Access to a Lawyer for Suspects at the Police Station and During Detention Proceedings
Directive 2013/48/EU of the European Parliament and of the Council of 22 October 2013 on the right of access to a lawyer lays down minimum standards concerning access to a lawyer for suspects and the accused in criminal proceedings, as well as persons subject to the European arrest warrant proceedings. The present article focus on the subject of access to a lawyer at the earliest stage of criminal proceedings – in connection with arrest as well as during proceedings concerning the use of pre-trial detention. Author analyzes in sequence: subjective scope of the right to a lawyer, the right to a lawyer for the person deprived of liberty, confidentiality of communications between the person deprived of liberty and their lawyer. Methods of initiating private prosecution proceeding
Z uwagi na konieczność realizacji celu procesu karnego w postaci konieczności zakończenia postępowania w rozsądnym terminie, zasadne wydaje się być możliwie najczęstsze stosowanie instytucji dot. uproszczonych form orzekania o odpowiedzialności karnej, w tym przepisów o postępowaniach szczególnych. Niniejszy tekst zawiera opracowanie dwóch możliwości wszczęcia postępowania prywatnoskargowego, a mianowicie prywatnego aktu oskarżenia oraz ustnej lub pisemnej skargi składanej na Policji. Autor przedstawia problemy zarówno natury faktycznej, jak i prawnej, z uwzględnieniem możliwości ich praktycznego zastosowania.In view of the need to achieve the objective of the criminal proceeding in the form of the need to terminate the proceedings within a reasonable time, it would seem reasonable to use the institution of simplified forms of criminal responsibility, including special proceedings. This article presents two options for initiating private prosecution proceeding, namely private indictment and oral or written complaint filed with the Police. The author presents problems of both – factual and legal – nature, taking into account the possibility of their practical application.
Appropriate application of the provisions of the Code of Criminal Procedure in disciplinary proceedings against attorneys and legal counsels

KULTematem pracy jest odpowiednie stosowanie przepisów Kodeksu postępowania karnego w postępowaniach dyscyplinarnych adwokatów i radców prawnych. Zgodnie z główną tezę, aktualnie obowiązujące uregulowanie kwestii proceduralnych w ww. postępowaniach dyscyplinarnych, tj. za pomocą ogólnego odesłania do odpowiedniego stosowania w kwestiach nieuregulowanych przepisów Kodeksu postępowania karnego, jest rozwiązaniem słusznym i optymalnym. Tezę główną wspierają trzy tezy szczegółowe. Po pierwsze, postępowanie dyscyplinarne jest postępowaniem represyjnym, postępowaniem karnym sensu largo. Po drugie, nie można postawić znaku równości pomiędzy odpowiednim stosowaniem przepisów kodeksowych o charakterze statycznym i dynamicznym. Więcej elementów autonomicznych, uregulowanych wprost w ustawach zawodowych, dotyczy statyki procesu karnego, co powoduje, że przepisy Kodeksu postępowania karnego ją regulujące znajdują odpowiednie zastosowanie w postępowaniach dyscyplinarnych rzadziej i w mniejszym zakresie, niż przepisy w przedmiocie dynamiki procesowej. Po trzecie, w przypadku bliźniaczych postępowań w tym samym przedmiocie, występująca w ustawach korporacyjnych dysproporcja normatywna jest nieprawidłowa, a regulacje ustawowe - o ile nie dotyczą kwestii wyjątkowo specyficznych, charakterystycznych wyłącznie dla danej grupy zawodowej - powinny być spójne. Celem udowodnienia powyższych tez autor przeprowadza analizę przepisów przede wszystkim Kodeksu postępowania karnego i ustaw zawodowych pod kątem zakresu i sposobu odpowiedniego stosowania przepisów w sprawach dyscyplinarnych.
The subject of the dissertation is the appropriate application of the provisions of the Code of Criminal Procedure in disciplinary proceedings against lawyers and legal counsels. According to the main thesis, the currently applicable regulation of procedural issues in the above-mentioned disciplinary proceedings, i.e. by means of a general reference to the appropriate application of the provisions of the Code of Criminal Procedure in matters not regulated, is the right and optimal solution. The main thesis is supported by three detailed theses. Firstly, disciplinary proceedings are repressive proceedings, criminal proceedings sensu largo. Secondly, one cannot equate the appropriate application of static and dynamic CCP provisions. More autonomous elements, regulated directly in corporate laws, concern the statics of the criminal process, which means that the provisions of the Code of Criminal Procedure regulating it are applied in disciplinary proceedings less frequently and to a smaller extent than the provisions on procedural dynamics. Thirdly, in the case of twin proceedings on the same subject, the normative disproportion occurring in corporate laws is incorrect, and statutory regulations – unless they concern extremely specific issues, characteristic only for a given professional group – should be consistent. In order to prove the above theses, the author analyzes the provisions, primarily of the Code of Criminal Procedure and corporate laws, in terms of the scope and manner of appropriate application of the provisions in disciplinary proceedings
Complaint against a Judgment of the Appeal Court in the Light of Rule of to a Fair Trial under Art. 6 ECHR
W związku z wprowadzeniem w 2016 r. do polskiego procesu karnego instytucji skargi na wyrok sądu odwoławczego autor podejmuje analizę tej instytucji z punktu widzenia prawa do rzetelnego procesu, zawartego w art. 6 EKPC. Rozważania dotyczą kolejno standardu postępowania odwoławczego i kasacyjnego, możliwości zastosowania tego standardu do skargi, a także realizacji gwarancji wynikających z art. 6 EKPC, ze szczególnym uwzględnieniem zasady równości broni. W konkluzji autor staje na stanowisku, że w postępowaniu skargowym ma zastosowanie art. 6 EKPC.The main purpose of this study is to present and evaluate institution of complaint against the cassatory judgment of the appeal court from the point of view of the right to a fair trial, provided for in Art. 6 (1) of the ECHR. The article presents arguments supporting the statement that Art. 6 (1) of the ECHR applies in complain proceeding, in the form of the standard of appeal and cassation proceedings, the possibility of applying this standard to a complaint, as well as the implementation of guarantees under Art. 6 (1) of the ECHR, with particular emphasis on the principle of equality of arms

Participation of a social representative in immunity proceedings in the light of regulations currently in force
W artykule przedstawiono argumentację na rzecz stanowiska, że przedstawiciel społeczny, o którym mowa w art. 90 § 1 Kodeksu postępowania karnego, może brać udział w postępowaniu immunitetowym, będącym „postępowaniem sądowym” w rozumieniu prawa i orzecznictwa Sądu Najwyższego. Błędny jest zatem pogląd, zgodnie z którym przedstawiciel społeczny nie może uczestniczyć w postępowaniu immunitetowym, gdyż postępowanie to jest wyłącznie elementem postępowania przygotowawczego, a więc nie jest „postępowaniem sądowym”. Aby przedstawiciel organizacji społecznej mógł brać udział w postępowaniu immunitetowym, nie jest tym samym konieczna żadna zmiana legislacyjna.The article presents arguments for the position that the social representative referred to in Art. 90 § 1 of the Code of Criminal Procedure, may participate in immunity proceedings, which are “judicial proceedings” within the meaning of the law and the jurisprudence of the Supreme Court. Therefore, the view according to which a social representative cannot participate in the immunity proceedings is erroneous, since these proceedings are only an element of the preparatory proceedings, and therefore are not “judicial proceedings”. Thus, no legislative change is necessary for a representative of a social organization to participate in the immunity proceeding
The Legal Character of Polish Disciplinary Proceedings for Advocates and Legal Advisers in Light of the Case Law of the Polish Constitutional Tribunal and the European Court of Human Rights
The article presents an analysis of the case law of the Polish Constitutional Court and the European Court of Human Rights regarding the nature of disciplinary proceedings for advocates and legal advisers in Poland. The analysis is based on a comparison of the standards outlined in the case law of both courts, demonstrating that disciplinary proceedings in legal professions in Poland have a repressive character, even though they are not formally criminal proceedings
