No full textIl riordino monografico della produzione artistica scultorea i occasione della mostra antologica Salvatore Spedicato. Sculture 1956-2011 (Cavallino, Galleria Palazzo Ducale, 21 aprile -27 maggio 2012), affronta l'ultra cinquantennale produzione artistica di un intellettuale a tutto tondo che si è sempre ispirato alla Terra salentina per un arte dagli svariati risvolti espressivi. Nell'ambito della ricerca universitaria, i contributo fornisce un approfondito studio sull'attività artistica di Salvatore Spedicato con una accurata documentazione che concorre al riordino filologico ovvero alla conoscenza dell' attività artistica dell'artista di origine salentina, proponendo un metodo di ricerca altamente qualitativo e ricco di spunti e suggestioni. Emerge una produzione plastica dal figurativo al costruttivismo per un ritorno al mito mediterraneo importante non solo per la storia dell'arte contemporanea locale ma italiana del ’900

No full textThe chapter examines moral rights arising from the creation of industrial design works. The author observes how, in the European Union, the overlap between the registered design law and the copyright law, which also applies to industrial designs, raises problems of harmonisation between the rules of one discipline and those of the other, while at the same time allowing a considerable extension of the moral rights available to the author. However, the attribution to the author of an industrial design of all the moral rights recognised by copyright law raises non-trivial problems of balancing interests against the need to protect the reasonable expectations of the authors' successors in title
Virtual Secondary Markets: Are They Legally Sustainable?
No full textThe essay examines the legal sustainability of virtual secondary markets within the framework of European copyright law, with particular reference to the Court of Justice of the European Union’s ruling in Tom Kabinet. The author challenges the prevailing interpretation that this decision marks the definitive end of the exhaustion principle for digital works, instead proposing a more systemic and nuanced reading of the CJEU’s case law, including UsedSoft, FAPL, and VOB. The essay explores the balance between rightholders’ interests and the economic freedoms of users and competitors, highlighting how technological developments necessitate a re-evaluation of the exhaustion principle in relation to intangible goods. It argues that, under certain technical safeguards—such as the “one copy, one user” model—digital secondary markets may be compatible with EU law, thus offering a framework that reconciles the protection of intellectual property with the safeguarding of economic freedoms

No full textThis paper examines the evolution of the EU copyright exhaustion, from its first recognition by the European Court of Justice in the Deutsche Grammophon case to the recent perspective taken by the CJEU in the Usedsoft case with respect to digital copies. Taking into account the economic rationale of the principle of exhaustion and considering the ongoing dematerialisation of markets for copyrighted works, the author investigates whether – in the light of international and EU legislation and of the ambiguous approach of the European Court of Justice when requested to interpret the copyright rules in the context of the digital environment – such principle will still play a central role in the near future as a tool to avoid the artificial partitioning of the common market
