Subjects of Municipal Legal Policy as a Type of Legal Policy of the State
No full textThe article is devoted to the study of the issue of subjects of municipal legal policy. The author made a thorough analysis of approaches to the definition of legal policy, municipal legal policy and gives his own vision on this issue, based on scientific literature and the provisions of Ukrainian and foreign legislation. The article considers two approaches (activity and institutional) to the understanding of the concept of «legal policy» in the scientific literature and analyzes the approaches to the definition of «legal policy». Thus, the paper presents the scientific developments of the representatives of the activity approach, in which the main subject of legal policy is the state bodies, it is concluded that such an approach narrows the understanding of the subjects of legal policy. The opinions of the representatives of the institutional approach are studied and it is noted that their understanding of legal policy without the allocation of subjects is quite controversial. The paper singles out the scientific approach, according to which the subjects are understood as state and municipal bodies, it is said that such an approach also narrows the understanding of the subjects. The author concludes that the subjects of legal policy can include government agencies and non-governmental organizations (political parties, NGOs, citizens, the scientific community). Regarding the definition of subjects of municipal legal policy, the author analyzes the approach to which the subjects are public authorities, local governments and the local community. It is noted that this definition of subjects in terms of separate allocation of the local community is fully consistent with the provisions of Art. 140 of the Constitution of Ukraine. The approach to the selection of subjects of municipal legal policy, according to which the subject is local government, is studied. The author believes that this position should be criticized because the municipal legal policy is formed and implemented not only at the local but also at the national level. The results of the study conclude that the allocation of state and non-state structures as subjects is the most balanced position in the scientific literature. The author concludes that the subjects of municipal legal policy should be understood as state and non-state (political parties, public organizations, etc.) structures, as well as individual citizens, scientists. The separation of state and non-state structures as groups of subjects of municipal legal policy is substantiated, as well as their division into a number of smaller subgroups.Стаття присвячена дослідженню питання суб’єктів муніципально-правової політики. На основі наукових досліджень та положень вітчизняного та зарубіжного законодавства автором здійснено ґрунтовний аналіз підходів до визначення суб’єктів правової політики, муніципально-правової політики та наведено власне бачення з цього питання. У статті розглядається два підходи (діяльнісний та інституційний) до розуміння поняття «правова політика» у науковій літературі та на основі проведеного розподілу аналізуються підходи до визначення суб’єктів правової політики. Так, у роботі наведено наукові розробки представників діяльнісного підходу, у яких основним суб’єктом правової політики вважаються органи держави, висновується, що такий підхід звужує розуміння суб’єктів правової політики. Досліджуються думки представників інституційного підходу та зазначається, що їх розуміння правової політики без виділення суб’єктів є досить спірним. У роботі окремо виділено науковий підхід, за яким під суб’єктами розуміються державні та муніципальні органи, сказано, що такий підхід звужує розуміння суб’єктів. На підставі проведеного аналізу автор робить висновок, що до суб’єктів правової політики можна віднести органи держави та недержавні утворення (політичні партії, громадські організації, громадяни, наукове співтовариство). Звертаючись до визначення суб’єктів муніципально-правової політики автор аналізує підхід, за яким суб’єктами є органи державної влади, місцевого самоврядування та місцева громада (власне населення). Зазначається, що таке визначення суб’єктів в аспекті окремого виділення місцевої громади повністю відповідає положенням ст. 140 Конституції України. Досліджується підхід до виділення суб’єктів муніципально-правової політики, за яким суб’єктом є органи місцевого самоврядування. Автор вважає, що до такої позиції слід ставитися критично через те, що муніципально-правова політика формується та реалізується не лише на місцевому, а й на загальнодержавному рівні. За результатами проведеного дослідження висновується, що виділення державних та недержавних структур як суб’єктів є найбільш виваженою позицією у науковій літературі. На підставі проведеного аналізу наукової літератури та законодавчих актів автор доходить висновків, що під суб’єктами муніципально-правової політики необхідно розуміти державні і недержавні (політичні партії, громадські організації тощо) структури, а також окремих громадян, учених. Going Beyond Counting First Authors in Author Co-citation Analysis

counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed

Get PDF“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship
Appropriate Similarity Measures for Author Cocitation Analysis
Get PDFWe provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature. Note that the objective for the hut study was to evaluate the IRS treatment applications for residual efficacy against Anopheles mosquitoes, including the local An. coluzzii mosquito population. Cows were only used to attract mosquitoes into the huts and no tests were carried out directly on the cows. The author checklist is intended for use with studies where experiments are carried out on animals, which is why we have had such difficulty in completing this for the hut study, as many of the questions do not relate to how the cows were used
