Opposizione alla donazione dissimulata e azione di simulazione
Per la prima volta in giurisprudenza, la corte d’appello di Roma ammette la trascrivibilità immediata – cioè senza attendere un accertamento giudiziale di simulazione – di un atto di opposizione (art. 563, comma 4°, cod. civ.) avverso un negozio dispositivo dell’ereditando che il futuro legittimario ritiene dissimulare una donazione, purché sia contestualmente trascritta la domanda di simulazione. Il commento si sofferma sulle ragioni della decisione, che viene inquadrata in un contesto dottrinale in evoluzione e nel solco di un percorso giurisprudenziale non ancora giunto al termine
Diritto di famiglia e minoranze culturali
The thesis aims to analyze the issue of the effectiveness in the Italian legal system of foreign legal devices concerning family law – in particular, those pertaining to the most represented cultural minorities in Italy, which our courts have mostly dealt with.
After a concise historical reconstruction of the legal protection of minorities in national and international systems, the analysis goes into the ground of private law. The research is divided into the two sectors corresponding to the traditional division of family law: that of the relationship between spouses and that of the relationship between parents and children.
The relationship between the family core individuals is considered first. The analysis is primarily devoted to the problem – emerging from the conflict between the principle of free will and the cases of planned or forced weddings. Secondly, the issue of polygamous marriages is examined, especially for the purpose of family reunification. Finally, the thesis deals with the Islamic repudiation, which can deploy certain limited effects in Italian law.
The second part of the work is devoted to the status of children belonging to cultural minorities. The survey is first conducted with reference to “extra-conventional” forms of adoption and custody, like the kafalah of Islamic law. Second, instruction and education of children are considered, with particular reference to the issues of religious freedom.
The work highlights the absolute centrality of public order, in which it is identified the real core of the cultural minorities legal issue: every political approach in this field is ultimately based on different modulations of this concept, which represents the outer limit a legal system opposes to the effectiveness of “alien” legal devices.Il presente lavoro mira a indagare il tema dell’efficacia nell’ordinamento italiano di istituti “alieni” in materia familiare e, in particolare, di quelli proprî delle minoranze culturali più rappresentate sul territorio nazionale, di cui la nostra giurisprudenza si è maggiormente occupata.
Premessa una sintetica ricostruzione in chiave storica della tutela giuridica delle minoranze in ambito nazionale e sovranazionale, l’indagine si articola sul terreno del diritto privato. L’ambito della ricerca è suddiviso nei due settori corrispondenti alla tradizionale partizione del diritto di famiglia: quello dei rapporti tra coniugi e quello rapporti tra genitori e figli.
Vengono quindi in considerazione, anzitutto, i rapporti tra gli individui costituenti il nucleo fondamentale della famiglia. In primo luogo, l’analisi è dedicata al problema della libertà matrimoniale, emergente dal contrasto tra il principio della libera volontà nuziale e la realtà delle unioni programmate o forzate. Si passa quindi all’esame del fenomeno delle unioni poligamiche, venuto all’attenzione della giurisprudenza soprattutto ai fini del ricongiungimento familiare. Infine, viene analizzato l’istituto del ripudio, suscettibile di dispiegare taluni limitati effetti nell’ordinamento italiano.
La seconda parte della tesi è dedicata allo status dei minori appartenenti alle minoranze culturali. L’indagine è condotta, prima, con riferimento alle forme “extraconvenzionali” di adozione e affidamento: in particolare, viene presa in considerazione la giurisprudenza riguardante la kafalah di diritto islamico. In secondo luogo, sono analizzati i profili di disciplina in tema di istruzione ed educazione dei minori, specialmente a proposito del problema della libertà religiosa.
Il lavoro pone in luce l’assoluta centralità del concetto di ordine pubblico, nel quale si identifica il vero fulcro del problema giuridico delle minoranze culturali: ogni possibile approccio politico alla questione si traduce, in definitiva, in differenti modulazioni di tale concetto, il quale rappresenta il limite opposto dall’ordinamento al dispiegamento al proprio interno di effetti giuridici da parte di fattispecie connotate da elementi di estraneità
Directors’ and Officers’ liability in Italy
In recent years several cases concerning the liability of directors and officers have courted controversy. Arguments raised in such discussions oscillate between two extremes: on the one hand, the need for governing bodies to give a space to entrepreneurial discretion and on the other hand to ensure the protection of investors in and creditors of a company from the consequences of disadvantageous decisions by those bodies. In light of the geographical dispersal of the above stakeholders, the study highlights on the relevant provisions in Italy, addressing the main issues also taking into consideration and suggesting principles for better stakeholder protection
Going Beyond Counting First Authors in Author Co-citation Analysis
The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation
counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed
Variations on the Author
“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship
Appropriate Similarity Measures for Author Cocitation Analysis
We provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature. Dispelling the Myths Behind First-author Citation Counts
We conducted a full-scale evaluative citation analysis study of scholars in the XML research field to explore just how different from each other author rankings resulting from different citation counting methods actually are, and to demonstrate the capability of emerging data and tools on the Web in supporting more realistic citation counting methods. Our results contest some common arguments for the continued
use of first-author citation counts in the evaluation of scholars, such as high correlations between author rankings by first-author citation counts and other citation
counting methods, and high costs of using more realistic citation counting methods that are not well-supported by the ISI databases. We have done our best to complete the author checklist relating to the use of animals in the hut study. Note that the objective for the hut study was to evaluate the IRS treatment applications for residual efficacy against Anopheles mosquitoes, including the local An. coluzzii mosquito population. Cows were only used to attract mosquitoes into the huts and no tests were carried out directly on the cows. The author checklist is intended for use with studies where experiments are carried out on animals, which is why we have had such difficulty in completing this for the hut study, as many of the questions do not relate to how the cows were used
