaying the information regarding the actual impression of the administrative bodies in the administration of estate.

Abstrak: Pentadbiran harta pusaka bermula dengan permohonan oleh benefisiari terhadap badan-badan pentadbiran. Tindakan ini dianggap sebagai langkah permulaan dalam pentadbiran harta pusaka kerana ia merupakan proses utama dalam mendapatkan surat perwakilan. Dengan wujudnya beberapa badan pentadbiran di Malaysia, adalah perlu untuk memastikan bahawa permohonan itu dibuat terhadap badan pentadbiran yang betul. Selain itu, pentadbiran harta pusaka perlu diselesaikan dengan segera bagi mengelakkan sebarang akibat yang tidak diingini, dan ini menunjukkan bahawa perlunya sesuatu permohonan awal dilakukan oleh benefisiari. Walau bagaimanapun, terdapat sesetengah benefisiari yang sengaja melewatkan permohonan dan ini telah memberi kesan negatif terhadap pentadbiran harta pusaka. Kekeliruan dalam mengenal pasti badan pentadbiran yang betul serta persepsi negatif oleh benefisiari terhadap badan-badan pentadbiran merupakan antara punca di sebalik kelewatan dalam membuat permohonan terhadap pentadbiran harta pusaka. Artikel ini menjelaskan bidang kuasa badan-badan pentadbiran dalam pentadbiran harta pusaka di Malaysia melalui bentuk perbandingan dengan mengklasifikasikan peranan setiap badan pentadbiran. Penulisan ini melibatkan kaedah penyelidikan melalui kajian berasaskan perpustakaan di mana data dikumpulkan daripada pelbagai sumber termasuk kertas persidangan, buku teks, statut, kes undang-undang, jurnal serta bahan-bahan lain. Hasil penemuan daripada artikel ini antaranya menyentuh berkenaan cadangan perlunya kerjasama antara masyarakat yang kerajaan dalam menyampaikan maklumat tentang peranan sebenar badan-badan pentadbiran dalam pentadbiran harta pusaka. Legal Development in Cross-Border Marriages Among Malay Muslims in Malaysia
Cross-border marriages have received a considerable amount of attention in recent years. Patterns and characteristics of cross-border marriages appear to differ widely among the world’s region and races. This article aims to discuss the legal development and history of cross-border marriages from the perspective of Muslim Malay couples in Malaysia and generally, under the English law. An analytical legal approach is used in this study to explore the legal developments in such cross-border marriages. The findings of this work are expected to fill the gap in the legal literature on marriages in Malaysia and also provide reference for designing a new improved policy and regulatory framework to deal with the problem
Mediasi sebagai kaedah penyelesaian dalam pertikaian pentadbiran harta pusaka untuk Undang-undang Keluarga Islam di Malaysia
Proposed Improvement for Divorce Resolution in Aceh And Malaysia: A Comparative Study
The purpose of this study is to analyze the solution of divorce cases among the people of Aceh and to study the
best practices that can be learned from Malaysia in order to create a model of a divorce case that can be
practised in Aceh. This qualitative study used the interview method which was conducted in Aceh and Malaysia
to learn how similar cases were resolved in Malaysia, while the secondary data was obtained through a library
study. The study concludes that the Customary Court has jurisdiction to resolve divorce cases, involving either
registered or unregistered marriage. However, the Customary Court failed to distinguish between criminal and
civil trial cases, which led to all cases of divorce claims being processed and subsequently allowed, but the
decision was only a fine. However, the Syariah court resolved divorce cases involving only registered marriages
as well as cases which impose imprisonment. This study proposes the need to create a Comprehensive Divorce
Case Settlement (PKPK) model which shows that divorce cases in the Customary Court can be brought before
the Syariah Court by the leader of the village who is entrusted to resolve the matter
Court-annexed mediation in Malaysia: prospect and challenges
There are three administrative bodies in Malaysia namely Civil High Court, Estate Distribution Division, and Amanah Raya Berhad (ARB). The Civil High Court is one of the administrative bodies where heirs will go if they want their estate falls within the the ambit of the jurisdiction of the court. . However during the hearing, disputes or disagreements, apart from those legal issues being heard at the court could arise. Since these problems are not being addressed at the court yet possess the potential to disrupt the estate management process, the parties' lawyers or even judges will suggest mediation as an effective solution. This is where Mediation Centre in Civil High Court takes place. In reality, despite the fact that this settlement mechanism has been active for a while, are unknown to the public. Therefore, the objective of this study is to provide a general overview of the Mediation Centre in Civil High Court and to evaluate any potential implications it might have in comparison to other administrative bodies towards attaining financial and social wellbeing in relation to inheritance management. This study adopts a library-based research on the pertinent materials, including but not limited to statutory provisions, case laws, textbooks, journal articles, newspapers, conference proceedings, and seminar papers, where the researcher applies a qualitative approach.. The findings from this study show that the mediation centre actually offers a variety of advantages, which therefore requires for its existence to be made known since many people are still unaware of this centre. REPERCUSSIONS OF MARITAL INFIDELITY IN MALAYSIA: A LEGAL RESPONSE
In today’s modern society, marital infidelity has become a dangerous threat to married life. Married couples are seen to be ‘comfortable’ in engaging in relationships with third parties. Such a trend has greatly contributed to the breakdown of marriages and subsequently led to the increase in the number of divorces and thus threatening the family institution. There are diverse causes for the prevalence of marital infidelity and this includes marriage boredom, unrealistic expectations, conflicts and misunderstandings between the husband and the wife. Although the seriousness of the affairs is widely recognized but marital infidelity is not considered as an offence in many jurisdictions including Malaysia. The objective of this article is to discuss the legal repercussions of marital infidelity in Malaysia and to consider whether existing legal solutions through the enforcement of law is an adequate mechanism to curb this social problem. The methodology adopted in this study is based on the content analysis of reports, case laws, leading textbooks and journal articles. The article is significant as it addresses crucial concerns over the adequacy of existing laws relating to the protection of the marriage and family institutions in Malaysia. The article is concluded with a series of recommendations and suggestions for improvements in existing law through appropriate legal mechanisms so as to curb the issue of marital infidelity in order to preserve the well-being of the family institution as a whole
Peranan dan cabaran pusat mediasi mahkamah dalam penyelesaian kes pertikaian di Malaysia (The role and challenges of the court mediation centre in resolving disputes in Malaysia)
Terdapat peningkatan kesedaran dalam kalangan rakyat Malaysia tentang
penyelesaian melalui mahkamah. Jika terdapat pertikaian yang berlaku
dalam kehidupan seharian mereka dan gagal diselesaikan secara baik,
tempat yang mereka tuju sudah semestinya mahkamah. Disebabkan
hal itu, kes di mahkamah semakin meningkat sehingga menyebabkan banyak kes di mahkamah terpaksa ditangguhkan atau ditunda ke suatu
tarikh yang lain. Perkara seperti ini secara tidak langsung memberikan
imej buruk atau negatif kepada institusi kehakiman di Malaysia. Oleh itu,
untuk mengelakkan perkara ini daripada menjadi tidak terkawal, hakim
di mahkamah mencadangkan pihak-pihak yang terlibat untuk bermediasi
di Pusat Mediasi Mahkamah yang dijalankan di Mahkamah Tinggi Sivil.
Walaupun pusat mediasi ini telah lama bertapak di Malaysia, kebanyakan
rakyat Malaysia masih tidak tahu akan kewujudannya. Oleh itu, objektif
utama kajian ini adalah untuk memberikan pengetahuan kepada orang
ramai tentang pusat mediasi ini dan menilai peranan dan cabaran yang
terdapat di pusat mediasi ini untuk menyelesaikan pertikaian. Kajian ini
mengguna pakai penyelidikan berasaskan kepustakaan, iaitu peruntukan
undang-undang, kes mahkamah, buku teks, artikel jurnal, akhbar,
prosiding persidangan dan kertas seminar. Kaedah temu bual secara
berstruktur juga dilakukan kepada pegawai mahkamah atau mediator
yang dilantik. Dapatan daripada kajian ini menunjukkan bahawa Pusat
Mediasi Mahkamah ini sebenarnya berkesan dalam usaha menyelesaikan
pertikaian khususnya pertikaian keluarga. Oleh itu, pelbagai usaha
perlu dipergiatkan agar kesemua cabaran yang ada di Pusat Mediasi
Mahkamah ini dapat diatasi secara efektif selain dapat meningkatkan
kesedaran orang ramai tentang kewujudan Pusat Mediasi Mahkama
Syndicate marriage or tafficking? The travails of Asian migrant women
Migration is a phenomenon that has come to stay. It cuts across all nations in the world. People migrate for
different purposes such as education, marriage, labour, job opportunity or employment and shelter for
refugees. Migration occurs through various mediums which could be self, family members, friends, or other
intermediaries such as brokers. This research applied the pure library-based research method to highlight the
activities of brokers in migration in Asia and examine the ordeals of women victims in cross-border
migration. It was discovered that activities of these illegal brokers, that is also known as syndicates, are not
different from human trafficking. The women victims, whose desires are to change their status, soon got
trapped in uncertainty with shattered dreams, hence the suggestion that Asian countries enter into bilateral
agreement to enable favourable and a less strict migration procedures for their member states. In addition,
the contracting states should enact strict legislation to curb syndicate marriage and check the accesses of
these illegal brokers
Small Estates (Distribution) Act 1955: analysis on the 2022 amendment and its effects over the inheritance management
This study aims to analyse the amendments to the Small Estates(Distribution) Act 1955 by looking at each amendment and identifying its impact on other relevant administrative bodies. This qualitative study involved library-based research in which the authors reviewed relevant literature for the purpose of data collection, namely newspapers, textbooks, conference proceedings, case laws, seminar papers, and journal articles. The amendment shows some overlap with the jurisdiction of other administrative bodies, specifically the Amanah Raya Berhad (ARB). The paper suggested that further amendments be made to other administrative bodies, namely the Civil High Court and ARB in order to prevent such overlapping
Muslim estate administration: the locus of Malaysian syariah court in Malaysia
The concept of dual justice system practiced in Malaysia governs the area of inheritance where there is a notable difference between Muslim and non-Muslim estate administration. While the non-Muslims deal solely with civil court, the Muslims are governed under both civil and Syariah Court. For Muslims, reference to Syariah Court is required for the purpose of obtaining the fara’id certificate, prior to the application to other administrative bodies. Having to deal with multiple bodies tends to lead to a confusion among the Muslims as to which institution should they approach, signifying the extra commitment that they will have to make. The complexity of the process encountered by the beneficiary results in discouragement to proceed the administration which eventually led to delay in estate administration and distribution. The lack of understanding regarding the function of the Syariah Court holds as a key factor to this ongoing issue. This paper adopts the library-based research which focuses on the analysis of written sources including but not being limited to journal articles, statutes, case laws and text books. In its findings, this paper states that there is a need for the government to re-look into the structure of the administrative bodies by making proper amendments in order to simplify the current process of the Muslim estate administration
