The current practices of Islamic build operate transfer (BOT) financing contracts: a legal analysis
Build Operate Transfer (BOT) is a kind of legal mechanism of privatisation. It is a business venture between the government and the concessionaire, with the ownership of the project asset transferred to the government at the end of the concession period. In Malaysia, a decade after the beginning of privatisation was marked by the emergence of capital market which consisted of conventional and Islamic capital market. Both Islamic and conventional capital markets facilitate the privatisations and infrastructure projects by the issuance of bonds, equity financing securities and Islamic securities. Islamic BOT financing is a new type of contract in contemporary Islamic law, and it is resulted from the modern infrastructure development needs. Although the financing of BOT is new to the Islamic law, the specific contracts used in the structure are common to the Islamic principles of muamalat (i.e. Islamic transactions) like sale, partnership and lease contract. The objective of this work was to study the current practices of the Islamic BOT financing contracts in Malaysia and other countries. The study adopted an analytical approach by assessing the strengths and weaknesses of the financing contracts via the sale, partnership, and lease contract. Finally, the findings showed that sale-based financing is more popular to the Project Company of BOT in Malaysia due to the fixed return and deferred payment mechanism. On the other hand, the mudarabah and musharakah contract provides an alternative to the project since both structures are in the form of business venture and lease-based financing which exploit the beneficial interest of an asset
Kelestarian alam sekitar dan pembiayaan teknologi hijau dari perspektif Undang-Undang Syariah
Makalah ini bertujuan membincangkan hubung kait antara konsep kelestarian alam sekitar, tenaga hijau dan teknologi hijau dari perspektif undang-undang syariah. Pembiayaan teknologi hijau secara Islam merupakan cabaran kepada industri kewangan. Kaedah kualitatif dan pendekatan harmonisasi perundangan diguna pakai, iaitu prinsip undang-undang syariah diharmonikan dengan prinsip pembiayaan konvensional dan alam sekitar. Hasil kajian menunjukkan bahawa kelestarian alam sekitar dan teknologi mempunyai elemen yang saling berkaitan dan dapat direalisasikan dalam pemeliharaan dan pemuliharaan alam sekitar. Oleh itu, mewujudkan teknologi berasaskan konsep hijau dilihat sebagai satu usaha dan sumbangan yang besar kepada alam sekitar. Pembiayaan secara Islam merupakan instrumen yang sesuai untuk mempromosikan tenaga hijau dan kelestarian persekitaran
Literasi perundangan media baharu dalam kalangan belia
Fungsi utama kewujudan suatu undang-undang ialah untuk menjamin kesejahteraan diri, masyarakat serta sesebuah negara. Dalam skop penggunaan internet, terdapat lima undang-undang yang mengawalnya seperti Akta Tandatangan Digital 1997, Akta Jenayah Komputer 1997, Akta Komunikasi dan Multimedia 1998, Akta Perlindungan Data Peribadi 2010 dan Akta Fitnah 1957. Perundangan media baharu ini bertujuan mengawal segala jenis penyalahgunaan media sosial yang dilihat semakin berleluasa akhir-akhir ini. Justeru, kajian ini bertujuan mengetahui tahap kefahaman dan kesedaran golongan belia mengenai perundangan media baharu. Dari segi metodologi, kajian ini menggunakan pendekatan kuantitatif untuk mendapatkan data kajian yang berkualiti. Dalam kajian ini, responden terbahagi kepada dua kumpulan, yang pertama terdiri daripada kalangan belia, majoritinya belia di Universiti Kebangsaan Malaysia. Sebanyak 227 set borang soal selidik telah diedarkan kepada responden kumpulan pertama ini. Manakala, bagi responden kumpulan kedua ialah mahasiswa dan mahasiswi di Politeknik Ungku Omar, Ipoh, Perak. Seramai 80 responden yang terlibat menjadikan jumlah keseluruhan responden dalam kajian ini ialah 307 responden. Hasil kajian mendapati majoriti belia mepunyai pengetahuan yang baik mengenai konsep media baharu. Selain itu juga, majoriti responden iaitu golongan belia juga menyedari serta memahami undang-undang berkaitan media baharu secara umum sahaja. Sungguhpun begitu, apabila menyebut beberapa jenis atau nama undang-undang berkaitan media baharu, majoriti responden masih berada pada tahap literasi perundangan yang sederhana

Legal analysis of successful and problematic Build Operate Transfer (BOT) projects in Malaysia
The Malaysian government has adopted the Build Operate Transfer (BOT) project contractual arrangement for developing public infrastructure projects like highways and railways. In an effort to balance the economic and social needs of the community, the government has introduced a policy and legal framework to address the issue. The aim of this article is to study factors contributing to both successful and problematic BOT projects in Malaysia. The analysis reveals that there are common underlying factors contributing to the success of BOT projects such as: sound policy and regulatory framework, strong government support, clarity of project formulation and documentation, responsible sponsors and fair deals for all parties. On the other hand, the factors contributing to the problematic projects are individualised. Finally, steps to overcome the problems are elucidated to improve the efficiency and effectiveness of both BOT legal technique and privatisation in general
The development of Islamic banking laws in Malaysia: an overview
Malaysia is well regarded by the international community as one of the leading Islamic financial centers. This was evidenced by the launching of an initiative by the Malaysian Government known as the Malaysian International Islamic Financial Centre (MIFC) on 14 August 2006. Behind this successful achievement, the emergence of Islamic banking in Malaysia stemmed from the establishment of the first full-fledged Islamic bank offering Islamic products and services in 1983 known as Bank Islam Malaysia Berhad (BIMB) under the Islamic Bank Act 1983. This article examined the development of Islamic banking and financial laws in Malaysia. Firstly, the background of Islamic banking and finance is addressed. Secondly, the development of the industry is described from its infancy days until its recent achievement to become an Islamic financial hub. The next section dwells upon the issues relating to the current legislative jurisdiction and Shariah supervision on the matters. Finally, while the study illustrates that the finance industry is revolving progressively, further efforts and reformation are needed for the country to sustain as \u27Malaysia International Islamic Financial Centre\u27

Protecting Purchasers’ Right in Abandoned Housing Projects (Goal 11)
