IN WAKE OF MCDOUGAL\u27S DEATH, SAYS UGA LAW PROFESSOR ATHENS, Ga. -- Echoing the call of Senate Majority Leader Trent Lott, UGA law professor and criminal law expert Ron Carlson has called for special prosecutor Kenneth Starr to show his cards and reveal the evidence derived from numerous interviews with James McDougal, the convicted Whitewater partner and former Clinton ally who died of a heart attack in federal prison on Sunday. McDougal, a key Whitewater witness, had recently supplied a steady stream of information to Starr in exchange for a reduced sentence. I would expect that in McDougal\u27s case, there are paper documents that reflect his testimony, tape recordings and videotape recordings of what McDougal has to say, said Carlson. Because of his death, by and large, those documents are inadmissible evidence. A live witness has to appear and be open to cross-examination. In the absence of the author of the remarks, the tape recordings are hearsay evidence, which judges exclude from trials. According to Carlson, the time for public accountability is near, and nothing makes more sense than for Starr to release his star witness\u27 words to the press and public. It would not compromise his trial evidence, said Carlson, so this seems the perfect opportunity for independent counsel Starr to inform the public, respond to Majority Leader Lott\u27s call to show something of what he has, and finally, let us all out here in the public judge for ourselves whether he has anything or not. Carlson says Starr\u27s next move will be dictated by the amount of pressure he feels from lawmakers, particularly if more Republicans demand a swift end to the investigation. I expect there will be enough pressure on Starr that he is going to need to make some important disclosures, said Carlson. Nobody knows precisely what McDougal has said because his dialogues with the independent counsel have been private. His statements might close the doors on Whitewater or they might throw them wide open. Carlson, a nationally recognized expert in evidence, trial practice and criminal procedure, has litigated many cases and has been admitted to practice before the U.S. Supreme Court. He has written numerous books on trial techniques and provided extensive commentary for the national media in high-profile trials. -30

    John Otterbein Snyder (1867–1943) was an early student of David Starr Jordan at Stanford University and subsequently rose to become an assistant professor there. During his 34 years with the university he taught a wide variety ofcourses in various branches of zoology and advised numerous students. He eventually mentored 8 M.A. and 4 Ph.D. students to completion at Stanford. He also assisted inthe collection of tens of thousands of fish specimens from the western Pacific, central Pacific, and the West Coast of North America, part of the time while stationed as “Naturalist” aboard the U.S. Fish Commission’s Steamer Albatross (1902–06). Although his early publications dealtmainly with fish groups and descriptions (often as a junior author with Jordan), after 1910 he became more autonomous and eventually rose to become one of the Pacific salmon, Oncorhynchus spp., experts on the West Coast.     2014-03 Prices and Quantities in Health Care Antitrust Damages

    Antitrust analysis conventionally assumes that illegal agreements among competitors raise prices and lower quantities, relative to lawful competition. However, markets for healthcare services have tendencies towards overprovision, which may increase when competition declines. This paper examines this possibility using data from a well-known antitrust case in Wisconsin. We find that, in parts of the state where physician groups illegally divided up markets, costs of physician services rose by about 10% more than they did elsewhere, with about half of this increase due to increased services. This suggests that higher quantities can contribute to healthcare antitrust damages, along with higher prices.Working Paper Series No. 2014-3 January 201

    Blind injustice : Jesus' prophetic warning against unjust judging (Matt 7:1-5)

    This dissertation seeks to provide a plausible alternative to the consensus interpretation of Jesus' "do not judge" teaching in Matt 7:1-5. While the overwhelming majority of recent interpreters understand "do not judge" (7:1) and its concurrent sayings such as "take the log out of your own eye" (7:5) to promote a non-judgmental attitude, this monograph seeks to situate this block of teaching within a Jewish second-Temple judicial setting. To this end, an overview of the judicial system during the second Temple era is provided, after which it is argued that Matt 7:1-5 is the Matthean Jesus' halakhic, midrashic comment upon the laws for just legal judging in Lev 19:15-18, 35-36 by which he prophetically criticizes unjust legal judging. Jesus' brother James takes up this teaching in Jas 2:1-13, using it to exhort Jewish Christian leaders who judge cases within Diaspora synagogues/churches. Such an alternative interpretation of Jesus' "do not judge" teaching in Matt 7:1-5 matches well other passages in Matthew which likewise speak of judicial, brotherly conflict such as 5:21-26 and 18:15-35. Some early Christian writers who quote or allude to Matt 7:1-5 reflect a judicial understanding of these verses as well, often relating Matt 7:1-5 to Lev 19:15-18, 35-36 and/or drawing parallels between Matt 7:1-5 and one or more of the NT judicial texts which, this thesis argues, is related to it (Matt 5:21-26, 18:15-35; Jas 2:1-13)

    The Evaluation of High Tannin Cotton Lines for Resistance to Rhizoctonia solani and Pythium aphanidermatum

    Cotton seedling disease complex is caused by a number of pathogens inducing similar symptoms and can lead to thin, uneven stands that grow slowly and yield poorly. Preliminary work indicated that a set of high tannin cotton lines developed and released in 1989 by Texas A&M AgriLife Research, (Smith et al., 1990a, Smith et al., 1990b, Schuster et al., 1990) may possess increased resistance to disease. This evidence, along with additional studies that show a clear role of tannin in disease resistance, suggest that these high tannin cotton lines may prove useful in breeding for increased resistance to cotton seedling disease complex. High tannin cotton lines were screened for their resistance to Rhizoctonia solani and Pythium aphanidermatum. While no high tannin germplasm line was more resistant to R. solani than the resistant control, Tamcot SP 21, the potential for significant gains from selection was demonstrated. Fifteen high tannin lines expressed resistance to P. aphanidermatum equal to the resistant control, Tamcot Sphinx (El-Zik and Thaxton, 1996). This resistance was not shown to be correlated with tannin content, though it is still unclear whether or not this lack of correlation is real or due to limitations in measuring tannin in infected seedlings
