    The political economy of hedge fund regulation

    The currency crises and episodes of market unrest of the 1990s sparked a series of regulatory initiatives to reform the Global Financial Architecture. One of these initiatives tackled the activities of hedge funds, a type of investment vehicle that was frequently cited as one of the causes of these crises. The key research question of this thesis is why efforts to regulate an apparently destabilising aspect of financial markets failed, despite the setting up of an ad hoc forum at the international level (the Financial Stability Forum) and various domestic initiatives in the US, the country where most hedge funds operate. The thesis develops a theoretical framework that examines this regulatory inaction through three explanatory models. The first model draws upon mainstream economic accounts and argues that the empirical evidence did not justify more interventionist public regulation of hedge funds. The second model assumes that a form of relational power has been exercised at the regulatory table: those actors with an interest in leaving hedge funds unregulated prevailed over those that favoured a more mandatory approach. The third model argues that it was not just relational power that determined outcomes, but mainly the power of the structure of meaning within which discussions took place and problems were framed. This structure of meaning led to a particular formulation of the problem at stake, which excluded other concerns and actors from the regulatory agenda. Each model is analysed for its policy implications. The first model leads to regulatory solutions that rely upon private actors' due diligence and self-assessment of risk. The second model leads to policy options that favour a greater inclusion of developing countries and other stakeholder groups in decision-making processes in global finance. The third model leads to a rethinking of the very tenets of financial market regulation and of the financial theories used to explain and govern the market. The thesis argues that the third model is better able to grasp the complexity of power beyond the seemingly technical nature of financial regulation. For this reason, it is deemed more suitable to provide policy solutions that challenge the current neo-liberal framework of regulation

    Dispelling the Myths Behind First-author Citation Counts

    We conducted a full-scale evaluative citation analysis study of scholars in the XML research field to explore just how different from each other author rankings resulting from different citation counting methods actually are, and to demonstrate the capability of emerging data and tools on the Web in supporting more realistic citation counting methods. Our results contest some common arguments for the continued use of first-author citation counts in the evaluation of scholars, such as high correlations between author rankings by first-author citation counts and other citation counting methods, and high costs of using more realistic citation counting methods that are not well-supported by the ISI databases. It is argued that increasingly available digital full text research papers make it possible for citation analysis studies to go beyond what the ISI databases have directly supported and to employ more sophisticated methods

    Managers' Perceptions of Cooperation and Joint Decision-Making with Trade Unions: A Regional Case Study in the Illawarra (Australia)

    This paper examines managerial perceptions of cooperation and consultation, and tests the hypothesis of some unionists that cooperation and consultation as perceived by management minimise union input into the decision-making process. The increased adoption of a strategic HRM perspective on the employment relationship has led to a growing concern with building cooperation through employee consultation and participation at the workplace level. This perspective actually embraces two broad approaches: 'hard' HRM characterised by direct forms of job-related participation; and 'soft' HRM characterised by representative forms of participation, or joint decision making, between management and unions and/or works councils (or consultative committees), as favoured in much of Europe. The choice between these is influenced, among other things, by the industrial environment in which workplaces operate, particularly the strength of traditional industrial relations structures and perspectives. This case study is based upon a survey of employment relations managers' attitudes to cooperation and joint decision making in a region characterised by a strong traditional industrial relations infrastructure, including strong unionism. It shows that whilst strategic HRM perspectives on employee participation have developed a significant presence in the region's workplaces, they have been adapted to the industrial environment. The managers overwhelmingly reported a cooperative relationship with unions, and a significant proportion believed in joint decision making with unions, albeit over a selective range of issues. Managers of public sector, tertiary sector and large workplaces were far more inclined to support joint decision making than others. The survey results also show that those respondents who perceived a cooperative relationship indicated a greater willingness on the part of management to share input with the union than those who perceived their relationship as confrontational. The perspective of a pragmatic HRM shaped by its industrial environment is confirmed by comparing these results with those from a survey of US employee relations managers conducted by Perline and Sexton (1994). The results of this comparison diverge considerably. Perline and Sexton found for the US that 'those managers who perceived their relationship with the union to be cooperative were less likely to believe that issues should be jointly determined by management and the union', thus confirming the pessimistic union hypothesis.trade unions, cooperation, consultation, perceptions

    The Right to Strike under the United States Constitution: Theory, Practice, and Possible Implications for Canada

    Answering critics of the Canadian Supreme Court's judgment in B.C. Health, the author argues that the Court laid the foundation for a principled and durable doctrine protecting constitutional labour rights, one that goes directly to the heart of the matter — the inequality of workers’ power in the employment relation. In the author’s view, two paths could lead from B.C. Health to the recognition of Charter protec- tion for a right to strike: one that treats the right as an accessory to col- lective bargaining, and one that upholds the right directly on the basis of the Charter values of equality and participation. The author supports the latter approach, contending that constitutional rights should be defined in relation to fundamental values, in a way that is not contingent on time-bound or fact-sensitive assessments about the role of strikes within a particular collective bargaining regime. Although a Charter right to strike may involve the courts in difficult choices about when to defer to legislative policy decisions, and courts may lack the institutional capac- ity to deal effectively with labour law issues, the author points out that judges can look to ILO standards for expert guidance. Noting that the U.S. experience in this area might be of considerable use to Canadians, the author concludes by providing an overview of American case law concerning a constitutional right to strike.Peer reviewe

    Satisfiability of ATL with strategy contexts

    Various extensions of the temporal logic ATL have recently been introduced to express rich properties of multi-agent systems. Among these, ATLsc extends ATL with strategy contexts, while Strategy Logic has first-order quantification over strategies. There is a price to pay for the rich expressiveness of these logics: model-checking is non-elementary, and satisfiability is undecidable. We prove in this paper that satisfiability is decidable in several special cases. The most important one is when restricting to turn-based games. We prove that decidability also holds for concurrent games if the number of moves available to the agents is bounded. Finally, we prove that restricting strategy quantification to memoryless strategies brings back undecidability

    Robustness in Timed Automata

    In this paper we survey several approaches to the robustness of timed automata, that is, the ability of a system to resist to slight perturbations or errors. We will concentrate on robustness against timing errors which can be due to measuring errors, imprecise clocks, and unexpected runtime behaviors such as execution times that are longer or shorter than expected. We consider the perturbation model of guard enlargement and formulate several robust verification problems that have been studied recently, including robustness analysis, robust implementation, and robust control
