The Proliferation of Joint Interpretation Clauses in New International Investment Agreements: A Mixed Blessing?
Joint interpretation clauses (JICs) are among the most controversial control mechanisms on the interpretative powers of tribunals brought by the current wave of reform of the investor–State dispute settlement system (ISDS). Literally proliferating in the new generation of international investment agreements (IIAs), these clauses give contracting States the power to issue joint interpretations (JIs) that are expressly recognized as binding upon dispute settlement bodies and may even be issued in relation to matters pending before such bodies. This article discusses several issues raised by the ‘authentic interpretation’ enhanced by JICs. In the first part, JICs are assessed against the background of the general rule on treaty interpretation, including, in particular, subsequent agreements under article 31(3)(a) of the 1969 Vienna Convention on the Law of Treaties. The second part of the article addresses the tensions between judicial bodies and treaty parties sharing the interpretative authority over IIAs and investigates whether there are any limitations on the interpretative powers of States under JICs. The third part is devoted to the impact of JIs on the proper conduct of investment arbitration proceedings, considering the participation of private actors (the investors) in the proceedings and the ‘dual role’ of States (as treaty parties and respondents) in this field. The concluding part of the article speculates whether a greater institutionalization of the international investment regime is likely to prompt more frequent forms of judicial reactions against ‘ill-perceived’ JIs and fuel the tension between States and dispute settlement bodies

A “Game of Give and Take”: The ITLOS, the ICJ and Provisional Measures
Besides testing the enduring influence of the ICJ law and practice on provisional measures on those of ITLOS, this chapter aims to assess whether the recent practice of ITLOS could suggest new developments in the ICJ (and other courts and tribunals) approach to provisional measures. Accordingly, the analysis carried out in this chapter is twofold. First, it is showed that, with respect to certain aspects of provisional measures, the practice of “borrowing” from the ICJ is still particularly evident in ITLOS case law. It is stressed at the same time that this practice should often be followed by a practice of adapting the Court’s suggestions to the Tribunal’s peculiarities. Secondly, this chapter claims that while the evolution of the law governing provisional measures in the ICJ continues to have a significant impact for the ITLOS, this latter has also the potential to “lend” something to the Court, rather than only to borrow from it, and more generally to contribute to the development of the international law on provisional measures
Duas ideias irreconciliáveis? Regionalismo e Jus Cogens no Direito Internacional
A ideia de normas peremptórias de direito internacional perpassa o discurso jurídico internacionalista há pelo menos três décadas. No entanto, sua matriz universalista se fragmentou em abordagens e compreensões regionais. Em paralelo, sistemas regionais passaram a reconhecer normas específicas como parte do jus cogens a nível regional, afastando o pressuposto de universalidade. Nesse artigo, a regionalização do jus cogens é investigada a partir dessas duas perspectivas, com fundamento na prática de codificação pela Comissão de Direito Internacional (CDI) e na prática estatal. Seu objetivo é compreender o entrelaçamento entre o conceito de regionalismo e o desenvolvimento de normas de jus cogens enquanto fontes de direito internacional. Além disso, as abordagens regionais sobre o jus cogens são analisadas mediante a análise do uso da peremptoriedade pela Corte Interamericana de Direitos Humanos (CtIDH), sublinhando a tendência do tribunal à universalidade e algumas dificuldades apresentadas pela noção de jus cogens diante da função judicial da CtIDH. O estudo prova-se original diante da dupla-conceituação entre regionalismo e produção normativa de normas peremptórias: seja pelo diálogo interpretativo entre normas de jus cogens universais e órgãos regionais, como a Corte Interamericana; seja pelo papel ativo na produção de supostas normas peremptórias regionais destes mesmos órgãos. O trabalho conclui que, embora a ideia de universalidade esteja profundamente enraizada na própria noção de normas peremptórias, a interpretação da ideia de peremptoriedade é essencialmente matizada pelas necessidades locais — especialmente no Sistema Interamericano

A Satisfactory Answer? The Enrica Lexie Award and the Jurisdiction over Incidental Questions
This article situates the Enrica Lexie award’s stance on the Tribunal’s jurisdiction over the marines’ immunity within the broader debate on the scope of the jurisdiction of international courts and tribunals over incidental questions. After illustrating the Tribunal’s approach to the question at hand, the paper appraises those instances where an international tribunal with limited jurisdiction can decide issues and apply rules that are “external” to its principal jurisdiction. It then focuses on the question of the jurisdiction over incidental issues, which is the most debated avenue for an international tribunal to engage with substantive matters falling outside the scope of the tribunal’s ratione materiae jurisdiction. Finally, the Tribunal’s approach in the Enrica Lexie award is critically assessed against the above debate. It is submitted that, although the award arguably put an end to the longstanding dispute between India and Italy, the Tribunal’s reasoning does not seem to be in line with the conditions for the exercise of jurisdiction over incidental questions as roughly sketched in relevant case law
