Methoden des Prozessmanagements in der Radiologie
Innerhalb eines Krankenhauses beeinflusst der Radiologe in einem Verbund von Fachabteilungen wesentlich die Liegezeiten von Patienten durch die diagnostische Information und die Verfügbarkeit seiner Dienstleistungen. Die Organisation und zeitliche Bemessung von radiologischen Untersuchungsabläufen werden dadurch um so wichtiger. Der Arzt wird im Rahmen seines Studiums und seiner Facharztweiterbildung nicht im Organisationsmanagement ausgebildet, entsprechendes Fachwissen muss er sich in der Regel in Eigenregie aus Fachliteratur und Kursen aneignen. Trotzdem wird vom Arzt über die medizinische Versorgung hinaus zunehmend verlangt, dass es seinen Arbeitsabläufe auch unter wirtschaftlichen Gesichtspunkten optimiert. In dieser Arbeit werden verschiedene Methoden des Prozessmanagements für ihre Anwendung in der Radiologie erprobt. Unter Zuhilfenahme von einfachen papierbasierten Methoden lässt sich bereits ein Großteil von Arbeitsprozessanalysen durchführen. Bei komplexen Arbeitsabläufen wird man eine Methode wählen, die möglichst genaue qualitative und quantitative Aussagen über zu erwartende Effekte liefert. Vorgestellt werden diesbezüglich die Netzplantechnik und die Prozesssimulation anhand des computertomographischen und sonographischen Arbeitsplatzes.Within a hospital, the radiologist considerably influences the patient s length of stay through the availability of service and diagnostic information. Therefore, coordination and timing radiologic examinations become increasingly more important. Physicians are not taught organizational management during their medical education and residency training, and the necessary expertise in economics is generally acquired through literature or specialized courses. Beyond the medical service, the physicians are increasingly required to optimise their work flow according to economic factors. This review introduces various tools for process management and its application in radiology. By means of simple paper-based methods, the work flow of most processes can be analysed. For more complex work flow, it is suggested to choose a method that allows for an exact qualitative and quantitative prediction of the effect of variations. Political belonging through elder care: Temporalities, representations and mutuality
In this article, we examine the ways elder care generates political belonging. Our approach builds on studies which argue that nurture and care create kinship, but takes that argument further by suggesting that care generates membership in numerous social formations, across scales. We suggest that elder care helps illuminate key aspects of political belonging, particularly the temporality of political membership, because elder care entails mutuality and reciprocity over a long period of time. In addition, elder care is an interactive process in which older persons, their caregivers, the state, and other actors negotiate modes of political belonging that entail affect as well as rights. Furthermore, elder care has been used to construct representations of ‘modern’ and ‘traditional’ families which are ideologically connected to particular political formations. These representations generate difference and ‘Othering’ of internal and external populations. Ultimately, we argue that a focus on elder care collapses domains usually kept artificially separated, like kinship and the state, and private and public, in ways that are productive for social analysis as a whole.Peer reviewe

Digitalization: Everything starts with an A: Evaluating the impact of digitalization on the maintenance strategy of digitized assets
The number of digital systems that is used for business processes in many organizations is increasing. These digital systems can be used to support decision-making in the maintenance process. In this research the effects of digitalization on the maintenance process are evaluated. This is done by focusing on five aspects: actors, agreements, approach, applications and availability. By comparing the recent knowledge described in the literature with the experiences from practice, a maintenance aspect framework is designed. The experience from practice is obtained from conducting interviews at four organizations. These organizations are: NS (Nederlandse Spoorwegen), Port of Rotterdam, Rijkswaterstaat and ProRail. At each of the organizations, one specific asset is selected for which the effects of digitalization are evaluated. The findings ofthe comparisons are reflected on the features of the asset and the organization to generalize the conclusions. Furthermore, an implementation plan and recommendations on how to use the framework to ensure that all the relevant aspects are included in future policies, are derived from the findings. The implementation plan is designed to be applicable in general, and the recommendations are made for NS specifically. In the recommendations, advice is provided on which aspects should be prioritized more and which aspects arealready well formulated in the long-term plans. Lastly, a time line is presented in which the phases of the digitalization transition process are represented. The implementation plan can be used as a guideline to determine in which phase an organization is currently in, and what steps should be taken to proceed to the next phase.Transport, Infrastructure and Logistic

Wykorzystanie dyrektywy jako „tarczy”, a nie jako „miecza” w relacjach horyzontalnych. Czy w świetle wyroku Trybunału Sprawiedliwości z dnia 18 stycznia 2022 r. w sprawie C-261/20 Thelen Technopark Berlin GmbH v MN ta koncepcja w ogóle ma sens?
This study of a scientific and research nature concerns one of the general principles of EU law, namely the principle of direct applicability. The publication contributes to a long-standing discussion on the direct effect of directives as secondary EU legislation. The main objective of the paper is to present the application of directives in the context of horizontal relations. This problem is of fundamental importance for explaining the mechanisms of direct application of the directives that have not been properly implemented in the national legal orders. Although in previous case law the Court of Justice had essentially opted against the concept of direct horizontal effect of directives, the issue in question, for its complexity, was again examined in one of the most recent preliminary rulings, case C-261/20 Thelen Technopark. Referring to that judgment, the author analyses the possibility of using a directive as a “shield” in the judicial application of law with an aim to eliminate a national law provision inconsistent with the directive from the rationale of the judicial decision. In particular, it concerns the possibility for directives to act in horizontal relations in such a manner that boils down to excluding the application of a provision of national law which is incompatible with it. The question of the possible use of directives as a “shield” is also examined from a slightly different perspective, namely from the point of view of the individual and the possibility to invoke a directive by the individual in the main proceedings where another individual wishes to cause an obligation be imposed on the former under the national law inconsistent with the directive. This problem, as can be argued, is ultimately resolved by the Court of Justice in case C-261/20 Thelen Technopark, which states that a national court hearing a dispute between individuals over a claim based on a national provision contrary to a directive is not required to disapply that provision solely on the basis of EU law.Niniejsze opracowanie o charakterze naukowo-badawczym dotyczy jednej z ogólnych zasad prawa Unii Europejskiej, jaką jest reguła bezpośredniego skutku. Publikacja stanowi wkład do trwającej od dawna dyskusji na temat bezpośredniego skutku dyrektyw jako aktów prawa wtórnego Unii Europejskiej. Głównym celem artykułu jest przybliżenie problematyki stosowania przepisów dyrektyw w kontekście stosunków horyzontalnych. Problematyka ta ma fundamentalne znaczenie dla wyjaśnienienia mechanizmów bezpośredniego stosowania dyrektyw, które nie zostały prawidłowo implmentowane do krajowego porządku prawnego. Mimo że we wcześniejszym orzecznictwie Trybunał Sprawiedliwości zasadniczo opowiedział się za odrzuceniem koncepcji bezpośredniego skutku dyrektyw w płaszczyźnie horyzontalnej, przedmiotowe zagadnienie – ze względu na jego złożoność – ponownie było rozpatrywane w jednym z najnowszych postępowań toczących się w trybie prejudycjalnym – sprawie C‑261/20 Thelen Technopark. Odnosząc się do tego wyroku, autorka poddaje analizie możliwość wykorzystania dyrektywy jako „tarczy” w procesie sądowego stosowania prawa w celu eliminacji z podstawy rozstrzygnięcia przepisu prawa krajowego sprzecznego z dyrektywą. W szczególności chodzi o możliwość takiego działania dyrektywy w relacjach horyzontalnych, które sprowadza się do wyłączenia stosowania niezgodnego z nią przepisu prawa krajowego. Problematyka ewentualnego wykorzystania dyrektywy jako „tarczy” jest rozpatrywana również z nieco innej perspektywy, mianowicie z punktu widzenia jednostki i możliwości powołania się przez nią na dyrektywę w postępowaniu krajowym w sytuacji, gdy inna jednostka chce doprowadzić do nałożenia na nią obowiązku przewidzianego przepisami prawa krajowego sprzecznymi z dyrektywą. Problem ten, jak można argumentować, ostatecznie rozstrzyga Trybunał Sprawiedliwości w sprawie C‑261/20 Thelen Technopark, orzekając, że sąd krajowy rozpoznający spór między jednostkami o roszczenie wywiedzione z przepisu krajowego sprzecznego z dyrektywą nie jest zobowiązany odstąpić od stosowania tego przepisu wyłącznie na podstawie prawa Unii Europejskiej

To focus the analysis, the author describes typical organizational and locational patterns and points out the high degree of international functional integration common in this activity. The Article next discusses the current tax rules applicable to global trading. The author focuses on the Organization for Economic Cooperation and Development model income tax treaty and the Internal Revenue Code rules that govern the apportionment among jurisdictions of the profits of this activity. The author concludes that global trading challenges many fundamental economic assumptions upon which these rules rest, among them the integrity of distinct legal entities and the relevance of national boundaries to capital markets

A High-Resolution Optical Measurement System for Rapid Acquisition of Radiation Flux Density Maps (Poster)
To identify the power and flux density of concentrated solar radiation the Institute of Solar Research at the
German Aerospace Center (DLR - Deutsches Zentrum für Luft- und Raumfahrt e. V.) has used the camera-based
measurement system FATMES (Flux and Temperature Measurement System) since 1995. The disadvantages of low
resolution, difficult handling and poor computing power required a revision of the existing measurement system. The
measurement system FMAS (Flux Mapping Acquisition system) is equipped with state-of-the-art-hardware, is
compatible with computers off-the-shelf and is programmed in LabView. The expenditure of time for an image
evaluation is reduced by the factor 60 compared to FATMES. The new measurement system is no longer associated with
the facilities Solar Furnace and High Flux Solar Simulator at the DLR in Cologne but is also applicable as a mobile
system. The data and the algorithms are transparent throughout the complete process. The measurement accuracy of
FMAS is determined to at most +/- 3 % until now. The error of measurement of FATMES is at least 2 % higher according
to the conducted comparison tests
