A representação do trabalho feminino em Os Corumbas, de Amando Fontes, e Em Surdinas, de Lúcia Miguel Pereira: um olhar sob a ótica do dano existencial
O tema da presente tese é o estudo do dano existencial frente a sua ponderação a partir do processo de leitura ficcional. Os textos ficcionais dos romances de 30 no Brasil se prestam a diversas possibilidades de análise, graças ao cunho social das suas narrativas. Nos corpora Os Corumbas e Em surdina, as personagens femininas sofrem dano existencial perante um tema comum, o trabalho. No primeiro, as proletárias das indústrias têxteis sergipanas nos anos 20, sofrem dano existencial, pois o trabalho é o único meio de subsistência, mas é nesse ambiente de exposição pública que elas caem na prostituição. Já no Rio de Janeiro, no mesmo período, está Cecília, mulher de origem burguesa impedida de ocupar um posto de trabalho por preconceito, já que o pai teme o desprestígio familiar se ela tiver acesso a um posto de trabalho. O dano existencial se caracteriza quando um indivíduo perde seus projetos de vida ou a sua vida de relação, por culpa de terceiros, que impedem o livre exercício da sua existência enquanto pessoa. A interdisciplinaridade unindo Letras e Direito se materializa com a interpretação hermenêutica da teoria literária do efeito estético, do alemão Wolfgang Iser, e do Jurisprudencialismo, teorizado pelo filósofo do Direito português António Castanheira Neves, busca-se encontrar as convergências possíveis nas teorias que a leitura dos textos têm em comum entre as duas áreas. A análise da caracterização do dano existencial parte da doutrina italiana, nascedouro do instituto jurídico de dano existencial, com pesquisas mais profundas de Paolo Cendon e Patrizia Ziviz. Partindo-se da ficção, chega-se à leitura e análise de casos jurídicos concretos, os quais fizeram história no universo jurídico contemporâneo, pois um trata do primeiro caso de dano existencial julgado no estado do Rio Grande do Sul e o outro aborda o caso da jovem empregada doméstica, mantida sob trabalho análogo à condição de escrava, na Bahia.The theme of this thesis is the study of existential damage regarding its weighting from the process of fictional reading. The fictional texts of the novels of 30 in Brazil allow various possibilities of analysis, because of the social nature of their narratives. In corpora Os Corumbas and Em surdina, the female characters suffer existential damage due to a common theme, work. In the first one, the proletarians of the textile industries in Sergipe in the 1920s suffer existential damage, since work is the only means of subsistence, but it is in this environment of public exposure that they fall into prostitution. In Rio de Janeiro, during the same period, Cecília is a woman from bourgeois origin who is prevented from occupying a job because of prejudice, since her father fears family disgrace if she has access to a job. Existential damage is characterized when an individual loses his/her life projects or his/her life of relationship, because of third parties, that prevent the free exercise of his/her existence as a person. The interdisciplinarity connecting the study of language and literature (area of study which is called Letras in Brazilian Portuguese) and Law materializes through the hermeneutic interpretation of the aesthetic effect literary theory, developed by German Wolfgang Iser, and Jurisprudentialism, theorized by the Portuguese philosopher António Castanheira Neves, trying to find the possible convergences in the theories that the reading of the texts has in commom regarding the two areas. The analysis of the characterization of the existential damage starts from Italian doctrine, where the legal institute of existential damage was born, with deeper investigations conducted by Paolo Cendon and Patrizia Ziviz. Starting from fiction, it is possible to begin by the reading of concrete legal cases, which made history in the contemporary legal universe, since one deals with the first case of existential damage judged in the state of Rio Grande do Sul and the other addresses the case of a young maid, who was kept under slave labor in Bahia
Going Beyond Counting First Authors in Author Co-citation Analysis
The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation
counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Variations on the Author
“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship
Appropriate Similarity Measures for Author Cocitation Analysis
We provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature. Dispelling the Myths Behind First-author Citation Counts
We conducted a full-scale evaluative citation analysis study of scholars in the XML research field to explore just how different from each other author rankings resulting from different citation counting methods actually are, and to demonstrate the capability of emerging data and tools on the Web in supporting more realistic citation counting methods. Our results contest some common arguments for the continued
use of first-author citation counts in the evaluation of scholars, such as high correlations between author rankings by first-author citation counts and other citation
counting methods, and high costs of using more realistic citation counting methods that are not well-supported by the ISI databases. O presente estudo visa fazer uma análise acerca do poder diretivo do empregador e suas limitações em face dos direitos de personalidade do empregado, mais especificamente em relação à dignidade da pessoa humana e o direito à intimidade. São inúmeras as situações de abuso do poder diretivo no cotidiano laboral. Nesse trabalho, com a intenção de demonstrar algumas dessas situações, o estudo aborda especificamente sobre o uso de câmeras de vigilância no ambiente laboral, o controle do correio eletrônico, a revista íntima e a solicitação excessiva de prestação de horas extras pelo empregador, apresentando as consequências do abuso do poder diretivo nesses casos, como as indenizações por dano moral e existencial. Conclui-se que o empregador, munido do poder diretivo, tem todo o direito de regulamentar, fiscalizar e disciplinar seus empregados, entretanto,no que tange aos direitos de personalidade, encontrará limitações na lei, nos princípios e no ordenamento jurídico,fazendo com que esse poder, a partir do seu exercício abusivo, se torne ilegal e ilegítimo (sic).The present study aims at analyzing the employer's directive power and its limitations in the face of the employee's personality rights, more specifically in relation to the dignity of the human person and the right to privacy. There are innumerable situations of abuse of the directive power in the daily work. In this paper, with the intention of demonstrating some of these situations, the study specifically addresses the use of surveillance cameras in the workplace, the control of electronic mail, the intimate magazine and excessive solicitation of overtime by the employer, presenting the consequences of the abuse of the directive power in these cases, such as compensation for moral and existential damage. It is concluded that the employer, with the directive power, has every right to regulate, supervise and discipline its employees, however, with respect to personality rights, will find limitations in the law, principles and legal system, causing this power, from its abusive exercise, becomes illegal and illegitimate (sic)

We have done our best to complete the author checklist relating to the use of animals in the hut study. Note that the objective for the hut study was to evaluate the IRS treatment applications for residual efficacy against Anopheles mosquitoes, including the local An. coluzzii mosquito population. Cows were only used to attract mosquitoes into the huts and no tests were carried out directly on the cows. The author checklist is intended for use with studies where experiments are carried out on animals, which is why we have had such difficulty in completing this for the hut study, as many of the questions do not relate to how the cows were used
Reforma trabalhista e a análise da homologação dos acordos extrajudiciais como método de proteção ao empregado
Tendo em vista a numerosa demanda judicial trabalhista, a Lei nº 13.467/2017 introduziu um dispositivo para a solução de conflitos trabalhistas que passa a ser permitido pela Justiça do Trabalho, em que visa a autonomia das partes para conciliar sem o meio litigioso do judiciário, empregando o poder do magistrado apenas para a homologação das transações extrajudiciais. Assim, pesquisa-se sobre esse novo método de conciliação, qual seja, a homologação de acordos extrajudiciais, bem como sua real eficácia, abordando todos os requisitos legais e verificando acerca das vantagens e desvantagens dessa negociação. Para tanto, é necessário o estudo por meio dos princípios que norteiam o Direito do Trabalho, em especial os acordos extrajudiciais trabalhistas, visto que o trabalho versa a respeito da proteção do empregado. Portanto, o estudo se baseia na segurança jurídica para as partes, mormente ao trabalhador por ser parte hipossuficiente da relação e de maior vulnerabilidade. Realizou-se uma pesquisa bibliográfica, formada por leis, doutrina, livros, artigos de revistas e periódicos e análise jurisprudencial. Constatou-se, dessa forma, que é necessário o olhar aprofundado em cada caso concreto pelo magistrado, a fim de considerar os princípios da autonomia da vontade das partes e proteção ao trabalhador, impedindo a homologação de acordos prejudiciais ao empregado, respeitando os limites dispostos com a Lei. O aumento do número de transações homologadas, restou compreendido que os acordos extrajudiciais são uma opção viável, célere e segura ao empregado. [resumo fornecido pelo autor]In view of the numerous labor judicial demands, Law 13.467/2017 introduced a device for the resolution of labor conflicts that is now allowed by the Labor Court, in which it seeks the autonomy of the parties to reconcile without the litigious means of the judiciary, employing the magistrate's power only to ratify extrajudicial transactions. Research on the new method of conciliation, as well as its real effectiveness, addressing all legal requirements and verifying about the advantages and disadvantages of this negotiation. Therefore, it is necessary to study through the principles that guide Labor Law, especially labor agreements, since the work is about employee protection, therefore, the study is based on legal security for the parties, especially to the worker for being a low-risk part of the relationship and of greater vulnerability. A bibliographic search is then carried out, formed by laws, doctrine, books, magazine and periodical articles and jurisprudential analysis. It was found, therefore, that it is necessary to look deeply into each specific case by the magistrate, in order to consider the principles of autonomy of the parties' will and protection of the worker, preventing the approval of harmful agreements to the employee, respecting the limits in Law. The increase in the number of ratified transactions was understood that extrajudicial agreements are a viable, quick and safe option for employees. [resumo fornecido pelo autor
