    La proposta di un indicatore di qualità nella valutazione medico-legale della responsabilità professionale in ambito sanitario - A proposal for an indicator of quality in the assessment of medical legal professional liability in heltcare

    RIASSUNTO La casistica concerne i dati relativi alla casistica di responsabilità professionale di un’azienda ospedaliera (AO) veneta dall'1 novembre 1999 al 31 gennaio 2012. Gli Autori propongono un indicatore di qualità nella valutazione dell’operato dei medici legali dell’AO nell’ambito di consulenza preliminare relativamente a tale casistica . La proposta consiste nel confronto tra la concordanza o discordanza tra quanto precedentemente espresso nei pareri preliminari redatti dai medici legali dell’AO e l’esito in ambito giudiziario sia penale sia civile. È stato riscontrato che i pareri espressi dai medici legali dell’AO in ambito penale sono maggiormente concordanti con l’esito giudiziario rispetto ai pareri espressi dai medesimi in ambito civilistico. Sono esaminati i casi in cui il parere dei medici legali dell’AO è stato discordante rispetto al parere del CTU secondo diversi aspetti di carattere metodologico; se il consulente tecnico d’ufficio è afferente all’ambito universitario o è libero professionista, se è associato con un ausiliario specialista, se ha ricostruito la vicenda clinica, se ha discusso adeguatamente la colpa e il nesso causale, se si è confrontato o ha confutato le tesi della parte convenuta, se ha offerto controdeduzioni ai rilievi espressi dalle parti. Le CTU elaborate con metodologia rigorosa sono risultate, in circa la metà dei casi, anche “inattaccabili” sotto il profilo contenutistico, mentre per quelle metodologicamente risultate inadeguate/carenti il consulente tecnico di parte convenuta ha trovato sempre spazio per una replica con l’eccezione di quattro casi. Pur nella consapevolezza che la proposta di tale indicatore è soggetta a importanti limiti e all’interferenza di variabili, quali fra tutte il grado di competenza del CTU, allo stato, rappresenta uno strumento per apprezzare la qualità dell’operato dei medici legali coinvolti, quali consulenti tecnici, nella valutazione dei casi di responsabilità professionale. SUMMARY A specific study of data related to the cases of professional liability of the hospital, of the Veneto Region from 1 November 1999 to 31 January 2012. The authors proposed a quality indicator in reference to the assessment of the work done by the legal medical examiners of the hospital with the scope of giving preliminary advice in respect of such cases. The proposal consists of comparing the concordance or discordance between what was previously expressed in the preliminary opinion reports from legal medical examiners of the hospital and the results from both the criminal and legal civil field. It was found that the views expressed by medical experts of the hospital in reference to criminal cases are more consistent with the outcome of judicial results in respect to the opinions expressed by them in civil cases. It was examined the cases in which the opinion of the medical examiners of the hospital was not in agreement in relation to the opinion of the CTU (expert witness) in accordance with various aspects of methods used; if the expert witness is pertaining to the university or a freelancer, if it is associated with an auxiliary specialist, if it was reconstructed the historical clinic record, if discussed properly at fault and the causal connection, if it is compared or has refuted the argument of the defendant, if offered rebuttal to the comments made by the parties. The rigorous methodology used by the CTU are found in about half of the cases, even " untouchabily correct " in terms of content, if compared to those found to be methodologically inadequate/lacking technical accuracy has always found room for a replicant with the exception of four cases. We are aware that the proposal of this indicator is subject to important limitations and interference of the variables, which is of the competence of the CTU at the present state it is an instrument used to assess the quality of the work done by the legal medical professionist involved, as expert in the assessment of cases of professional liability

Nel corso degli anni, anche se in modo talvolta incompiuto, sono state introdotte in ambito medico-legale e giuridico delle innovazioni legate alla informatizzazione quali l’utilizzo della posta elettronica certificata, della firma digitale e del Processo Civile Telematico.     Going Beyond Counting First Authors in Author Co-citation Analysis

    The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed.     “Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship

    Appropriate Similarity Measures for Author Cocitation Analysis

    We provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature.     Dispelling the Myths Behind First-author Citation Counts

    We conducted a full-scale evaluative citation analysis study of scholars in the XML research field to explore just how different from each other author rankings resulting from different citation counting methods actually are, and to demonstrate the capability of emerging data and tools on the Web in supporting more realistic citation counting methods. Our results contest some common arguments for the continued use of first-author citation counts in the evaluation of scholars, such as high correlations between author rankings by first-author citation counts and other citation counting methods, and high costs of using more realistic citation counting methods that are not well-supported by the ISI databases. It is argued that increasingly available digital full text research papers make it possible for citation analysis studies to go beyond what the ISI databases have directly supported and to employ more sophisticated methods

    We have done our best to complete the author checklist relating to the use of animals in the hut study. Note that the objective for the hut study was to evaluate the IRS treatment applications for residual efficacy against Anopheles mosquitoes, including the local An. coluzzii mosquito population. Cows were only used to attract mosquitoes into the huts and no tests were carried out directly on the cows. The author checklist is intended for use with studies where experiments are carried out on animals, which is why we have had such difficulty in completing this for the hut study, as many of the questions do not relate to how the cows were used
