    Independent Medical Review: Expanding Legal Remedies to Achieve Managed Care Accountability

    Author Leatrice Berman-Sandier reports on independent medical review (IMR), a state-based statutory remedy used to resolve disputes over coverage between patients and their health plans. Ms. Berman-Sandler explores the connection between ERISA preemption and IMR, and opines that in light of recent Supreme Court decisions, the stage has been set for expansion of IMR. Accordingly, Ms. Berman-Sandler concludes that there are strong legal and policy reasons for state legislatures to broaden the application of IMR and for the Court to continue to narrow ERISA preemption in order to increase accountability in the managed care arena

    L’article examina la crònica/memòria de Sabina Berman La bobe, en què l’escriptora mexicana entreteixeix les experiències migratòries jueves intergeneracionals a través de la relació entre tres generacions de dones. La perspectiva analítica es centra en la seva aproximació a l’exili i l’herència cultural. L’article introdueix dos moviments conceptuals clau: “praxis eròtica” i “kinopoètica”, per a transformar la manera tradicional amb la qual es conceptualitza el desplaçament i la migració. A través del marc teòric del materialisme cinètic de Thomas Nail, el text demostra com l’obra de Berman privilegia el moviment com a principi generatiu. Tot plegat s’exemplifica a través del seu estil narratiu, que oscil·la entre una perspectiva tràgica i còmica, i que manté una tensió productiva. A l’últim, l’article argumenta que Bergman desafia les narratives migratòries tradicionals i ofereix alternatives creatives mitjançant la comèdia i una lògica femenina, tot reimaginant l’exili com un procés vital i imaginatiu. Més enllà de l’obra de Berman, aquesta aproximació articula una nova forma de conceptualitzar les relacions i les poètiques interexilíaques basades en el paradigma del moviment i l’erotisme.This article examines Sabina Berman’s chronicle/memoir La bobe, where the Mexican author interweaves intergenerational Jewish migration experiences through the relationships between three generations of women. The focus is on her approach to exile and cultural heritage. By introducing two key conceptual movements “erotic praxis” and “kinopoetics”, the article aims to transform the traditional understanding of displacement and migration. Drawing on Thomas Nail’s theoretical framework of kinetic materialism, it demonstrates how Berman’s work privileges movement as a generative principle. This is exemplified through her narrative style, which oscillates between tragic and comic perspectives, maintaining a productive tension. Ultimately, the article argues that Berman challenges traditional migration narratives by offering creative alternatives through comedy and a feminine logic, reframing exile as a vital, imaginative process.     This memoir recounts the author’s first meetings with David Soren in Tunis and Rome during the summer of 1970. It also records an influential visit to the Roman apartment of a major artist and collector of Etruscan antiquities, Eugene Berman (1899–1972), that same summer and gives a brief description of the collection, now the property of the Italian State.     Proving Relative Lower Bounds for Incremental Algorithms

    A general powerful method that permits simple proofs of relative lower bounds for incremental update algorithms is presented. This method is applied to derive a hierarchy of relative incremental complexity. Which classifies functions by relative lower bounds. We demonstrate our technique by bounding a number of incremental algorithms drawn from various domains. The method described expands upon work by Paull, Berman, and Cheng ~71 and generalizes a result of Even and Gazit 2. Our results have interesting implications with respect to the optimality of an incremental algorithm previously developed by Ryder in [9, 101. We also show that for certain graphs, Frederickson's update algorithm for minimum spanning tree is nearly optimal. Perhaps most importantly, the proof method and hierarchy suggest which types of problems are likely to yield good incremental algorithms (i.e., of lower complexity) and which cannot be improved by an incremental approach.Technical report DCS-TR-15

    The problem of protecting consumer interests in the regulatory process is viewed from the free enterprise, progressive, and pluralist paradigms. Berman considers the characteristics of each paradigm, the ways reformers have sought to implement each, and how they interact and shape the nature of the regulatory system. The greatest conflict lies between the free enterprise and progressive paradigms on the need for regulation. The author concludes, however, that the regulatory system can best be viewed as a blend of the different paradigms-unstable though that blend may be.     The text discusses a monograph by Piotr Rypson about Mieczysław Berman. When we consider Czerwony monter [The Red Assembler], however, we need to refer to a concept that is closely akin, namely, Andrzej Leder’s take on revolution. What is underscored here is Berman’s composite photographs since, as the author of this discussion believes and expands upon in her text – they depict most accurately the times of the photo designer’s life. He is considered the creator of the communist propaganda’s graphical language. And that is probably why a considerable period has had to elapse before he became again considered “worthy” of the scholarly interest. It seems, in this day and age, important to reconsider the works of this world-renown “assembler” of red propaganda, merely in order to trace the remnants of his style in the graphic-design culture of today.The text discusses a monograph by Piotr Rypson about Mieczysław Berman.
