Kebebasan Akademik: Memperkasa Sistem Pendidikan di Malaysia
Academic freedom is one of the important elements of the establishment of higher education institutions for promoting a holistic and integrated education in order to produce knowledgeable human capital. Article 10 of the Federal Constitution clearly states that it all citizens have the right and freedom to express their views freely. From the said provisions of the Federal Constitution, there are many other legal provisions that have an impact on academic freedom in Malaysia. These include the Penal Code (Act 574), the Defamation Act 1957, the Sedition Act 1948, the Printing Presses and Publications Act 1984, the Official Secrets Act 1972, the Communications and Multimedia Act 1998, the University and University Colleges Act 1971, the constitution of every educational institution in Malaysia and others. A knowledge-based society should be given the right and freedom to express any ideas, findings or reforms that can be channeled to the relevant parties for the development of the country. However, limiting the space for these rights and freedoms will result in an "infertile" climate of thinking within local society, which will eventually lead to a reduction in intellectualism. Therefore, this article is designed to provide the concepts, scope and other factors that are considered appropriate to help the public understand the reality of the situation and how it can lead to the formation of a knowledge society as outlined in the Malaysian education system.

Masyarakat yang berteraskan ilmu hendaklah diberikan hak dan kebebasan untuk menyuarakan apa-apa pendapat, idea, penemuan atau pembaharuan yang kemudiannya disalurkan kepada pihak yang berkaitan bagi membangunkan negara. Keterbatasan ruang yang diberikan terhadap hak dan kebebasan ini mengakibatkan "kemandulan" pemikiran masyarakat yang akhirnya menyumbang ke arah penguncupan dari segi keilmuan. Oleh itu, artikel ini bertujuan untuk menzahirkan konsep, dan skop yang difikirkan sesuai bagi membantu masyarakat memahami hakikat sebenar keadaan ini dan menjurus kepada pembentukan masyarakat berpengetahuan seperti matlamat yang digariskan dalam sistem pendidikan di Malaysia.

Perlembagaan Persekutuan dan Undang-Undang Spesifik yang Berkaitan dengan Pendidikan di Malaysia serta Hubungannya dengan Kebebasan Ahli Akademik
Academic freedom is fundamental to the formation of a knowledge society. It is a form of freedom that needs to be upheld and strengthened to ensure that the the delivery of knowledge can continue to be implemented transparently and openly. However, this freedom has become a hot topic of discussion in society because there are restrictions against the development of knowledge which lead to non-sustainability of the educational sector. The Federal Constitution, the Statutory Bodies (Discipline and Surcharge) Act 2000 (Act 605), the University and University Colleges Act 1971 (Act 30), Education Act 1996 (Act 550), Private Higher Educational Institutions Act 1996 (Act 555), National Council on Higher Education Act 1996 (Act 546), Malaysian Qualifications Agency Act 2007 (Act 679) and the constitutions of the various universities are among the series of important statutes that need to be debated in detail, so that matters related to academic freedom in Malaysia can be clearly defined and put back on track. The objective of this article is to discuss those legal provisions which are directly or specifically related to academic freedom, especially involving those academics currently serving in higher education institutions in Malaysia. As an immediate effect of this article, it can be stated that there are several provisions of the said statutes which need to be reviewed immediately in order to ensure that the aspirations and goals of the National Education Philosoph—to produce holistic and integrated human capital in meeting the challenges of the globalization era—can be realized effectively.

Kebebasan akademik perlu ditegakkan serta diampuhkan bagi menjamin kesinambungan penyampaian ilmu pengetahuan dapat dilaksanakan secara telus dan terbuka. Walau bagaimanapun, kebebasan ini menjadi tajuk perbincangan yang hangat diperkatakan dalam kalangan masyarakat kerana terdapatnya sekatan yang memungkinkan perkembangan ilmu pengetahuan tidak dapat dijalankan secara mampan. Persekutuan Malaysia, Akta Badan-Badan Berkanun (Tatatertib Dan Surcaj) 2000 (Akta 605), Akta Universiti dan Kolej Universiti 1971 (Akta 30), Akta Pendidikan 1996 (Akta 550), Akta Pendidikan Tinggi Swasta 1996 (Akta 555), Akta Majlis Kebangsaan Pendidikan Tinggi 1996 (Akta 546), Akta Agensi Kelayakan Malaysia 2007 (Akta 679) dan Perlembagaan universiti-universiti merupakan antara sebilangan rangkaian akta penting yang perlu diperbahaskan secara rinci agar perkara yang berkaitan dengan kebebasan ahli akademik di Malaysia dapat diperjelas serta diletakkan semula pada landasan yang betul. Objektif makalah ini adalah untuk membincangkan peruntukan undang-undang yang secara langsung atau secara spesifik berkait rapat dengan kebebasan ahli akademik, khususnya melibatkan ahli akademik yang sedang berkhidmat di institusi pendidikan tinggi di Malaysia. Kesan langsung yang dapat dinyatakan dalam makalah ini ialah terdapatnya beberapa peruntukan undang-undang tersebut yang memerlukan penelitian semula secara segera bagi memastikan hasrat dan matlamat Falsafah Pendidikan Kebangsaan untuk melahirkan modal insan yang holistik dan bersepadu bagi mendepani cabaran era globalisasi ini dapat direalisasikan secara efektif.

Academic Freedom: Empowering the National Education Philosophy in Malaysia
Academic freedom is one of the basic rightstowards
improving the quality of teaching and learning processes. A
quality educational system should have a clear goal of
producing competitive, creative, and progressive human capital
as well as capable of expressing thoughtful and sound ideas to
enhance holistic and integrated national progress. Malaysia’s
educational system guided by the National Education
Philosophy underscores that integrated education should be a
key thrust in educating and producing students who are able to
compete internationally. With the accomplishment of several
key thrusts to achieve that goal, the National Education
Philosophy has also laid down an education basis through the
formation of a knowledge-based community peculiar to the
foundation of an integrated national development. Achieving
this goal will contribute to a strong and substantial progress in
addressing the challenges of globalization that every individual
in the society needs to face. As such, academic freedom should
serve as a core thrust in creating a sustainable and competitive
society in crossing and facing the challenges of a borderless
world that highs on the mental strength of each individual. This
paper will focus on the concept of academic freedom and its role
in empowering the National Education Philosophy in Malaysia
by implementing the Legal Research Methodology. Initially, the
legislative restrictions are the main issue faced by the
key-players in academic fields to defend their academic
freedom.
